I wish I can give negative 5 stars. In January of 2022, I contacted McKeen & Associates to explore legal representation in a dispute. The events that have unfolded since then have led to a dispute regarding the contingency fee agreement between myself and McKeen & Associates. On December 13th, 2022, approximately a year after my initial contact with McKeen & Associates, I received an email from Shirley Biernacki requesting my signature on a medical release form. This communication caught me by surprise as I had forgotten about my earlier inquiry. It was then revealed that McKeen & Associates had filed a motion/complaint in June of 2022, resulting in a default judgment against the defendant. Subsequently, on December 16th, 2022, I received an email from Shirley Biernacki, once again a year later from my initial phone call to McKeen & Associates, and I was asked to sign a contingency fee agreement, which I initially refused. After discussions with Mr. Leon Walsh, my assigned attorney at McKeen & Associates, I agreed to a 33% contingency fee (instead of 25%) based on the representation and promise by Mr. Walsh that my case had a potential of multi-million dollar value. However, during a facilitation in November of 2023, Mr. Walsh conveyed that a settlement over a million dollars was unattainable. After an 8-hour and 30-minute discussion with the defendant, I proposed a settlement agreement, the terms of which were entirely my own ideas. At the conclusion of the facilitation, I insisted on a reduction of the contingency fee to 25%, considering the significantly lower settlement amount and most importantly I did come up with a solution to resolve the case. Despite Mr. Walsh's promise to discuss the matter with Mr. Brian McKeen, I encountered resistance when Mr. McKeen refused to negotiate and promptly hung up on me during a call on January 17th, 2024. Adding to my dissatisfaction, I received an "authorization to deposit" on January 17th, 2024 from Mr. Walsh, aiming to enable McKeen & Associates to endorse all settlement checks on my behalf. However, I declined to sign this authorization until the contingency fee dispute was resolved. On January 25th, 2024, Mr. Walsh informed me of his intention to file a motion with the court if I did not sign the authorization of deposit promptly. This request, however, was made without addressing or resolving the contingency fee dispute, leaving me feeling misled and deceived. Imaging being in a catastrophic car-pedestrian accident, 18 years of pain and suffering, 12 surgeries, 12 years in a wheelchair, I am still unable to walk without an assistive device to this day, and I only got $500K after they took out their 33% contingency fee of $750K settlement. In conclusion, my experience with McKeen & Associates has been marked by poor communication, unmet expectations, avidity, and a lack of commitment to addressing client concerns. I strongly advise potential clients to exercise caution and thoroughly consider their options before engaging with this firm.
