I worked with these folks over at Jones, Skelton and Hochuli before they broke off into another firm. While I like a majority of these folks, the administrator is awful. If she doesn’t like you you’re out. Her name is Kara. And she fires people if they get cancer. Unless, of course, you’re a lawyer. Just think about this before choosing this firm as your law firm. And Rachel Love, Tonya died. Your assistant, that you loved so dearly passed away from ovarian cancer, and wasn’t given the opportunity to come back to work after treatment. Because Kara, who is now your administrator, told her that she has CANCER and there’s no place for her at the firm anymore. Tim is great. Rachel, I thought you were a nice person. Apparently I was wrong.

I am profoundly disappointed with the legal representation provided to Chris Kelly. The manner in which his case has been handled is extremely unjust, reflecting a lack of due diligence and proper advocacy on his behalf. Furthermore, our attempts to reach out and address these concerns have been met with silence, as there has been no response to multiple contact requests. This lack of communication only exacerbates the frustration and sense of injustice surrounding this matter.

They are a well ran establishment and he was very constructive in meeting my expectations as my defense attorney, I was dealing with a lot outside of this issue and he understood that and was very helpful and supportive in every way necessary as my attorney. I would highly recommend him if you are looking for a genuine hardworking attorney who is able to get the job done accordingly

Called and made an appointment in the office. So I drove 20 minutes to the office. Once I got to the office, the front desk lady asked me who I was here to see and no name was given to me so I called them to let them know I was here (and on time). They told me they’d send someone to come get me. I sat and waited over 20 minutes. So I called them again and it went to voicemail. Waited 10 more minutes and nothing. I feel it is very unprofessional especially when there is an appointment scheduled. I had other things to do and went out of my way to get a babysitter and drive all the way down to the office. Very disappointing.

I used this attorney back in 2009. She charged me a $4,000 retainer. My ex and I were able to work a lot of stuff out on our own, she she ended up having to do very little work for me. Well, she made sure she kept her $4,000 by charging for every little thing. She also left some very important items out of the parenting agreement. She claims I told her to leave them out, but I did not. Any good lawyer would not have left them out. As another reviewer stated, she "nickeled and dimed". I feel that overcharged me for the work she did and that her work was inadequate.

Hired Marc by default only to be insulted and and treated very rudely. After going to work he continued to increase his fees and insults he worked harder in finding ways to charge me more then he would on my case. He would only return my calls when he felt like it. I would give him the information he requested only for him to confuse and mix-up the information then complain about having to do the work. finally imputing your information given to him incorrectly and charging me almost double what I was originally quoted. yet he complained about everything. Then after charging me double and making the entire event more difficult he quit halfway through and charged me a highly inflated amount. I still had to hire another attorney to finish the case and do damage control. Do yourself a favor and hire a competent attorney one that doesn’t blame you for all of his mistakes.

Stanley Murray was a God-sent for my post-divorce care. When my ex appealed the divorce Ruling, Stan Murray was efficient, effective, calming and compassionate. He was quick to respond to my questions, calls and emails. He always explained issues in terms that I could understand. I was so impressed with his abilities for the appeal that I hired him for the remainder of the post-divorce details, which were extensive. At times, I was emotional and scared. He has talked me off the ledge on several occasions, in a compassionate manner. In the end, he was an effective diplomat during the crisis management of helping me and my ex to negotiate the best possible deal for each of us. I recommend Stan to anyone needing a strong and steady hand through the ordeal of a difficult divorce.

Trevor White tried to say that items were not left to me and even sent me an email saying that he thought I only wanted those items for my parents, which wasn't true. As an executor, I didn't think it was any of his business what I did with items left to me. I could have chopped them up and burned them and it still wouldn't be any of his business. Was ill prepared for Court and got us destroyed. Lied to me and said I couldn't appeal until it was too late to appeal and then was like "oh yeah, I guess we could have done that." Messed up my evidence. Flubbed questions and countless opportunities in Court. Told opposing Counsel stuff he shouldn't have. Gave up way too much way too early. Completely off base. SLOW in every way, especially in court & responding. He was more nervous than I was. Sure, he seemed real nice. Took forever to respond. Responded rudely and dismissively. Took his money and ran (sent me demands in less than 5 minutes after they sent me a bill because he doesn't know how his own billing works - their bills run really late.) I would give this attorney zero if I could because of her ethics. She is willing to represent deadbeat parents who abandon their children.. She uses the law and the system to benefit them and encourages bad behavior to keep the case going. She bounces around from law firm the law firm having worked for several over the last eight years. This attorney does not care about right and wrong in my opinion. She is simply a tool of the industry that loves to recommend/encourage useless services and keep a case going. All to the detriment of all parties involved except for her pocketbook, of course.. I never talked to this attorney personally, but I know people who have worked with and against her, and it is all the same outcome. The divorce industry wins and the people lose.. if care about your children in a divorce steer clear from this attorney.

A friend of mine - wrongly convicted - received Kerrie as his court-appointed counsel for his appeal. What a joke. She filed a one-issue brief and didn't even correctly cite the record. If you know anything about appeals, you know that you can only further appeal the issues that were preserved. She preserved one out of the myriad of issues in the trial court, so now he's screwed. He said he received very little communication from her and he filed a motion to force her to withdraw, which was granted over 12 days ago now. The court ordered immediate withdrawal and transfer of the record items and she has yet to do so.

I wanted a Rule 32 in my case. I filed the paperwork for a post conviction relief (Rule 32) and asked to be assigned a public defender to help me with my case. The judge granted the public defender request and assigned Kerrie Droban. The only contact I had was a single letter the office sent me saying she only does work by mail (snail mail) and wont do anything by e-mail or phone. I got to know nothing about what was going on...if anything. Then one day a random letter shows up saying Kerrie Droban's office cant find anything wrong with my case after they looked at the transcripts (this being 6 months after I 1st filed the rule 32 motion) . I understand getting transcripts, but that does not take 6 months. Plus that was not even the problem in my case. My probation officer lied in court, told the judge I had committed 1000 arsons when I have committed zero, not even my crime. My probation was violated because probation violated a court order and punished me for it. How hard is it to put in a motion to clarify, get a response, put in a motion to enforce, and make a judge understand I cant violate probation for doing everything the court says.

She thoroughly botched the job of PC when she was assigned, spending many months and thousands of dollars, ultimately failing to protect my children. I had to go to court to have her removed from the case early and then spend more time and money unravelling the damage she did. Ultimately I prevailed and we are on a better track, but in my opinion Nanette had a hard time transitioning from being a Judge to a Parenting Coordinator. She brought very little that was productive to the table. I am writing this review in lieu of filing a formal complaint with the State Bar, I honestly don't have the energy, or enough bitterness to do this woman professional harm. She is in the twilight of her career and I'm certain there is a role for her somewhere, I just wouldn't engage her as a Parenting Coordinator.

I contacted this lawyer regarding a social security disability claim. He cancelled our appointment less than one hour before the appointment for “a family emergency”. He told me to drop by and meet his assistant who would be handling the case. I assumed he meant next time I was in town. He called back one hour later and left a message wanting to know why I didn’t keep my appointment. I called back the next day to apologize to his assistant, assuming I misunderstood. She was unavailable so I left a message. I called back the next day, and was again told she was unavailable, so I left another message. I called back a third time, and after being on hold over five minutes was told she couldn’t be located. At this point I left the message for her to please send me the paperwork to sign in order to get things working. Two days later, I received correspondence from him. Instead of a contract to sign, I received a cancellation letter for failure to keep scheduled appointment (which he cancelled) and failure to return phone calls. I don’t know how good he is as a lawyer, I never got that far.

What an Appeals Lawyer Can Do for You

An appeals lawyer specializes in representing clients in appellate courts, challenging or defending lower court decisions. If you believe that a legal error was made during your trial or that the court’s decision was unjust, an appeals lawyer can help you appeal the ruling to a higher court. They work to identify mistakes made during the trial, such as improper application of law, exclusion of key evidence, or jury misconduct. On the other hand, if you're defending a favorable judgment, an appeals lawyer can help protect the decision from being overturned.

Appeals lawyers don’t retry the case but instead focus on legal arguments and procedural issues to convince the appellate court to either overturn, modify, or uphold the lower court’s decision.

When Should I Hire an Appeals Lawyer?

Hiring an appeals lawyer is necessary when you are involved in a legal appeal, either as the appellant (the party appealing the case) or the appellee (the party defending the lower court’s ruling). Common situations in which you should hire an appeals lawyer include:

  • Appealing a conviction or ruling: If you’ve been convicted in a criminal case or lost a civil case and believe the decision was based on legal errors or improper procedures, an appeals lawyer can review the case and file an appeal on your behalf.
  • Challenging a sentence: In criminal cases, if you feel that the sentence is excessively harsh or not in line with legal standards, an appeals lawyer can work to reduce or modify the sentence.
  • Defending a lower court ruling: If the opposing party has filed an appeal to overturn a favorable ruling, an appeals lawyer can help defend the judgment and argue that the lower court’s decision should be upheld.
  • Complex legal issues: If your case involves complicated legal issues or interpretations of the law, an appeals lawyer can provide the necessary expertise to argue those points effectively before an appellate court.
  • Reviewing trial errors: Appeals lawyers can examine whether mistakes such as jury misconduct, improper exclusion or admission of evidence, or incorrect jury instructions occurred during the trial.

You should hire an appeals lawyer as soon as you decide to appeal or are informed that the other party is appealing the case, as appellate procedures are time-sensitive.

What Does an Appeals Lawyer Do?

An appeals lawyer provides specialized legal services to challenge or defend a lower court decision. Their role focuses on legal arguments, reviewing the trial record, and persuading the appellate court to either reverse or uphold the ruling. They can:

  • Review the trial record: Appeals lawyers meticulously review transcripts, evidence, and rulings from the original trial to identify any legal errors or procedural mistakes that could be grounds for appeal.
  • Prepare and file briefs: Appeals lawyers write legal briefs that present persuasive arguments to the appellate court. These briefs focus on the legal errors made during the trial and how they affected the outcome.
  • Present oral arguments: In many appeals, lawyers present oral arguments before a panel of judges, explaining why the lower court’s decision should be reversed or upheld based on legal principles.
  • Monitor case law developments: Appeals lawyers stay updated on changes in the law and precedents set by higher courts, which can be crucial in shaping the arguments they present during the appeal.
  • Provide legal advice on the likelihood of success: Appeals lawyers can offer a realistic assessment of your chances of winning the appeal based on the legal errors and evidence from the trial.

How Are Appeals Lawyers Paid?

Appeals lawyers typically charge for their services based on the complexity of the appeal and the amount of work required to prepare briefs and present arguments. Common payment structures include:

  • Hourly rate: Many appeals lawyers charge by the hour due to the significant amount of research, writing, and preparation involved in appeals. Hourly rates can range from $200 to $600 or more, depending on the lawyer’s experience and the case’s complexity.
  • Flat fee: For some straightforward appeals, a lawyer may charge a flat fee that covers all the work necessary to complete the appeal.
  • Retainer fee: In complex or high-stakes appeals, a lawyer may require a retainer, an upfront payment that covers the initial stages of the appeal. The lawyer then bills against this retainer for ongoing work.

It's important to discuss fees and costs upfront with your lawyer during the initial consultation to ensure you understand the financial commitment involved.

How Much Does an Appeals Lawyer Cost?

The cost of hiring an appeals lawyer varies depending on factors such as the complexity of the case, the lawyer’s experience, and the amount of work involved. General cost estimates include:

  • Straightforward appeals: For simpler appeals, such as those involving minor legal errors, fees can range from $5,000 to $15,000, depending on the scope of work.
  • Complex appeals: Appeals that involve complicated legal issues, multiple grounds for appeal, or high-stakes outcomes can cost anywhere from $20,000 to $100,000 or more, especially if the case requires extensive legal research, brief writing, and oral arguments.
  • Hourly rates: Many appeals lawyers charge hourly rates ranging from $200 to $600 per hour, with higher rates often associated with more experienced attorneys or particularly challenging cases.

Before proceeding with your appeal, it’s crucial to ask for a clear estimate of the costs involved so you can budget appropriately.

Top Questions to Ask an Appeals Lawyer

Before hiring an appeals lawyer, it’s essential to ask questions to ensure they are well-suited for your case and that you understand the appeals process. Important questions include:

  1. What experience do you have with appeals?
Ensure the lawyer has substantial experience handling appellate cases, particularly in the area of law relevant to your case (e.g., criminal, civil, family, etc.).
  2. How do you charge for appeals?
Ask whether the lawyer charges an hourly rate, a flat fee, or a retainer, and request an estimate of the total costs for handling your appeal.
  3. What is the likelihood of success for my appeal?
A good appeals lawyer should provide an honest assessment of your case’s strengths and weaknesses and the chances of winning the appeal.
  4. How long will the appeal process take?
Ask for an estimate of how long the appeal process might take, from filing the initial briefs to a final decision by the appellate court.
  5. Will you personally handle my appeal?
In larger law firms, junior attorneys or legal assistants may handle some of the research or drafting. Clarify who will be responsible for preparing and arguing your case.
  6. What is your approach to handling appeals?
Some lawyers may be more inclined to focus on procedural issues, while others emphasize broader legal arguments. Make sure the lawyer’s approach aligns with your goals.

How to Check the Credibility of an Appeals Lawyer

To ensure that you’re hiring a reputable appeals lawyer, take the following steps to verify their credentials and experience:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no history of disciplinary actions.
  • Look for appellate experience: Review the lawyer’s website or profile to ensure they specialize in appellate law and have successfully handled appeals similar to yours.
  • Check client reviews and testimonials: Look for client feedback on platforms like Avvo, Martindale-Hubbell, or Google to get insight into the lawyer’s track record and client satisfaction.
  • Ask for references: A credible lawyer should be willing to provide references from past clients who can speak to their expertise and success in handling appeals.
  • Look for recognition in appellate law: Membership in organizations like the American Academy of Appellate Lawyers (AAAL) or awards and recognition in appellate law can indicate a lawyer’s expertise in this specialized area.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with an appeals lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Trial transcripts and court records: The lawyer will need a complete record of the original trial, including transcripts, motions, exhibits, and the final judgment or order.
  • Legal briefs from the trial: If any briefs or motions were filed during the trial, bring copies so the appeals lawyer can review the legal arguments that were presented.
  • Written decision or verdict: Bring the court’s written ruling, verdict, or decision so the lawyer can identify any potential errors or issues to raise on appeal.
  • Questions about the appeal process: Write down any questions you have about the appeal’s timeline, costs, and potential outcomes.
  • List of potential legal errors: If you believe specific mistakes were made during the trial (e.g., improper evidence, legal misinterpretations), provide a list of those issues.

Being well-prepared for your consultation allows the lawyer to assess your case more effectively and provide the best guidance on how to proceed with your appeal.
