David Lawrence is a professional and takes his cases very seriously. I have used him twice in cases I had in Roanoke and Bedford and both times it went in my favor. He is a kind and gentle man but when it comes to court he is very serious. He takes your case to heart and fights with everything in his knowledge and experience to get you the best result possible. He will not let anyone walk on your rights and makes sure you are not treated unfairly. This man and his team worked miracles in my cases. Things happed that I never thought possible and to beat it all I never had to say a word. He went in there and owned the case and we walked out victorious. He and his team are top of the line in all their work. Very professional and never treat you as just another client. They really care about you and getting you the best outcome possible. They have a very reasonable payment plan that makes it easy for you to have him by your side in court. He and his team are just flawless

Lindy attorney handled my personal injury lawsuit where I was not at fault. When the car accident occurred, I contacted attorneys I knew through my line of work for a referral, and multiple attorneys referred me to Lindy and said she was a bulldog. That proved true. Don’t call someone from a sign, because they don’t have the experience and you’d only be a statistic to them. Lindy educates the client on their options, directs them correctly, and handles everything on the back end to relieve all the stress. The day I retained her, the insurance companies were no longer allowed to hassle me. She is the legal shield and knows what she is doing. In my dicusssions with her, she seems to have more knowledge about personal injury than some doctors! She exemplifies fill confidence and is also a good trial attorney. While being in the middle of an overwhelming situation, any personal injury client of Lindy’s is going to completely taken care of. Because of Lindy’s expertise, her ability to make the client feel entirely comfortable, and her strength in dealing with both the car insurance companies and the medical insurance companies, I would confidently put Lindy up for being the legal counsel for any personal injury client. I’m sure that her non-personal injury clients would feel the same.

Was dealing with possession of marijuana and possession with intent to distribute. Underage consumption of alcohol and possession of a weapon. Dark time in my life. Took care of my case and was always prepared. Got all of my serious charges dropped and always stayed in touch. Took stress off of my mind and told me to relax. Very confident in the court room. Would definitely recommend to others who are as well in a serious pickle with the law. Thank you Joshi for everything.

Peter Grenier, I have used over a dozen different attorney's over the past 20 years and finally I found the best! This man is to be feared! Peter slaughtered my last opponent who unrightfully attempted to sue me. I just called him again today over another pending issue and I can't wait to see him in action. I almost feel bad for any one who goes up against him, but I'll get over it when I'm counting my money!

Sam took on our criminal case which could have rendered a catastrophic legal result. Without getting into the specifics of the case, the accused had an inappropriate relationship with a custodial minor. The felony and misdemeanor charges meant that the defendant was facing up to 24 years incarceration. But Sam had knowledge of system and the discernment to pursue a strategy which resulted in a small fraction of that time--less that a year. I will admit that I had doubts about his recommendations. But he proved to be absolutely correct and the outcome was better than anyone expected--including some of the state's own evaluators. . If you are ever facing a serious criminal charge and you need an attorney who understands the system and who can work on your behalf, I would highly recommend Sam Vance.

I hired Mr Byers to represent me in a Civil Litigation where I was sued for payments on a vehicle were not being made by the person suing me. She wanted me to pay her back payments she never made plus some. Mr Byers was very confident he presented evidence that he dugged up. I didnt have to do nothing but sit there and watch him work. He asked her questions and she just stumbled over the lies she was trying to keep up with. He made her attorney look like a fool. Needless to say we won. She lost. I am a person that panics over everything but he made me feel confident and relaxed while he handled everything. I would definately hire Garland Byers Jr for any case I was involved in. He is wonderful.

I know Eric handles a lot of “big” cases. He represented me in boating DUI, which was a “big” case to me. I had refused the breath test – which is a $2,000,00 fine. He beat that. The DUI charge itself he was able to get reduced to a non-criminal traffic ticket. He is a competitive person and gave my case the same attention as he does the higher profile cases.

We sincerely hope that you never have to experience being named "Defendant" in a lawsuit based on false, malicious, and meritless accusations. Yes, it does happen...and it happened to us. Had we met Fred Ervin when it all started the lawsuit may never have been filed and if it had been filed it would not have proceeded to the extent to which it did proceed. We are certain that it would have been settled quickly and appropriately. But hind sight is 20/20! We spent almost a year represented by another attorney defending us in the lawsuit. The lawsuit was out of control and continuing in the wrong direction. We needed to make a change. We needed an EXPERIENCED LITIGATOR. A trustworthy family friend with a great deal of experience in real estate introduced us to Fred Ervin and we realized during our first consult with Fred that he instantly understood the dynamics and legal issues of our lawsuit far better than the lawyer we had been paying to defend us for many months. Mr. Ervin's practice is primarily litigation oriented. He has EXTENSIVE experience in numerous aspects of law. For us, it was his expertise in real estate disputes, boundary and easement disputes, title issues, adverse possession and prescriptive easement proceedings that brought about absolute resolution in our case. Fred Ervin had the experience, knowledge, assertiveness, initiative, resourcefulness, aggressiveness and confidence, -- in a word, gumption -- to answer our lawsuit and file a counter lawsuit. In addition, his command of the written word is outstanding and that benefited our proceedings tremendously. The lawyer for the Plaintiffs knew that she would now oppose a real attorney! As Fred put it, "I love to fight" (we knew he meant litigate) but when he prepares to litigate he has all the facts, all the evidence of proof, confidence and his ducks in a row. Our case was settled out of court with the best possible outcome...after we turned the case over to Fred. Fred Ervin is the ONLY attorney you will ever need or want.to handle you legal affairs. My Husband and I were referred to The Armstrong Law Firm by our neighbor after our son was in a accident that wasn't his fault. Progressive Insurance company thought they could get away without paying for damages. This was the first time we had ever needed the services of an attorney and didn't know what to expect. Mr. Lamar, Daniel and everyone on their team was very helpful and were able to explain the process very thoroughly to us. During the almost two years that it took to resolve our case they kept us informed of each step that they were taking. We were very happy at the conclusion of our case and would definitely recommend the firm to our friends and family

Kenneth Quincey is an excellent personal injury attorney, and I would strongly encourage you to seek his counsel early if you have been injured. I was severely injured in a traffic accident not caused by me. Ken showed a depth of professional experience which I simply did not have. I would have naively believed the insurance company providing my uninsured motorist coverage was my "friend;" however, this was not the case. Ken is a man of integrity. While other lawyers respect him, it was very clear that Ken was working for my benefit. My case was steadily moved forward through depositions and fact gathering. Ken's diligence and negotiating skills resulted in a settlement which I am very happy with. Ken is a great person to have working for you, and I strongly urge you to contact him about your personal injury case.

I had a very difficult case. My checks did not come on time. I was in serious pain and was not receiving proper medical attention. The T.V. lawyers before Mr. Mast would not keep me informed of my case and acted as though they did not have the time to talk to me. I was frustrated and in pain. A friend of the family introduced me to Mr. Mast and he talked to me and answered my questions honestly. When I told him about my checks being delayed and issues I had with the employees doctors he immediately began making phone calls on my behalf. Mr. Mast will hang in there with you until the end even if he has to go beyond the industrial commission. If you want a ,trustworthy, and responsive, knowledgeable attorney Mr. Mast is the man.He has some of the friendliest staff of people from the receptionist, paralegals and staff attorneys that you would ever want to meet. They make you feel at home offering you a cold drink on a hot day and hot coffee on cold days. Once your case is over he will continue to provide followups to make sure you are alright! I recommend this man and his firm who has proven to be more than a lawyer for hire, but a friend who genuinely cares about you.

Jonathan McGrady represented me in a reckless driving offense. We spoke and I explained the citation and the circumstances. Mr. McGrady asked questions, understood my situation and then fully explained my options. His staff is extremely professional. Their communication was clear and concise, left nothing in question. I was able to communicate by email and phone. Not a call or question went unanswered. Being from a different state, I was afraid location was going to be an issue. His staff made me fill like they were right next door. Mr. McGrady and his staff took this negative experience and were able to put a positive light on the outcome and the process..... I would highly recommend Mr. McGrady as legal representation. Hopefully, I never have to use him again, but if I find myself in a similar situation, I know who to call.

What a Wrongful Death Lawyer Can Do for You

A wrongful death lawyer specializes in representing families who have lost a loved one due to the negligent, reckless, or intentional actions of another person or entity. These lawyers help families seek compensation for the emotional and financial losses associated with the untimely death of a loved one, including medical bills, funeral expenses, lost income, loss of companionship, and pain and suffering. Wrongful death claims can arise from various situations, including car accidents, medical malpractice, workplace accidents, and criminal actions.

If you have lost a family member due to someone else’s wrongful actions, a wrongful death lawyer can help you navigate the legal process and pursue justice on behalf of your loved one.

When Should I Hire a Wrongful Death Lawyer?

You should consider hiring a wrongful death lawyer if a loved one has died as a result of someone else’s negligence, recklessness, or intentional harm. Some common reasons to hire a wrongful death lawyer include:

  • Car accidents: If a loved one was killed in a car, truck, or motorcycle accident caused by another driver’s negligence (e.g., reckless driving, DUI, or distracted driving), a lawyer can help you file a wrongful death claim.
  • Medical malpractice: If a loved one died due to medical negligence, such as a misdiagnosis, surgical error, or medication mistake, a wrongful death lawyer can help you pursue compensation from the healthcare provider.
  • Workplace accidents: If your loved one died in a workplace accident or due to unsafe working conditions, you may be entitled to compensation from the employer or third parties responsible for the unsafe conditions.
  • Defective products: If a defective product caused your loved one’s death, a lawyer can help you file a wrongful death claim against the manufacturer or distributor of the product.
  • Criminal actions: If your loved one was the victim of a criminal act, such as homicide or assault, a wrongful death lawyer can help you pursue a civil claim for damages, even if a criminal case is also ongoing.
  • Nursing home negligence: If an elderly loved one died due to neglect or abuse in a nursing home, a lawyer can help you hold the facility accountable for their wrongful actions.

Hiring a wrongful death lawyer soon after the incident ensures that important evidence is preserved and that you can meet any legal deadlines for filing a claim.

What Does a Wrongful Death Lawyer Do?

A wrongful death lawyer provides a wide range of services to help families navigate the legal complexities of a wrongful death claim and seek compensation for their losses. Their responsibilities often include:

  • Investigating the death: Conducting a thorough investigation of the circumstances leading to your loved one’s death, gathering evidence such as medical records, accident reports, and witness statements.
  • Establishing liability: Identifying who is legally responsible for your loved one’s death, whether it’s an individual, company, or government entity, and building a case showing how their negligence or wrongful actions caused the death.
  • Calculating damages: Helping you determine the full extent of your financial and emotional losses, including funeral expenses, medical bills, lost income, loss of companionship, and pain and suffering.
  • Filing a wrongful death claim: Preparing and filing the necessary legal documents to initiate a wrongful death lawsuit within the statute of limitations in your state.
  • Negotiating settlements: Working with the responsible party’s insurance company or legal team to negotiate a fair settlement for your losses.
  • Representing you in court: If a settlement cannot be reached, representing you in court by presenting evidence and making legal arguments to support your case.
  • Handling legal deadlines: Ensuring that all legal filings are completed within the deadlines set by your state’s statute of limitations for wrongful death cases.

How Are Wrongful Death Lawyers Paid?

Wrongful death lawyers typically work on a contingency fee basis, meaning they only get paid if they win or settle the case. Here’s how it generally works:

  • Contingency fee: The lawyer’s fee is usually a percentage of the total settlement or damages awarded, typically ranging from 25% to 40%. You won’t have to pay any upfront fees, and the lawyer only gets paid if they successfully recover compensation for you.
  • No fee if no recovery: If the lawyer does not win or settle your case, you generally won’t owe them any legal fees.
  • Case expenses: In addition to the contingency fee, you may also be responsible for reimbursing the lawyer for case-related expenses, such as court costs, expert witness fees, and investigation costs. These expenses are typically deducted from the settlement or award.

It’s essential to discuss the fee structure with your lawyer during the initial consultation to ensure you understand how much you will owe if your case is successful.

How Much Does a Wrongful Death Lawyer Cost?

The cost of hiring a wrongful death lawyer is usually based on a contingency fee structure, meaning you only pay if the lawyer recovers compensation for you. General cost estimates include:

  • Contingency fee percentage: Most wrongful death lawyers charge between 25% and 40% of the total settlement or court award. For example, if you receive a $500,000 settlement and the lawyer’s fee is 33%, the lawyer would receive $165,000, and you would keep the remaining $335,000.
  • Case expenses: In addition to the lawyer’s fee, expenses such as court costs, expert witness fees, and investigation costs may be deducted from the settlement or award. These expenses can range from $5,000 to $50,000 or more, depending on the complexity of the case.

Make sure to ask your lawyer for a clear explanation of their fees and case-related expenses before proceeding with your wrongful death claim.

Top Questions to Ask a Wrongful Death Lawyer

Before hiring a wrongful death lawyer, it’s important to ask the right questions to ensure they have the experience and resources to handle your case. Key questions to ask include:

  1. What experience do you have with wrongful death cases?
Ensure the lawyer has successfully handled cases similar to yours, whether it’s medical malpractice, car accidents, or workplace deaths.
  2. How do you charge for your services?
Clarify the lawyer’s contingency fee percentage and any additional costs, such as case expenses, that you may be responsible for.
  3. What is the likelihood of success in my case?
Ask the lawyer for an honest assessment of your case and any potential challenges that could affect the outcome.
  4. How long will the process take?
Wrongful death cases can take time to resolve, so ask how long the lawyer expects the process to last, from filing the claim to reaching a settlement or going to trial.
  5. Will you handle my case personally?
In larger firms, junior attorneys or paralegals may handle parts of the case. Make sure you know who will be managing your case and representing you in court.
  6. What types of damages can I recover?
Ask the lawyer to explain the types of compensation you may be entitled to, such as medical bills, funeral expenses, loss of income, and emotional suffering.

How to Check the Credibility of a Wrongful Death Lawyer

To ensure you are hiring a reputable wrongful death lawyer, take the following steps to verify their credentials and track record:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed to practice and has no history of disciplinary actions.
  • Look for wrongful death experience: Review the lawyer’s website or professional profile to ensure they specialize in wrongful death cases and have successfully handled cases like yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A reputable lawyer should be able to provide references from past clients who have worked with them on wrongful death cases.
  • Check for certifications or memberships: Membership in organizations like the American Association for Justice (AAJ) or local bar associations can indicate the lawyer’s dedication to wrongful death and personal injury law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with a wrongful death lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Death certificate: Bring a copy of your loved one’s death certificate, as this is a key document in wrongful death cases.
  • Medical records: If applicable, bring your loved one’s medical records, autopsy reports, or any documentation of their medical care leading up to their death.
  • Accident or incident reports: If the wrongful death resulted from an accident, bring any police reports, accident reports, or workplace incident reports.
  • Financial records: Provide documentation of your loved one’s income, benefits, and financial contributions to the family to help calculate economic damages.
  • Correspondence: Bring any communication you’ve had with the responsible party, their insurance company, or legal representatives.
  • List of questions: Prepare a list of questions for the lawyer about the legal process, potential outcomes, and fees.
  • Timeline of events: Be ready to provide a clear timeline of the events leading up to and following your loved one’s death.

By preparing thoroughly for your consultation, you can help the lawyer assess your case more effectively and provide the best possible legal advice.
