I had a 3rd degree assault charge in March 2017, and met about 10 attorneys — all claimed it's a very minor charge and would be easily dismissed. The only concern was that I asked to advance to an earlier summon date due to travel plan. I eventually met Mr. Chen after an attorney’s referral and hired him at the end of March, because at our first meeting he promised me to fight in his best effort to advance my case, claiming that he's a "creative lawyer that always looking for creative solution". I believed him and paid him right away. But after our first meeting, he disappeared. After half a month with no progress, I had to call his office to track him down. The only thing I heard was "if I hear anything from the district attorneys office I will let you know". After an entire month since I hired him, which is only a week before my first summon date (I originally hired him because I want to advance this date, which is around the first week of May), he messaged me that there was no progress and he'd "keep tracking" (this is only the 3rd time that he messaged me since I hired him). I asked if I can call him but he directly refused me. I realized then that what he promised was undeliverable. He promised to arrange my document carefully to write to the ADA a clear story about my case. What actually happened was he sent exactly what I sent him (around 30 pages long) to ADA without revising them at all. He also said that it would be easy to arrange a face-to-face meeting at the attorney's office. This never happened. On the court date, he came in 3 hours late. In front of the judges, I hardly recognize it's the same person that presented himself confidently during our 1st meeting. He faltered his voice when the judge and clerk asked him questions, that they demand him to repeat what he said and looked at him confusedly. I was so worried that I even wanted to help him speak. After the first court appearance, I had many doubts. But since I paid him thousands of dollars, I had to continue trust him. He again promised me to help advance my next court date. But literally one week before that date, I had to call him for update after he ignored my message. I asked why he kept telling me he’d do something but every time he’d only do it after I called. He started to yell at me! As a lawyer he couldn’t defend himself, he finally ran out of excuses. However, instead of apologize afterwards, he simply texted me “I was speaking fast”. I finally lost my faith in him. I hired another attorney on Avvo.com. The case got dismissed and sealed within a month. My new attorney always kept me notified, even work during weekends. I found there are so much more one attorney can do to help the case progress: e.g. he obtained documents from the office (I didn’t know they exist before!) and arranged the meeting at attorney’s office the 2nd week I became his client. It was after the comparison that I fully found out what kind of attorney Chen is. Throughout being his client, I felt insecure, left alone, constantly ignored, angry, and hurt. My new attorney made me feel I don’t need to worry about anything. He didn’t just say that, he actually did it. Throughout my communication to Chen, he kept using a condescending tone to emphasize on my ignorance in law. However, it’s always me that pushed the progress of my case -- he would only contact the DA's office after I called him for update. He only called DA's office several times. And there are two times, he emphasized that he talked with ADA for more than 5 minutes. As if working on my case for more than 5 minutes is a big deal. The total number of emails he sent to me when he was my lawyer is 2. With my new lawyer, the number of communication in email is 72. Not to mention text messages. And not to mention, I am after all, a referral case from his peer attorney. Hard to imagine how he'd treat a client without referral. Avoid him as your criminal defense attorney by any cost.
