I would not recommend the Law Office of Theresa Napolitano. Short Version: Back in the days when we had no yelp, in 2002, to be specific, her office screwed up my H1B1 application that I paid $3000 plus for including the expedited processing fee. They filed it non-expedited. Never really apologized or refunded any fees paid. Napolitano's incompetence and refusal to take my questions seriously nearly cost me a job that it took me a year to find. Thankfully, the employer was willing to wait 3 months for an application that a competent attorney could have turned around in 3 weeks.

Mr. Kong is a good lawyer and I am surprised that there are several negative reviews on this site. My experience with Mr. Kong has been great on several tough cases. I am a business man, with assets in real estate and contracts in restaurants. Mr. Kong also helped me and my business with immigration filings. Not every lawyer is right for every client, but Mr. Kong is right for me. Mr. Kong charges a premium, but he always gives me a discount as well! Still expensive but worth the advise and help he has given me on the sales and purchases of my real estate investments. I recommend him highly.

Hired him for an office closing several years ago. At the time, we just didn't know any better. Now we do. He spoke to us very minimally, and in between his constant gum-chewing, managed to answer most of our questions with "well, there's nothing we can do about that...." Now we're being slapped with a late penalty from the Dept of Finance because the transfer tax was filed 3 months LATE. Our current attorney says that it was the Title Company's responsibility to file it on time...and guess who chooses the Title Company?....yup, our wonderful attorney Mr. Kong....

I hired Stewart for a Visa application. Over the two year process ( I was quoted a 6 month time frame) he coerced money from me, ignored my emails, failed to provide proper information to me in a timely and professional matter. He had told me upon consultation that he had never lost a case, my case was denied. My experience with him was a complete waste of time and money. DO NOT hire him for ANY kind of legal advice. Just walk away.

My employer used Lisa and her team for my H1-B petition. Dealing with her and her team, especially given I was the beneficiary of the petition but not, in their view, the client, was torture. Unresponsive, unprofessional, sloppy, lacking transparency and, I suspect, incompetent. They are negligent with matters of people’s livelihood. My H1-B was mysteriously rejected and I was never able to get to the bottom of why that occurred. Regardless of the cause, their reaction was basically to shrug. If your employer proposes to use Fragomen for your immigration matters I would be very wary.

Probably one of the worst immigration attorney and least responsive attorney I have ever seen. I work in the legal industry and have never seen a worse big law attorney than her. The employer of my family member hired Fragomen as the law firm for their immigration petitions. In term of timing for submitting the petitions and responding to RFEs, she gave about 3 different deadlines and missed all of them. We emailed her repeatedly without any response. Company HR reached out to her for a month without any kind of response. No response to phone calls. One time she went on PTO for a week without telling us or HR that she's going to miss another self-set DDL. Utterly disgusting.

It’s a nightmare to deal with Lisa. She was utterly unprofessional and ill-prepared for multiple conversations during our consultation. I felt like I was educating her the details of the law. Worse still, she didn’t seem to be concerned about my emergency and acted arrogant. She constantly dismissed my views and gave wrong legal advice until I corrected her! She also implied that I couldn’t afford her services, while I certainly would not wish to have her as my immigration lawyer after such bad experience.

- Charged for every little thing, from the regular contract, to 2 contract changes, to difficultly dealing with the buyer. - Cannot answer or advise on legal proceedings, had to ask a different lawyer instead. - Did not re-type the Contract of Sale. In the end, the contract looked like a C+ graded paper. - Constant yelling and screaming on the phone. - Cannot argue or defend client effectively. We were sellers and we ended up yielding to close at the buyer's title office. - Exposed the confidential papers to the buyer which effectively lowered our price. Then complained in the email that she wasn't notified even though there was an email trail. - Charged $500 to Uber to the closing because she lost the argument to close in her office. In the end, she hitched a free ride from one of the brokers. - Filled out the 1099-S duplicate form wrong to the title company and said it's not her job later and to them to go contact the accountant.

This lawyer's office constantly overcharged for filing fees. Only accepted Zelle $380 payment to begin divorce proceedings. I found out the actual cost should have been about $215. They didn't have a working fax # although the fax # was on every email. They didn't inform me that a stipulation I requested to remain on health insurance was not legal. They filed the paperwork with the courts BEFORE confirming with both parties. Refused to refund any of that inflated fee. Lied about not receiving information about the other lawyer although I had emails to prove I sent it. They would omit important information ie: There is a fee for a discontinuance (no mention of what the fee amount is).

This lawyer was hired to handle what should have been normal course of business for an immigration lawyer. She is not only incompetent, but belittles her clients & their family. Every single filing she made had errors in it. She spent half the time in court talking about her love life - come to find out the deadbeat just filed for bankruptcy protection from over 100 creditors. Bottom line this was a waste of thousands of dollars and my uncle got deported.

Ms. Wonder was hired to prepare and file a green card application. The office and attorneys repeatedly made careless errors in names, country of origin, and facts. They were always busy, never paid attention to the client, were scolding and patronizing, and submitted an application that was filled with errors and inconsistencies, which was the stated reason by the government for denial of the application. Wish we never hired this firm.

It all seemed to go well at first she attended my calls, got back to me soon, filled out paper work then one day I went to "fill out the first form for my husband" and she made me go in (i live 1 hr 20min away) for something that could have been done over the phone. She kept on like forgetting the things she told me to bring and would forget the laws too, like she HAD to stop and take a few minutes to think about it but was never really confident in her own response. She said she would "mail me the forms for my husband to sign" 3 months later no forma,no call nothing. I would always have to call her, leave a message and she wouldn't get back until 2-3 weeks later. At the end it was just time wasted because the final response she gave me was that there was no way I could submit the forms without my husband being deported because he has only been in the US for 8 years. I personally think that's something she could have "told me to begin with" but she waited 9 months to tell me this? No. She herself is not a bad person, I just honestly don't think she is professional enough and doesn't have enough knowledge of what she's doing. Sorry jen.

Luna had an office in Queens where she consulted for my brother and family. She not only overcharged my poor brother, she knowingly had my brother do the necessary filing and organization of the the files, and all she had to do was “comment, ask for payment, and send the file to USCIS”. My brother’s application ended up with a request for information. And then Luna was gone. Not only she was unprofessional, she won’t help if it’s not convenient for her.

I had a consultation with that so called lawyer. I needed a representation in my asylum case which was pending . I had explained to him that I won. Greencard and was looking for someone who can do an adjustment of status . That attorney told me that it is not possible on my case and I have to do a consular proceeding. However it turned out to be not true. When I consulted another lawyer, I was advised that in my case I could do an adjustment inside the country without ever leaving. So, I paid $ 450 for 30 min consult. Which is outrageous. I do not recommend this lawyer.

I just came back from a consultation with Alan and paid $100 for less than 10 minutes. I had a lawyer working on my current case, and as he was retiring, I had to look for another. I had high hopes since he was recommended on some kind of review site. Here are 3 main reasons why I strongly encourage you to look elsewhere. 1) His attitude: During the consultation, he refused to look at even the simplest letter from the government, and, believe me, I have had around 8 consultations with different lawyers, and he was the rudest of all. 2) He made assumptions before listening to my case. As I've said before, I have met many different lawyers. They all listened to me, asked me valid questions, looked through the paperworks, and gave relevant advices. They all gave me thoughtful feedback AFTER reviewing and hearing the materials. Alan, from the beginning, made incorrect assumptions. He can build his opinion after listening about my case, and that's fine. He came to a conclusion without even listening or reading through the materials, and he will probably do the same with you. 3) I was in to meet with Alan but at the end of the brief meeting, he delegated me to his associate. Into 30 seconds discussing about my case, he cut me off and called an associate in. He looked like he was in his late twenties, which made me think of him as an intern. I thought he was there to learn, which is fine with me. But later, Alan said, "ok well if you want to proceed, it will be $15,000 for the case and $2,000 for each trip. AND MY ASSOCIATE WILL TRAVEL. HE LIKES TO TRAVEL." I don't care if he likes to travel. Also, I'll pay even more for a good lawyer. But he didn't even introduce the associate, his experience, or even his name, NOR he asked me whether it would be okay for a different person to potentially handle my case. This is why I do not recommend seeing this lawyer. This is my honest opinion, and you can still proceed to work with him. However, there are plenty of good lawyers in NY. He is not one of them.

I had a deeply disappointing experience with this immigration attorney regarding my visa application process. Here are the key issues I encountered: The attorney provided unclear and often contradictory information about my visa options. This made it difficult to understand my choices and their implications. When discussing the visa I was interested in for quicker permanent residency, the attorney emphasized only potential drawbacks and obstacles. They failed to present a balanced view of both pros and cons. Instead of advocating for my preferred option, the attorney seemed intent on presenting a negative case to my company's HR department. This approach felt more like an obstacle than assistance in my immigration journey. The attorney appeared reluctant to explore or explain alternative visa pathways that might have better suited my goals for faster permanent residency. The approach taken by this attorney could potentially extend my case for years, which raises questions about whether this aligns with my best interests or theirs.

What an Immigration Lawyer Can Do for You

An immigration lawyer specializes in helping individuals, families, and businesses navigate the complex immigration process. These lawyers provide legal guidance on various immigration matters, such as obtaining visas, gaining permanent residency (green cards), applying for citizenship, and defending clients in deportation or removal proceedings. Immigration lawyers also assist with employment-based immigration, asylum applications, and resolving issues related to visas or immigration status.

Whether you're trying to immigrate to the U.S., facing deportation, or sponsoring an employee or family member for a visa, an immigration lawyer can help you understand your legal options and navigate the often complicated legal system.

When Should I Hire an Immigration Lawyer?

Hiring an immigration lawyer is beneficial in many situations where you are dealing with U.S. immigration laws, whether for personal or business reasons. Common reasons to hire an immigration lawyer include:

  • Visa applications: If you need assistance applying for a visa, whether it's a work visa (H-1B), student visa (F-1), or tourist visa (B-1/B-2), a lawyer can help ensure the application is properly completed and submitted.
  • Green card applications: If you're seeking permanent residency, an immigration lawyer can guide you through the process, whether through family sponsorship, employment, or the Diversity Visa (lottery) program.
  • Deportation or removal defense: If you’re facing deportation or removal from the U.S., a lawyer can defend your case in immigration court and seek to prevent removal.
  • Asylum applications: If you’re seeking asylum due to persecution or fear of persecution in your home country, a lawyer can help you prepare a strong case and file for asylum.
  • Family reunification: If you're a U.S. citizen or permanent resident looking to bring family members to the U.S., a lawyer can assist with the family sponsorship process.
  • Citizenship and naturalization: If you're ready to apply for U.S. citizenship, a lawyer can help you navigate the naturalization process and ensure you meet all the requirements.
  • Business immigration: If you're an employer seeking to hire foreign workers, a lawyer can assist with employment-based visas, labor certification, and compliance with immigration regulations.
  • Special immigration categories: Immigration lawyers also handle complex cases, such as visas for victims of human trafficking (T visa), crime victims (U visa), or those seeking Temporary Protected Status (TPS).

Hiring an immigration lawyer early in the process can help you avoid delays, errors, and possible denials due to incomplete or incorrect applications.

What Does an Immigration Lawyer Do?

An immigration lawyer provides a wide range of services to help clients with their immigration needs, whether personal or business-related. Their tasks often include:

  • Assisting with visa applications: Helping clients fill out and submit visa applications, ensuring all documentation is complete and accurate.
  • Filing for green cards and permanent residency: Guiding clients through the process of applying for a green card, including family-based, employment-based, or other forms of residency.
  • Defending against deportation or removal: Representing clients in immigration court who are facing deportation and working to prevent removal from the U.S.
  • Preparing asylum cases: Assisting clients in applying for asylum based on fear of persecution in their home country due to race, religion, nationality, political opinion, or membership in a particular social group.
  • Handling citizenship applications: Helping lawful permanent residents apply for naturalization and ensuring they meet all the legal requirements for U.S. citizenship.
  • Employment-based immigration: Assisting employers with the process of sponsoring foreign workers for temporary or permanent visas, including H-1B, L-1, and EB-1 through EB-5 visas.
  • Representation in immigration interviews: Preparing clients for immigration interviews and attending interviews at U.S. Citizenship and Immigration Services (USCIS) offices.
  • Appealing denied applications: If a visa, green card, or citizenship application is denied, a lawyer can file appeals or motions to reopen or reconsider the case.

How Are Immigration Lawyers Paid?

Immigration lawyers generally charge for their services based on the type of immigration case and the complexity of the legal work involved. Common payment structures include:

  • Flat fee: Many immigration lawyers charge a flat fee for specific services, such as preparing a visa application, green card petition, or citizenship application. Flat fees help clients know upfront what the legal costs will be for a particular service.
  • Hourly rate: For more complex cases, such as deportation defense or appeals, some lawyers charge by the hour. Hourly rates vary depending on the lawyer's experience and the complexity of the case.
  • Retainer: For ongoing immigration matters, some clients may need to pay a retainer, which is an upfront payment billed against as the lawyer works on the case.
  • Pro bono or sliding scale: Some immigration lawyers or nonprofit organizations may offer free or low-cost services for clients with limited financial means, particularly in asylum or humanitarian cases.

It’s essential to discuss the fee structure with your lawyer during the initial consultation to understand the costs and payment arrangements.

How Much Does an Immigration Lawyer Cost?

The cost of hiring an immigration lawyer varies based on the type of legal service required, the lawyer's experience, and the complexity of the case. General cost estimates include:

  • Visa applications: For help with visa applications (e.g., H-1B, L-1, F-1), legal fees may range from $2,000 to $7,500, depending on the complexity and the type of visa.
  • Green card applications: Fees for family-based or employment-based green card applications typically range from $3,000 to $10,000, depending on the case.
  • Deportation defense: For defending clients in removal proceedings, costs can range from $5,000 to $15,000 or more, depending on the complexity of the case and how long the case takes.
  • Asylum cases: Asylum applications may range from $2,000 to $10,000, depending on whether the case is defensive (in removal proceedings) or affirmative (not in removal proceedings).
  • Citizenship applications: Legal fees for filing a naturalization application usually range from $1,500 to $5,000, depending on the complexity of the client’s immigration history.
  • Business immigration services: Fees for assisting businesses with employment-based visas (such as H-1B or EB-5 visas) often range from $3,000 to $10,000 or more.

Always ask for a clear breakdown of costs and fee arrangements before proceeding with legal services.

Top Questions to Ask an Immigration Lawyer

Before hiring an immigration lawyer, it's essential to ask questions to ensure they have the experience and expertise to handle your case effectively. Important questions to ask include:

  1. What experience do you have with immigration cases like mine?
Ensure the lawyer has experience handling cases similar to yours, whether it’s family-based immigration, employment visas, or asylum.
  2. How do you charge for your services?
Clarify whether the lawyer charges a flat fee, hourly rate, or retainer, and ask for a detailed estimate of the total cost.
  3. What is the likelihood of success in my case?
Ask for an honest assessment of your case and the potential outcomes, including any challenges you might face.
  4. How long will the process take?
Immigration cases can take time, so ask how long it may take to process your application or resolve your legal issue.
  5. Will you handle my case personally?
In larger firms, junior attorneys or paralegals may handle parts of your case. Make sure you know who will be working on your case directly.
  6. What documents do I need to provide?
Ask the lawyer about the documentation required to support your case, such as birth certificates, marriage certificates, or employment contracts.

How to Check the Credibility of an Immigration Lawyer

To ensure you are hiring a reputable immigration lawyer, take the following steps to verify their credentials and track record:

  • Check their state bar status: Confirm with your state bar association that the lawyer is licensed to practice and has no disciplinary actions against them.
  • Look for specific immigration law experience: Review the lawyer’s website or professional profile to ensure they specialize in immigration law and have experience handling cases like yours.
  • Read client reviews and testimonials: Look for reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be willing to provide references from past clients who can speak to their ability to handle immigration cases.
  • Check for industry affiliations: Membership in organizations like the American Immigration Lawyers Association (AILA) can indicate the lawyer’s expertise and commitment to immigration law.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with an immigration lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Passport and immigration documents: Bring your passport, visa, and any documents related to your current immigration status.
  • Family documents: If you're applying for a family-based visa or green card, bring marriage certificates, birth certificates, and proof of family relationships.
  • Employment information: For employment-based visas, provide your employment contract, offer letter, or other documentation of your job.
  • Criminal records (if applicable): If you have any criminal history, bring copies of court records and other relevant documents.
  • Timeline of events: Provide a clear timeline of any prior immigration applications, visas, or issues with immigration authorities.
  • List of questions: Prepare any questions you have about your immigration case, the process, costs, and the likelihood of success.

By preparing thoroughly for your consultation, you can help the lawyer understand your case more effectively and get the best possible legal advice on how to proceed.
