This gentleman works for the NC Division of Employment Security as an Appeals Referee which is actually a Judge. This gentleman is biased towards employers and is not able to distinguish when he is being lied to or know how to ask the Right questions in a matter. He can be given facts and evidence and still make slanted decisions in the favor of the employer, simply to cheat someone of their due employment benefits. If he cannot tell the difference between the victim and the perpertrator then I don't think law is a good fit for him. He was given video evidence that he never reviewed and even when the case was sent back to him on remand, he did not even try to form a new conclusion. I believe that Mr. Futrell and his Co-worker Chynna Smith need a huge dose of Humanity and try to put themselves in the shoes of the people they are supposed to helping or at least giving a Fair trial to. Look at who has the most to lose and then think of the correct questions to ask. It should not be the burden of the victim to Prove that they are the victim. Be considerate and helpful, do not assume that you know the facts based on other cases. Each person is an individual. Also know the Law, and by that I mean, Know it, feel it and make sure to keep the humanity in it. Any interpretation of the law, that doesn't keep in mind the Humanity is a Abomination and a travesty of the law. Also know that when you have witnesses swear an oath, that oath is legally binding and that recording Can be used against you later. Even DES cases are bound by the law, and for a person to lie under oath is Perjury, and Perjury is a Felony in North Carolina.
