David Berger represented my father-in-law in a house sale. Dave quoted us a price of $750 over the phone but later invoiced us for $850.
He failed to update his templated documents which, when sent to us, were fraught with errors from previous versions.
He expected us to sign the closing papers without a Statement of Sale. “After you sign, I’ll just hold the papers until the Statement of Sale comes back.” (Trust me.) We asked to delay the signing date. At first Dave pushed back, resisting our desire to change the date. We had to insist on waiting to sign until all sales closing documents were complete and delivered to our notary.
Once he finally did deliver the sales document, we discovered that we had good reason for our lack of confidence in him, because because the document shorted our bottom line by over $3,700! And he wanted us to sign blindly, before delivery of the document.
Whether he was trying to pull a fast one, or he is simple incompetent, either way his performance was unacceptable.
Finally, Dave expected me to coordinate with the mobile notary in the delivery of the closing documents. No Dave, that’s your job.
We found David S. Berger to be a lazy, sloppy lawyer at every turn.
