I spent two years battling my Key West condo association over payments for damages done to my condo from water leaks coming from the units above and adjacent to mine. These condo boards act as if they can dictate whose project gets approved and whose repairs get funded/refunded. It was basically me against them for two years. Finally I received a letter saying that my condo renovations which were done to repair the previous water damage were not approved by the board President therefore they will not be reimbursing me for any damages caused by the water leaks. It was difficult to find a local lawyer willing to take on the local board, I had to go out of town and luckily I found Erik Perez, from Perez Mayoral. Erik listened to my situation and immediately sent letters to the Association demanding that they cover the repairs under Florida Chapter 718, The Condominium Act. As expected, The Board refused. After a 30 day run around from the Board and their intentional disregard for the Law, Erik was able to contact the Insurance carrier and eventually settled the water damage claim to my satisfaction. Claim #2: After spending six months spinning my wheels trying to get the Association to cover my spalling repairs, even though the Association was actively covering repairs and obtaining bids to cover spalling in other units. Chapter 718 clearly states that the Association is required to cover repairs. I called Erik. He was able to circumvent the Association go directly to the insurer and I was promptly reimbursed. I learned the hard way that, "You can't fight city hall, BUT Erik can." Thanks to Erik and his team at Perez Mayoral, I was able to get reimbursed and am now a happy Florida home owner regardless of my Condo Board and their decisions.
