Lessons Learned ...
A 96 year old woman was brought into this office in 2021 to meet with Mike Horan accompanied by her niece. She had a previously changed Will (made at age 91) he made a Trust for this woman based on changed Will and he believed everything he read and was told by the niece. He didn't do his job as an officer of the courts and as a result he has violated the law in RI.
Mike Horan didn't research any documents pertaining to this woman's property because if he did his homework, he would have realized that there was a Will that was probated in Pawtucket in 1982 that pertained to the property in question and that this woman was coerced to change her original Will that remained in tact for almost 17 years from another attorney in Cranston (John B Ennis).
In this Trust, the niece that took her Aunt to him, forced her Aunt to leave her the property and a very large sum in money in the Trust because a Trust doesn't pass through Probate Court and a Judge wouldn't see that the niece was the only one to benefit from these changed Wills.
The house in question was put on the market last week and the niece doesn't legally own the house according to the original Will and the Probated Will from 1982 pertaining to this property at 80 Windmill Street in Pawtucket.
The Realtor has been notified about Mike Horan's failure to do his job as an attorney and an officer of the courts in the state of RI, he has failed this elderly woman and God only knows how many other estates he has put in jeopardy.
There have already been two Open Houses to sell this property and if offers have been made on this property, there will be lots of legal problems I'm sure.
The estate of this 96 year old woman and its heirs will be taking legal action against him for his failure to follow the laws of making sure proper ownership is established. I am sure the Realtor also has grounds to sue his office as well.
Mike Horan changed another elderly woman's Will from this same family that had been in tact for years untouched. The woman was coerced to change her Will by the daughter who is the actual niece of the aforementioned 96 year old woman.
In this Will change, the daughter/niece had her mother disown one son because she believed there's more money to split five ways instead of six. This daughter surely took all monies because she felt entitled and the remaining siblings got nothing.
The lesson learned here is to make sure your hired attorneys know what they are doing and not just looking to make money out of greed.
