Finding not only the best attorney, but the right attorney, will never be anything I excel at. My recent experience with Anita Cutrer's firm demonstrated that spectacularly. I felt that I did my due diligence researching and reading reviews of so many DFW law firms with the legal background I was needing for my particular situation and somehow I ended up going with this firm. I won't say it was a mistake, but it certainly was a huge waste of mine and my mother's time. I can say with the upmost confidence when dealing with someone like my sister as the opposing party, time was of the essence. My sister, with her own mastery in how to cheat the system and screw even her family over, needed only time to get exactly what she wanted despite my attempts at stopping her via legal avenues. I had expressed this multiple times during my consultation and through email after hiring this group and putting down a $7500 retainer and when I asked, worst case scenario, how long this process would take, I was told usually a month, 2 months tops, for this kind of case. That was reasonable and I hired them to represent me. This was a guardianship case that I was encouraged to pursue by family, APS, and the SSA to protect my mom, recently diagnosed with a terminal brain cancer, from financial exploitation by my sister.
I was lead to believe that Reba was the expert in adult guardianship law and would serve my needs the best going forward. Any paperwork or forms that I needed to sign and have notarized were completed and sent within 24 hours, some even the same day. Unfortunately, that did not seem to help speed up the initial process of the case at all. I am honestly convinced that my case was forgotten about until I reached out a couple weeks later asking for an update. My emails usually took 2-3 attempts before I got a response in return. The application was filed and turned out to be incorrect and needed to be edited and then sent to me again to sign and notarize, repeating the first several weeks. I decided to do a little more digging on the firm I had hired and it turned out Reba, the expert in adult guardianship cases, had only recently passed her bar exam within the last 6 months and had been an intern with that firm prior to that. It made a lot more sense of why things were already falling through the cracks and things were not getting done. My sister had not even been served after 2 months of beginning this procedure, let alone being assigned a court investigator and ad litem for my mom. I eventually was tired of waiting and as soon as my mom was healthy enough to go out in public, I personally took her to her bank and the SSA to have all her funds removed from my sisters control and back into my moms hands. Once I updated the firm of this, suddenly I was being referred to another attorney to represent my mom in writing out a new durable power of attorney that would for the time being, not require me to seek guardianship. I voiced that I felt my case was forgotten about and not getting the attention I paid for.
Jennie and Reba will tell you that every phone call and email costs money from day one. Sadly, more than half of my emails and calls were never addressed or responded to. Looking back now, at least 5K of my retainer was wasted on mistakes being corrected and correspondence going unanswered. I wasn't even given an itemized invoice of what my money was used for, only a hand written refund check for just under $2500. I will say I am happy with the outcome regardless, but that was achieved by my own persistence and the assistance of another probate attorney altogether. This could have been so much cheaper had I been advised of this route from the beginning. Take caution when hiring this firm and vet your representation thoroughly beforehand.
