He sold out to the interests of the insurance company CAP MPT. He istoo interested in settling as a business decision rather than fully defendi the client and solving the fraudulent case. I had an incident a couple years ago where I need an attorney for a petty crime. Now I know Ivie, McNeill, and Wyatt is a large firm and they deal with a lot of cases, but I thought that my matter would be respected just the same. Long story short, I was about to graduate from college and the situation came back when I was trying to apply for a government job and needed a security clearance. I reached out to Atty. Purcell everyday for a two weeks and there was no response. My mom had to run around the whole city for those two weeks to get the information that he would have access to within an hour. I was supposed to receive my security clearance in April; now it's July and I have the information that I need, but I'm still waiting on my security clearance in order to move forward.

First of all, this entire practice has been useless. I have had the absolute worst customer service when it comes to phone calls, emails, and communication, in general. John first came across as knowledgeable, strong minded, and helpful. That was short lived. That persona ended as soon as I left the building after our first meeting. Once he had my retainer, his communication was lack luster and basically non existent. I asked countless times for explanations on just how this process actually worked, as it was my first time needing a lawyer at all. He never answered questions directly, and the couple times he finally returned an email, they were short, terse, and rude. Because of him and his late responses, my case took over a year, for a simple divorce. His email responses were over a month in between. He clearly just saw me as a nuisance and not worth his own time. My case wasn't going to render him much money, as it was a simple case to settle, so I gathered he dragged it out as much as possible to charge me as much money as he could. His "assistant" never returned emails or calls. John McKinley is exactly why people have a distrust of lawyers and a general dislike of them. He epitomizes the term lackluster. Do yourself a favor and use an entirely different practice.

I hired McKinley to do my divorce and custody battle in 2010. He comes across as confident, knowledgable, and aggressive, of which he is all three. However, as shortly after the case started, I found him to be abrupt, not forthcoming, and completely unhelpful when it came to strategy. He would gather facts, but would not advise me on how to come across, nor how the system worked. He would answer questions tersely, with the least amount of information possible, which would naturally lead to more questions from me. This information-hoarding created a cycle in which I would rack up billable hours unnecessarily. it also led to mistakes on his part which cost me thousands. At times he was flat-out rude, which i did not appreciate from a hired contractor at all. He was a poor listener, thinking he knew best in all circumstances what information was needed; however, his performance in court was hit-or-miss, as the only times I came out favorably was when the laws were clearly on my side. Otherwise, when it was up the the judge's discretion, I usually came out on the losing end, even when the other party had inferior lawyers. Thinking his familiarity with my situation might help, I re-hired him for child support. What a mistake. He was a no-star lawyer here, and was a complete waste of money. He divulged no information on how to present my situation to the court, and offered zero insight on how the amount was calculated. It was obvious he took the case just to bilk me of more money, as he put little effort into it, just showing up with nothing. I could have had no lawyer present and ended up the same, save the undeserved lawyer fees. This guy is the epitome of what gives lawyers the poor reputation they have, with high fees, no insight for the paying customer on how to come out the best way possible, and a good-old-boy attitude in court with no appreciation for the seriousness of the situation the the client.

Our case was a travesty. Mr. Brelsford told us we were at third base with regards to settling. Then he did a 180, after we had met with all the attorneys involved. He told us we could not win, that no one would care there was an assault by a healthcare worker, that we had gone to too many physicians trying to get help for an undiagnosed spinal cord injury resulting in a permanent disability. He said we had to settle for what was offered by one physician. The settlement didn’t even cover the three years lost income. He claimed to have thousands of dollars invested in our case, but settled for a fraction of what he said would be offered.

Mr. Kapland is currently my attorney in my injury and illness that I receive in 2001 with the company I worked for over 23 years and recently had to leave the company after 13 failed surgeries due to what we know now a severe metal allergy that has caused me to become very ill and without an elbow. The claim was uncontested by my employer and insurance company. Mr. Kaplands mishandling and greed for my claim is the only reason it went to court. Throughout the years the insurance company changed hands but the last company it was turned over to CAIGA. I was made 100% disable and unable to work in 2014vbut made permanent and stationary in 2007 but continued to work under severe stress and very ill. I was just informed that I won and received an award, future medical with a life pension in 2016. Mr. Kapland has refused to communicate with me except to send me harassing emogyi's laughing at me. I never received a structured settled and for the past year I am being refused medical care locally and being forced to travel from Arizona to Los Angeles Can for court hearings and doctor appointments. I receive no reimbursements for traveling and when I appear in WCAB twice in the past 3 months no attorney speaks to me and I don't see our judge so I have no idea why I'm even ordered to appear. I then receive from the defense counsel via mail that my attorney had the claim. Put on the calendar to inform defense counsel and the court that he is my attorney and they are not allowed to speak with me when I call and have all communications go through him. I haven't spoken to Mr. Kapland since I dismissed him years ago for mishandling and inappropriate behavior. Mr. Kapland who is claiming to be my attorney is trying to cover up his mishandling. He also uses Dr.Khioury to conduct insurance fraud by charging the insurance company for exams and treatment that were never performed. He has caused me to lose my family home and in jeopardy of losing my current residence and belongings. But will send emogyi's from his identified cell phone and work email on a regular basis to terrorize me. Please be aware of this attorney he is a bad man and an even worse attorney. I can supply you with evidence of all my claims and much more.

If I could rate Jeff Raynes a ZERO I would. Jeff represented me in a medical malpractice law suit. Over the course of years countless doctor visits, experts and negotiations the attorneys for the defense offered 180.000.00 Jeff said not to take it that this case was worth 350.000.00. We ended up going to a full trial that lasted 2 weeks. Jeff lost the case. Fast forward to 2004 my family hired Jeff Raynes to represent us in the wrongful death law suit concerning my mother. Jeff Raynes represented us concerning. After months of negotiations, depositions and representation at the 11th hour Jeff Raynes instructed his staff to notify our family that he had decided not to represent us in the wrongful death lawsuit. He would not accept our calls, he would not provide an explanation. The only information we were told was Jeff Raynes had changed his mind. The statue of limitations was hours from expiring my family went to court to get an extension so time would be permitted to hire new council. Jeff Raynes never filed a petition to start the law suit from the beginning. This case was never heard and thanks to Jeff Raynes and his infinite wisdom he lost another case. My advise to anyone that uses this lawyer for representation is to run as fast as you can to someone who is more qualified.

i contacted this company as i had a problem with a medical product. And they list medical malpractice & problems with products under there legal services provided I know i have a good case, as I have done all my research . And hundreds of other people have filed recently with the same situation. A woman name Maria called me back. If rudeness was a person..she's it! Right from the start she was telling me the myriad of reasons 'why i didn't have a case'. She asked questions, then didn't listen to the answers. Instead reassuring me that no matter what the situation i didn't have a case because of ...the hospital i attended, how long ago i had the surgery (i had it 2 months ago folks!! one has 2 years to file a case) and that j'her'attorneys don't handle medical product problems. I Did point out that both of these service are listed on the attorneys profile on Avvo & this is why i contacted them. She told me to "find an attorney who handled medical product issues". I reminded her this was listed on 'her' attorneys CV. "Well, he's never done a case like this before. And Ive been here 30 years". Then why list a service 'you have never done in 30years". Oh my! She was negative rude & disrespectful from start to finish. I did ask for an attorney to call me back. Of course none ever did. Do yourselves a favor folks...if u need a medical malpractice attorney, or a lawyer to file a case for you when a medical device causes you serious health problems..LOOK ELSEWHERE!!

My experience with Mr. Shock was the worst legal experience of my life. I experienced neglect, breach of confidence, and laziness. Just 13 days before a trial, he had still failed to get my medical records, and the matter at hand was a personal injury lawsuit. He said that if we went to trial, I would be personally liable for $50,000, payable to the defense. And I was in the car that got rear-ended in a nasty accident. For any competent attorney, this case would have been a slam dunk.

I have been consulting Kevin Park since November 2012. He informed me that I had a medical malpractice case and that he would take it on once I obtain an expert report. (I am based in the UK). I spent a fortune on expert opinion; e-mailed him the report and Kevin Park informed me that next step is to sign a written retainer agreement. Then I had to chase him up and he later informed he would not take on the case; 2 months before my limitation period expires. How professional and responsible of him! I guess he never had any intention to take it on; for him it was just a bit of an e-mail chat

What a Medical Malpractice Lawyer Can Do for You

A medical malpractice lawyer specializes in helping individuals who have been harmed due to the negligence or misconduct of healthcare professionals, such as doctors, nurses, or hospitals. These lawyers assist in cases where a healthcare provider deviates from the accepted standard of care, resulting in injury or death. Medical malpractice cases can involve misdiagnosis, surgical errors, medication mistakes, birth injuries, and other forms of medical negligence.

If you or a loved one has suffered harm due to improper medical treatment, a medical malpractice lawyer can help you understand your legal options, file a lawsuit, and pursue compensation for medical expenses, pain and suffering, lost wages, and other damages.

When Should I Hire a Medical Malpractice Lawyer?

Hiring a medical malpractice lawyer is essential if you’ve been seriously injured due to the negligence of a healthcare provider or institution. Situations where you should seek legal representation include:

  • Misdiagnosis or delayed diagnosis: If a doctor fails to diagnose or delays diagnosing a medical condition, leading to harm or progression of the illness.
  • Surgical errors: Harm resulting from surgical mistakes such as operating on the wrong site, leaving instruments inside the body, or performing unnecessary procedures.
  • Medication errors: Injuries caused by prescribing the wrong medication or dosage, or mistakes made by pharmacists in dispensing drugs.
  • Birth injuries: Injuries to a newborn due to medical negligence during labor and delivery, such as failing to perform a timely C-section or improper use of delivery instruments.
  • Anesthesia errors: Complications arising from improperly administered anesthesia, which can lead to serious injury or death.
  • Inadequate follow-up or aftercare: Suffering due to lack of proper monitoring or care after a medical procedure, leading to complications.
  • Hospital or nursing home negligence: Harm caused by the negligence of hospital staff, nurses, or administrators who failed to provide adequate care.

Medical malpractice cases are complex, and hiring a lawyer early can help ensure your rights are protected and your case is handled effectively.

What Does a Medical Malpractice Lawyer Do?

A medical malpractice lawyer provides various legal services to help injured patients hold negligent healthcare providers accountable. Their responsibilities include:

  • Evaluating your case: Reviewing medical records and consulting with experts to determine if you have a viable claim based on the standard of care and harm suffered.
  • Filing a lawsuit: Initiating legal action by filing a complaint against the responsible parties in the appropriate court.
  • Gathering evidence: Collecting medical records, expert testimonies, and other relevant evidence to build a strong case.
  • Negotiating with insurance companies: Working to secure a fair settlement that compensates you for your injuries without the need for a trial.
  • Litigating in court: Representing you during trial proceedings if a settlement cannot be reached, presenting evidence and arguing your case.
  • Calculating damages: Assessing the full extent of your losses, including medical expenses, lost income, pain and suffering, and future care needs.
  • Handling expert testimony: Coordinating with medical experts who can testify on how the standard of care was breached and how it led to your injuries.

How Are Medical Malpractice Lawyers Paid?

Most medical malpractice lawyers work on a contingency fee basis, which means they only get paid if they recover compensation for you. Key aspects of this payment structure include:

  • Contingency fee percentage: The lawyer's fee is typically between 25% and 40% of the settlement or award.
  • No upfront costs: You do not pay any legal fees unless the lawyer successfully recovers compensation on your behalf.
  • Case expenses: Costs for expert witnesses, medical record retrieval, and court fees may be deducted from your settlement or award in addition to the lawyer's fee.

Always discuss the fee arrangement during your initial consultation to understand your financial obligations.

How Much Does a Medical Malpractice Lawyer Cost?

The cost of hiring a medical malpractice lawyer is usually based on a contingency fee model. General estimates include:

  • Contingency fee: Lawyers typically charge between 25% and 40% of the total recovery amount.
  • Case expenses: Additional costs such as expert witness fees and court expenses can range from $5,000 to $50,000 or more, depending on the case complexity.

Ensure you receive a clear explanation of all potential fees and expenses before proceeding with your case.

Top Questions to Ask a Medical Malpractice Lawyer

Before hiring a medical malpractice lawyer, consider asking the following questions:

  1. What experience do you have with medical malpractice cases like mine?
Confirm the lawyer has a successful track record with similar cases.
  2. How do you charge for your services?
Understand the contingency fee percentage and any additional costs you may incur.
  3. What is the likelihood of success in my case?
Seek an honest assessment of your case's strengths and potential challenges.
  4. How long will the process take?
Get an estimate of the timeline for settling or taking the case to trial.
  5. Will you handle my case personally?
Ensure you know who will be managing your case and their level of involvement.
  6. Have you worked with expert witnesses?
Verify the lawyer's experience in collaborating with medical experts essential for your case.

How to Check the Credibility of a Medical Malpractice Lawyer

To ensure you're hiring a reputable lawyer, take the following steps:

  • Verify their bar status: Check with your state bar association for their license and any disciplinary actions.
  • Review their experience: Look for specialization in medical malpractice and a history of successful cases.
  • Read client reviews: Consult platforms like Avvo or Martindale-Hubbell for testimonials and ratings.
  • Ask for references: Request contact information of previous clients willing to discuss their experience.
  • Check professional affiliations: Membership in organizations like the American Association for Justice (AAJ) indicates a commitment to the field.

What Should I Prepare for My First Consultation?

To maximize the effectiveness of your initial meeting, bring the following:

  • Medical records: All documents related to your treatment and injury.
  • Evidence of harm: Photos, medical bills, and records of lost wages.
  • Communication records: Any correspondence with healthcare providers or institutions.
  • List of healthcare providers: Names and contact information of all involved medical personnel.
  • Questions for the lawyer: A prepared list to address all your concerns.
  • Timeline of events: A detailed chronology of your medical care and the issues encountered.

Being well-prepared helps the lawyer assess your case accurately and advise you on the best course of action.
