It's a pleasure to recommend E. Darby Herrington as a thorough, empathic, and excellent lawyer. My recent experience with her began when I asked her to draft a pre-nuptial agreement between my husband-to-be, a Quebecer, and me, a US citizen. My husband's and my goal was to make it clear to all that my assets were to remain mine, in the event of death or divorce after our marriage, so that no one--especially my three sons--would suspect that this marriage was about my assets. Darby drafted a comprehensive and excellent agreement, which my husband was completely willing to sign. We then learned that pre-nups don't hold much weight given Quebec's division of marital assets laws. So, on Darby's advice, we turned in another direction, and drafted an irrevocable trust, placing the assets I identified into the trust, now held by my sons. This work required several meetings, my sons were present for some of them, and throughout, Darby listened carefully and produced the documents we needed to accomplish our goals. I will, without hesitation, use Darby's services in the future. One additional note: When I had a question about immigration law and in what country my husband and I should marry, Darby--not being well-versed in immigration law--gave me a referral that turned out to be excellent. I mention this because it's evidence of Darby's integrity, I think, that she doesn't pretend to know about things that she doesn't know about. I believe she's your best bet! --Otho Thompson

I felt at ease with Mark Kolter, he's down to earth and doesn't make you feel out of place. If I had any questions or needed help, all I need to do is call the office and I would get the help I needed. I would recommend him to anyone. He's the best.

I am appalled by the lack of professionalism and competency I experienced from a DKR attorney during representation in a private real estate transaction. I engaged DKR for legal counsel at the beginning of February to purchase a condominium, closing 3/31/22. On 2/3/22 I spoke on the phone with the attorney that would represent me during the sale. Up front, he indicated that the legal fees for his representation would be between $1,500 and $2,500 depending on the sale complexity. He said that if at any point the bill exceeded that amount we would stop and evaluate. I was then billed $3,000. Questioning the discrepancy I was told it was due to the unforeseen need of preparing Right of First Refusal. This was not unforeseen - counsel informed me on our first call that the unit would be subject to a RoFR clause, but he did offer to "split the difference" and charged only $2,750; still excess of what I was advised. After receiving a draft copy of the purchase and sales agreement, I sent a list of requested alterations. Over one hour (3:05 to 4:15 PM) I received four emails from the attorney asking for my phone number to discuss my questions. Not only had he and I spoken on the phone previously but adding my phone number to the P&S was one of my requests, indicating he had not read my email as my number was listed in the message. I work 8-5 and cannot spend the workday checking my personal email multiple times hourly. After my comments were incorporated (taking several further revisions as he would implement one change and undo a previous one), the attorney still put an incorrect phone number in the agreement. The attorney sent out multiple copies of the P&S making Seller-requested changes without my knowledge or approval. Several times the attorney claimed to have made changes, then sent out copies without changes. The attorney attempted to modify the P&S at one point breaking the formatting then indicated that if myself or the Seller wanted it correct, someone else would have to fix it. This was a legal contract - I was surprised counsel didn't seem to think it important that the document be accurate and professional in presentation. When we settled on a P&S both parties were comfortable with, my attorney had me sign the P&S. After receiving my signature the attorney sent out the original, unmodified P&S to both parties and I had to notify that this was NOT the document I had signed. If I had not caught this error we may have executed an agreement that was, in my opinion, against the interests of myself and the Seller. During negotiation I was unable to contact the attorney for two weeks. He later told me he had been on a vacation without phone or email. I have never heard of a legal representative disappearing for weeks during negotiation without informing his or her clients. This was not the only time my counsel took vacation without forewarning. In the closing documents, among other errors, the property address was NOT the property we were buying. I would think one of the most important pieces of information to be correct in a home purchase would be the address. The attorney forgot to invite me to the closing, then scrambled to get my signature on several forms remotely at 11:53 for the 12:00 closing. $496 of my closing costs was for dues that DKR was to deposit with the condo association. Two months after closing, I found out that DKR had provided my money to a man in Montpelier with no affiliation to the condo association and I was delinquent in my dues as a result. DKR did refund that amount after I managed to uncover the error. After closing on 3/31, I reached out on 4/15 to inquire when I should receive the deed. I was told the deed was still in recording and I would receive it when it arrived back at DKR. In May I called the town clerk and learned the deed had been mailed back to DKR on 4/13. I pointed this out to my attorney on 5/11 and finally received the deed two months after closing and after it had been in DKR's possession for six weeks.

Mark Kolter and his assistant Erica handled all aspects of my Workers Comp case with the highest degree of professionalism. They answered any and all of my questions no matter how many times I asked them. They worked directly with the insurance company so there was chance the "big" company was going to push around a little guy. I highly reccomend contacking Mark Kolter if you even have the slightes felling you might need legal support with a WC case. 5* Is not a high enough rating for the service and support I recieved.

Darby Kolter and Roberts were incredibly helpful and responsive to our complicated legal situation. Keith Roberts helped us every step of the way, including letting us know when we really needed him and when we didn't. The end result was Revitalizing Waterbury negotiating an excellent lease with a new tenant at the Waterbury Train Station.
