The best decision I every made was to call Don Fountain. I had originally hired another attorney from a boutique firm who promised they had the funds to take on cases they felt strongly about, even if it would not be easy and take significant time and money. It became obvious they were not putting in the effort required for a complicated case against a large corporation. They came to me to say we needed to refer to a larger firm and had another well-known firm in mind. However, I was making my own calls and asked them to speak to Mr. Fountain. From day one, I knew I was in the right hands. The case involved an unsafe boat design, failure to warn and the wrongful death of my young son. I had many interactions with Don and his staff, and they were always extremely responsive and made me feel very taken care of. After years of research, mediations, pre-trial motions and delays due to Covid, we went to trial. Don has a quiet confidence and is a genius. He was so prepared and so impressive it was something to see; the defense was no match for Don. Julie Littky-Rubin and Ben Whitman handled my husband and my testimony of the accident and the other personal witnesses testifying to the value of my son's life. They were both so kind, compassionate, and likable it made a very difficult experience manageable. They eased the anxiety of the other witnesses and helped me through some tough moments. I cannot imagine how traumatic the whole pre-trial and trial experience could have been without the support of the entire team. Oh, and I almost forgot to mention - we won so big the industry is sure to take notice and make safety a higher priority.
