Jon Hackworth and Melissa Wilson essentially saved us from a vindictive landlord in Tampa who had illegally retained our security deposit. I was deployed to USCENTCOM in Tampa for one year and then moved back to San Diego with my family. Within 30 days we were issued a letter from this landlord stating that he was retaining our full deposit of $4,500 plus billing us for additional expenses and even indicated some TBD charges. We suspected he would pull this type of stunt based on his illegal threats (stated he would contact the “base commander” about one of our disputes) and irrational behavior while we were living there, so we had taken videos of the place prior to moving out of the house. I won’t even go into some of the ridiculous charges, which we later found out he pulled against the previous tenants, too. Anyway, we worked with the one of the legal assistance attorneys at Naval Station North Island in Coronado to issue a demand letter refuting all of his unreasonable claims. This went back and forth with no resolution until we finally threatened to take him to small claims court. He preempted us and instead had us served with his own lawsuit. This was now out our Navy JAG’s jurisdiction, so we had to search for legal representation in Tampa. I came across a few law firms that deal in landlord/tenant issues. One of the offices was very responsive but did not have a lot of experience and charged more than we were willing to risk. I then had a 50 min call with another attorney who talked the entire time comparing these types of cases to a “bum fight” where everybody slugs each other until there is a winner but nobody really wins. We didn’t even geyt to discuss the particulars of my case. After that, he said that he would be happy to take my money, but I obviously lost all confidence in him. Ironically, he also had very good reviews. Then I found Hackworth Law PA, who also had a lot of great reviews. I talked to Jon first, and then he connected me with Melissa. They were well aware of the Florida statute that required the landlord to return a tenant’s deposit after he/she had issued a demand letter. The statute puts the burden on the landlord to then have to go after the tenant in the court of law, and not vice versa. So our landlord had violated this statute, which meant that we could go after him for civil theft up to triple the amount of our deposit. Besides their strong grasp of the law, there fee structure was very fair. Essentially, they charged a smaller upfront fee in exchange for a reasonable fraction of the potential winnings. This meant that they had “skin in the game” to go do the work and win. They weren’t just going to bill us for hours and hours with potentially an unfavorable outcome. At the end of the day, the landlord didn’t change his demeanor one bit, so we had to navigate through multiple mediation meetings, court hearings, and motions to dismiss. Melissa successfully had their motion to dismiss denied, which gave us great leverage for negotiation. I’m not going to pretend to know all the nuances of how this played out, but bottom line, we put him in a bad position to potentially lose a lot more money. Ultimately, Melissa and Jon did a great job in forcing the landlord to finally hire his own legal representation and end up having to pay more than our deposit and legal fees. They involved me in the process, making sure that I felt comfortable with the amount that was ultimately mediated. They made this whole unpleasant experience as painless as it could be, given the circumstances. And the final outcome was more than worth it.

When I was first looking for someone to represent me in my divorce proceeding, I called several law offices and waited days to get a call back, if I got one at all.
