I am writing to provide some personal comments about the legal work provided by Dennis McCooe, Esq. to my husband and business partner Peter. In 2004, my husband’s life work was taken by the company that manufactures his furniture designs. Because we couldn’t afford to engage an attorney to protect his work, the company continued to knock off his designs and not pay the agreed upon royalties. In 2013, we contacted Philadelphia Volunteer Lawyers for the Arts (PVLA) seeking pro bono legal assistance to enforce his rights. From the moment we met Dennis McCooe, our situation started turning around. Dennis suggested we create a timeline of Peter's work, with images and dates. Then he asked us to do the same for the knockoff furniture. We collected and collated 30 years of magazine articles and design books to establish Peter’s work and brand identity prior to commencing his relationship with the offending company. Having gathered all the facts, we traveled together to Lancaster, PA for a negotiation with the offending company and its attorney. After the material was presented, Mr. McCooe asked one question, “If this dispute were to go to trial, and a jury saw this information, how do you think the verdict would go?” Dennis’s clever strategy resulted first in the payment of back royalties and then to a new royalty agreement ratified by the company. Unbeknownst to us, the company was getting ready to file bankruptcy, which they did in late 2014, while still owing us a great deal of money. Instead of backing away from this case, Dennis and Blank Rome petitioned the creditors of the bankruptcy for the tooling and molds that Peter had designed and made. Because of this intervention, the court released these items. Our life today is much improved. We have a new factory working with us and Peter has a new studio with the equipment we obtained from the bankruptcy proceeding. None of this would have been possible without the generous and steadfast support of our counsel, Dennis McCooe. We will forever be in his debt and hope that he remains a friend for life. We must also thank Blank Rome for its generosity and commitment to bringing justice for artists through the PVLA.

I met Jeff at an industry seminar about seven years ago. He immediately struck me as a business 'savvy' guy and very enthusiatic and proactive. At the time I was just starting my first biotech/pharma company and he turned out to be an amazing guiding light and resource. He helped me build that company via three rounds of financing into a succesful venture. More recently he is helping again to set up my latest business.

I had received representation from Hartley in 2017/2018 for Endangering the Welfare of a Child- M1. Everyone except the ADA of Venango Co. Brenda Servidio, knew I was innocent and wrongfully charged and imprisoned. Hartley was appointed to me through the Venango Co. Public Defenders Office. He was hands down the absolute best attorney I ever had to represent me! He was very detail oriented, professional, very knowledgeable about criminal law, and he held several consultations with me about my case. He tried pleading down the charge with the ADA to avoid trial and she of course refused all plea negotiations. Claimed she was “going to make an example out of me”. So he took my case clear to a jury trial. Hartley had just become a Public Defender for Venango Co. & I was Hartley’s very first case in venango co. I also was his first case in venango that went clear to trial. He was confident we had a good chance at winning my case at trial. Before trial began, as we sat in the courtroom waiting for the jury to be brought it, the ADA tried offering a plea. We did not accept any plea from her and proceeded with trial. Hartley made the ADA look very unprofessional and really got her flustered during the course of my trial. His cross examinations were flawless and his opening & closing arguments were nothing but extraordinary! After trial was over and the jury was sent out for deliberation, Hartley spoke with me & my family about everything. The jury took roughly 30-45 minutes to deliberate and was back with a final decision. As we all gathered in the courtroom to hear the final verdict, Hartley was confident the jury was going to make the right verdict and serve justice! And the jury did just that with a final verdict of “NOT GUILTY” to 1 count of Endangering the Welfare of a Child- M1. Everyone in the courtroom cheered as justice had been finally served on my behalf! I honestly do not think I would have even went to trial if Hartley was not representing me. His hard work, determination, professionalism, knowledge of the criminal justice system, and his dedication to me as his client (and to prove my innocence) showed the courts, the PD office, the ADA/DA, and everyone else he was the BEST attorney! And I can’t thank Hartley enough for everything he did for me & for not giving up on me even when things got rough!

Dan handled a contentious litigation matter for my company. During that time, he prepared numerous written motions, briefs and other papers, argued several hearings, and handled a number of settlement conferences. The quality of his legal work in all of these tasks was excellent. He was well prepared, thorough and clear in his explanation of the relevant strategies, proceedings and potential outcomes. I was very satisfied with Dan's representation and would highly recommend Dan for the most complex commercial ligation matters.

Andrew represented us in a rather hostile grandparent's rights dispute. We found Andrew after trying our luck with a flashy, expensive local firm and being handed a first year, inexperienced lawyer. We were feeling defeated and as parents astonished by the outcome. Andrew and his firm were a breath of fresh air. Andrew is experienced in all aspects of the law, professional, honest and above all calming. We were told up front the expense for his representation. We were pleasantly surprised to find he was reasonable as well as knowledgeable ! I had no issue reaching Andrew when we needed him via his personal cell phone or e-mail. The moment he entered the court room, his confidence and experience were evident and the outcome exceeded our expectations. I would recommend Andrew and his firm to anyone and without hesitation.

Dealing with the legal system can be intimidating and confusing. We all hope never have to need the assistance of a lawyer. But if anyone does, by all means, call Joe Maenner, you will find an ally to treasure. When I had an intellectual property dispute a year ago, I turned to Joe for help and found the most amazing person one can ever hope for. Joe understood and identified with my problem instantly. He discussed options and sprung into action immediately. He is kowledgable without any pretense, personable in his approach without a trace of ego. He gave me good strategic advice, communicated constantly and directly. I felt very positive and trusting throughout the process until the conflict was resolved. Even if my case would have lost ( we won!) I was convinced that I had the best help possible. Joe Maenner is a true advocate, the best representative of his field, the kind of person who makes his profession shine. He reminds us and shows us by example how noble and truly helpful the best lawyers can be.

Tim Golden is filing my partner's O-1 Visa. He is quick and to the point, so expect a rigid professional relationship, however, he is extremely knowledgeable and that's all that matters. He put together a strong petition for the O-1 and although we received an RFE after submission, he attacked it right away and put together a solid second re-submission. He comes highly regarded by peers and clients. Waiting on final answer but regardless of outcome, I do recommend Tim Golden.

Adam took my Child custody case Pro-Bono, due to me losing my attorney at no fault of my own. My last Attorney was promoted within the Courthouse and could no longer represent me. My child and I had been battling the Court System and his Paternal Grandmother for years with no success. We finally got to a point where we could go in front of the President Judge of Crawford County and plea our case. Adam spent time with my son and I before the hearing, reviewed all prior hearings, learned everything he needed to and more, and did his homework on all angles of this case. He took the case with no hesitation. He represented my son and I in Court against the Grandmother and her Attorney, and he did an amazing job. He had answers for every question, brought up key points that I feel helped the case immensely, and was smart enough to see when the opposing participants were trying to be slick and 'pull the wool' over the Judge's eye. We went to court to try to lessen visitation time with the Grandmother because over the years, she had been awarded a huge amount of time with my son by being deceitful, and she had just as much time with him as I did. A lot of her time was on the weekends however, so I was losing time with him when he was out of school for the week and I didn't have to work. We received the Court Order a couple weeks later and we won!! We got what we asked for, and more. I was awarded Full Sole Legal Custody of my son which is what I had hoped for, but never fought for because I didn't have a good Attorney and never thought it was possible. Adam is truly an amazing Attorney and is willing to do whatever he can to help people in need. I would recommend him to anyone I could!! Thank you so much Adam!! You changed our lives for the better and I am grateful for it!!

What an Intellectual Property Lawyer Can Do for You

An intellectual property (IP) lawyer specializes in protecting the rights related to creations of the mind, including inventions, designs, logos, brands, artistic works, and trade secrets. IP lawyers help clients secure legal rights to their intellectual property, enforce those rights, and defend against infringement claims. They can also assist with licensing agreements, negotiating royalties, and managing intellectual property portfolios.

Whether you're a business seeking to protect a trademark, an inventor patenting a new product, or an artist protecting your work from unauthorized use, an intellectual property lawyer ensures that your creations are legally safeguarded and helps you navigate the complex landscape of IP law.

When Should I Hire an Intellectual Property Lawyer?

Hiring an intellectual property lawyer is beneficial in many situations where you need to secure, protect, or defend your intellectual property rights. Key scenarios include:

  • Filing a patent: If you've invented a new product or process, a lawyer can help you apply for a patent and ensure the protection of your invention.
  • Trademarking a logo or brand name: To protect your business's brand identity, a lawyer can assist in trademarking logos, names, slogans, or symbols.
  • Copyright protection: If you’ve created an original work (e.g., a book, music, or software), a lawyer can help you register your copyright and ensure your rights are protected.
  • Trade secrets protection: For businesses with proprietary information, a lawyer can draft agreements to protect trade secrets and ensure they remain confidential.
  • Defending against infringement: If someone is using your intellectual property without permission, a lawyer can help you take legal action to stop the infringement and seek damages.
  • Licensing agreements: If you want to allow others to use your intellectual property for a fee, an IP lawyer can draft or negotiate licensing agreements that protect your interests.
  • IP portfolio management: If you have multiple forms of intellectual property, a lawyer can help you manage your IP portfolio, ensuring all assets are protected and strategically utilized.

Hiring a lawyer early in the process can help you avoid legal pitfalls and ensure that your intellectual property is adequately protected from the start.

What Does an Intellectual Property Lawyer Do?

An intellectual property lawyer provides a wide range of services to protect and enforce your intellectual property rights. They can:

  • File patents and trademarks: Helping you prepare and submit patent or trademark applications to protect your inventions, brands, or logos.
  • Register copyrights: Assisting with the registration of original creative works to ensure your rights are protected under copyright law.
  • Litigate infringement cases: Representing you in court if your intellectual property has been used without authorization or if you're accused of infringement.
  • Draft licensing agreements: Creating contracts that allow others to use your intellectual property while ensuring you retain control and receive appropriate compensation.
  • Manage IP portfolios: Helping businesses and individuals manage multiple forms of intellectual property, including patents, trademarks, copyrights, and trade secrets.
  • Conduct due diligence in business deals: Ensuring that intellectual property assets are properly valued and protected during mergers, acquisitions, or licensing agreements.
  • Monitor and enforce IP rights: Monitoring for potential infringement and taking legal action when necessary to protect your IP from unauthorized use.

How Are Intellectual Property Lawyers Paid?

Intellectual property lawyers typically charge for their services in different ways, depending on the complexity of the work and the type of intellectual property being protected. Common payment structures include:

  • Flat fee: For specific services such as filing a trademark or copyright application, many lawyers charge a flat fee that covers all the work required for that service.
  • Hourly rate: For more complex tasks, such as drafting licensing agreements or litigating infringement cases, lawyers may charge by the hour. Hourly rates vary depending on the lawyer’s experience and location.
  • Contingency fee: In some cases, particularly for IP litigation, a lawyer may work on a contingency basis, meaning they only get paid if they win or settle the case. Their fee would typically be a percentage of the settlement or damages awarded.
  • Retainer: For ongoing IP needs, some clients may pay a retainer fee upfront to secure the lawyer’s services, which the lawyer then bills against as they work on the case.

It’s essential to discuss fees and payment arrangements with your lawyer upfront to ensure there are no surprises.

How Much Does an Intellectual Property Lawyer Cost?

The cost of hiring an intellectual property lawyer depends on the complexity of the case and the type of intellectual property involved. General cost estimates include:

  • Trademark registration: The cost of registering a trademark can range from $500 to $2,000, depending on the complexity of the application and whether there are any issues during the registration process.
  • Patent filing: Filing a patent is often more expensive, with costs ranging from $5,000 to $15,000 or more, depending on the type of patent (utility, design, etc.) and the complexity of the invention.
  • Copyright registration: Registering a copyright is usually less costly, with fees typically ranging from $300 to $1,500 for most creative works.
  • Litigation: If you’re involved in an IP dispute or infringement case, litigation can be costly, with fees ranging from $10,000 to hundreds of thousands of dollars, depending on the complexity and duration of the case.
  • Licensing agreements: Drafting or negotiating a licensing agreement can range from $1,000 to $5,000 or more, depending on the terms and complexity of the agreement.

Always get a clear estimate of costs during your initial consultation to ensure that the services are within your budget.

Top Questions to Ask an Intellectual Property Lawyer

Before hiring an intellectual property lawyer, it’s essential to ask questions that will help you determine if they are the right fit for your case. Here are some key questions to ask:

  1. What experience do you have with intellectual property law?
Ensure that the lawyer has substantial experience with your specific type of intellectual property, whether it’s patents, trademarks, copyrights, or trade secrets.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or contingency, and get a clear estimate of what your case will cost.
  3. What is the likelihood of success with my application or case?
A good lawyer should provide an honest assessment of the chances of successfully obtaining a patent, trademark, or copyright or winning an infringement case.
  4. How long will the process take?
Ask about the expected timeline for filing your application or resolving your dispute, as IP matters can sometimes take months or years to finalize.
  5. What steps will you take to protect my intellectual property?
Ask the lawyer how they will help ensure your intellectual property is fully protected and what strategies they use to enforce IP rights.
  6. Have you handled cases similar to mine?
If your case involves specific industries or technologies, ask whether the lawyer has worked with similar clients and what the outcomes were.

How to Check the Credibility of an Intellectual Property Lawyer

To ensure that you’re hiring a reputable intellectual property lawyer, take the following steps:

  • Check their standing with the state bar: Verify that the lawyer is licensed to practice in your state and has no history of disciplinary actions.
  • Look for specific IP experience: Check their website or professional profile to ensure they specialize in intellectual property law and have successfully handled cases like yours.
  • Read client reviews and testimonials: Look for reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what past clients have said about their experience with the lawyer.
  • Ask for references: A reputable lawyer should be willing to provide references from past clients who can speak to their professionalism and success in handling IP matters.
  • Check for certifications or memberships: Membership in organizations like the International Trademark Association (INTA) or the American Intellectual Property Law Association (AIPLA) can indicate expertise in intellectual property law.

What Should I Prepare for My First Consultation?

To get the most out of your first meeting with an intellectual property lawyer, it’s important to come prepared with relevant information and documents. Here’s what you should bring:

  • A detailed description of your invention, brand, or creative work: Be prepared to explain what you are seeking to protect, including any unique aspects or characteristics of your intellectual property.
  • Any existing IP registrations or applications: If you’ve already filed for trademarks, patents, or copyrights, bring copies of the relevant documents.
  • Information on potential infringers: If you are dealing with an infringement issue, provide details of the alleged infringer, including evidence of the infringement, such as images, documents, or correspondence.
  • Questions about the process: Write down any questions you have about protecting or enforcing your intellectual property rights, including timelines, costs, and potential outcomes.
  • Your goals: Be clear about what you want to achieve, whether it’s securing a patent, protecting a brand, or enforcing your IP rights against unauthorized use.

Being prepared for your first consultation will help the lawyer assess your situation more effectively and provide you with the best possible advice for protecting your intellectual property.
