April 2008 Mindy Joy Facer A.K.A. Mindy Joy Gulati is a Deputy Public Defender working out of the Westminster, California courthouse. Mrs. Gulati/Facer was assigned to represent me for a charge placed upon me as a result of a false arrest. My arrest occurred out of the jurisdiction of the Countyof Orange (where Mrs. Gulati/Facer works). Mrs. Gulati/Facer told me she was going to send an "investigator" out to the location of my arrest. She said that when the investigator reported back to her that I was in fact arrested far enough out of the County of Orange, that my case would not be prosecuted in Orange County. The next time I spoke with Mrs. Gulati/Facer she tried to talk me into taking a plea bargain. I told her that I would not accept a plea bargain and asked her the results of her "investigator's" findings. Mrs. Gulati/Facer would not tell me whether an investigator did anything. Nor would she provide me with a name of an investigator. Instead, Mrs. Gulati/Facer told me that she had spoken with a police officer who worked for the police department that arrested me. Gulati/Facer claims the police officer told her about an "agreement" that exists between the police department that arrested me, and the sheriff's department in the adjacent county. Gulati/Facer claims that this alleged "agreement" gives the County of Orange jurisdiction to try me. I asked to see a copy of this alleged "agreement." Gulati/Facer could not provide me with a copy of the agreement, nor could she provide any information about the source of her information. Mrs. Gulati/Facer never once suggested that a hearing for a "motion to supress" any evidence be conducted. If I had not requested such a hearing she would have never mentioned it. Two things bothered me about this "lawyer." 1. As an attorney, Mrs. Gulati/Facer should know that federal law overrides state law, state law overrides county law, and county law overrides city ordinances. 2. Mrs. Gulati/Facer was unwilling, and/or unable to reveal her source of information regarding an alleged 'agreement' so that I could look into this matter.
