The case was one where a family trust was questionably liquidated by the trustees to the exclusion of some of the beneficiaries. Earlier, another attorney had advised us that the harm to trust's excluded beneficiaries was not actionable and would probably result in the beneficiary plaintiffs being disinherited. Legal research by Ms Zizzo revealed a practice which worked around the loophole in the law which discouraged beneficiaries from bringing action against trustees with power of appointment in a trust . This resulted in a lawsuit that eliminated the risk of disinheritance and the case was settled out of court for six figures going to each of the wronged beneficiaries. Congratulations to Nate Olansen and Alison Zizzo for not only executing this project well but giving us confidence to proceed every step of the way.
