I had to use Tom for the one and (hopefully only) time I had to file a lawsuit against someone who badly deserved it. I am glad I did. While he is a man of few words, he delivers results. I have heard from numerous well respected people in the Huntsville/ Madison area upon learning I am using Tom as my lawyer that I made the right choice. He is highly respected for his work in Real Estate litigation. Highly recommended!

It is going to be difficult for me to find the words to express the level of heartfelt gratitude I have toward Mr. Thomas S. McGrath’s law firm. I am a single mother of 2 small children who was seeking to purchase a home and found herself being taken advantage of a Real Estate team out of Madison, Alabama. They were in the process of trying to manipulate me into buying a home that they had not repaired as promised and time was running for me with my apartment lease. I had to make a decision to stay in my apartment or take a chance on a house that may never be repaired as promised. I knew I could never afford to take on the repairs they were trying to leave behind. I was receiving threats of being taken to court for not wanting to purchase this home and with their disregard for my situation could have very well lead to the kids and I being homeless. They did not care no matter how much I tried to explain my situation. Needless to say I was scared and was losing hope quickly. I decided it was time to seek legal advice. I was able to speak with a few lawyers in the area but I only got very “broad” answers if you will, which didn’t give me any comfort or direction. Luckily, Mr. McGrath was recommended to me and within a few days his team had me scheduled for a consultation. The day of the consultation, Mr. McGrath’s demeanor was unmatched and his genuine concern for the situation was overwhelming. He is very direct and will tell you the truth about the severity of the situation and the projected outcome based on facts presented. His efforts are 100% the entire time. I had been dealing with this situation for weeks on my own and I finally felt like I had solid support. Mr. McGrath has been practicing law for 27 years or more and is well versed in Real Estate, among other things which is very comforting also. He went the extra mile to ensure I was secure and understood the plan of action he had. His skill and attention to detail helped me retrieve the mutual release and earnest money I had deposited within a few days even after the real estate company had denied my request of release several times. Mr. McGrath projected how they would respond and always had a plan of action in place at all times. The kids and I lost our opportunity to purchase a home this year but I can guarantee you I will be confident next year knowing I can call Mr. McGrath if another agency tries to corner me into a bad buy again. He is extremely knowledgeable and has high moral standards. You will not find a better person to support your legal needs. I hope Real Estate teams who tend to lean toward unfair practices are well aware that there is a lawyer in the area who won’t allow it and is very capable of discerning good and bad real estate practice. I thank the McGrath Law Firm from the bottom of my heart and will be forever grateful!

I had a house build by a "so called" premier builder. What I thought was going to be my dream home turned into a nightmare. I was introduced to Mr. McGrath and all I can say is , he is my hero!! He is a caring, highly competent attorney that I will always be grateful to for fighting for me. I was given the run around until he took my case. When THEY hear his name , things start to happen!! Simply the best!!

I couldn't be happier with my case result from Tom and his team. I had a flooring issue that resulted in the Builder basically telling me to "kick rocks" and leave them alone. I then hired Tom and magically things started happening and the Builder (and Sub) started changing their tunes. The case was resolved to my satisfaction and I got a fair settlement and new flooring...a win/win if you ask me! I wouldn't recommend anyone other than Tom and his team for any and all Builder/Contractor related issues.

Contacted Tom in regards to builder not wanting to refund earnst money after terminating contract for builder noncompliance of contract. Tom took the case and we were able to get our money. He was easy to work with and very knowledgeable. If I have any future problems, he is definitely the person I will be contacting.

He was very curtiuos. He always was on time. And the main thing for me was he always found loopholes where the patrol officers violated my rights. He got mine thrown out. Thank you!!!!

I consulted Mr.Tewalt on my husbands immigration case. He was kind and patient and listened to all the facts of the case. When I finished, Mr.Tewalt helped us find a solution at no cost. He did not charge a consultation fee as promised and refused to take payment for his service. A truly honest attorney is hard to find. I have been to many attorneys for this case and he was the only one who refused to just take a retainer and get back to me.

We were very pleased with Mr. Howie. Every phone call or email was answered in a very timely manner. He laid out all the options and kept us from going to trial. He is a tough negotiator and will fight for you. We got the best possible outcome that we could have hoped for and certainly recommend him for any criminal charge that someone may be dealing with. Thank you Mr. Howie!

Can a Lawyer Represent Me in Courts Outside of Huntsville, Alabama?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
