Mr Howard handled my legal dispute with an assisted living facility where my sister incurred serious and permanent injury due to the negligent care she received, and, a rehabilitation center which failed to rehabilitate her. Both facilities tried to enforce a clause in their contracts that would require patients to bring any complaints to an arbitrator. But Mr Howard challenged that and, after a Superior Court judge sided with the facilities, he challenged it in the Appellate Division of Superior Court and a panel of three Appellate Court judges agreed with him and overturned the lower court decision. That Appellate Court decision has set a precedent for all nursing homes. Mr Howard and his assistant, Peter Tabisz, worked on this case for almost five years and they were, in the end, able to obtain a very satisfactory settlement for my sister.
