This was an estate issue. Among assets was a house that an heir had built with $ from the deceased. The heir owed roughly $100,000 to estate. A promise to pay note called for full repayment by 3 years from date of death. My dad, co executor, asked via email 3 separate times what would have to be done if the full repayment isn't made. Benyak refused to reply, then sent an email angrily scolding my father for "games" and, again, refused to answer the question. Benyak stated that my dad could hire another attorney to explain what would have to happen if the terms of the note weren't met as agreed to. Benyak had been paid $19,894.54 by my calculations at this point, and he's telling my dad to hire another lawyer to explain what may have to happen in the near future!! Can you believe that arrogance? Maybe he doesn't know what will have to happen and if embarrassed to say that, we still don't know. Also, a mere coincidence no doubt, he sent my dad an email 11 days prior to his hissy fit email asking my dad to write several checks, one of which was to "Alan Benyak" for a little over $400 for "Final Attorney's Fees"! Purely coincidence he gats his final payment, 11 days is enough time for the check to be presented and cleared I believe, then refuses to take any more emails. OH!!! He stated in his 8th grade female hissy fit email that any attempt by my dad to find this information out from him (Benyak) in the future would be harassment! He actually put his own client on notice that any further attempt to get information from him (Benyak) would be viewed as harassment!!! This man has more arrogance than any politician, in my opinion. Maybe he should become a politician... but I can't say for sure. SO, he gets ALL OF HIS MONEY then tells my dad not to send any more email questions (hey, its only $100,000, why would my dad b3 concerned about that?) about a possible foreclosure situation. If you want to shell out roughly $20,000 and be admonished for not knowing what a lawyer is hired to know...run to this guy. If you want representation and advice, hire someone else. This level of arrogance requires an extra terrestrial measuring instrument as it exceeds all Earthly standards.
