I am very pleased to have found Doug. He is very knowledgeable in Trust laws. He has a dedicated work ethic which is difficult to find these days. I knew before the consultation was complete that he was an excellent choice. I am very satisfied with his services. Even though I reside on the East Coast he managed to maneuver around that obstacle. No one wants to have a legal dispute with family members and he was very understanding of my concerns. I quickly found myself confident in his knowledge and professionalism. Doug has excellent communication skills and was quick with replies to my questions. During what has been a difficult situation, it was comforting to know that I could trust his counsel. He was just what I was searching for in an attorney. I can’t thank him enough!

My elderly father hired Atty. Newborn to resolve a breach of a verbal agreement between himself and his son where his son took a significant amount of money not owed to him after the sale of my fathers property. Atty. Newborns assistant Isaiah researched case law due to the nature of this particular incident and along with other factors in this case helped my father *win* his case. Atty. Newborn and the office personnel were always professional. Our calls were returned if we had questions and my father was kept current about case progression. *The down side to this case, which has nothing to do with Atty. Newborn who did a fantastic job, is that my father will probably never recover his money because the COURT SYSTEM/LAWS do not protect the victim/plaintiff from defendants who liquidate assets to avoid liens or collection of payment and or disappear prior to the case being decided in court. How does a victim recover his stolen money from the unscrupulous defendant? Something to think about if pursuing a defendant in a civil case where money is involved. These laws need to be changed to protect the victims. Yes my father won which is great - but on paper only.

Pros
1
Knowledgeable and provides prompt, informative, and helpful legal advice
“Mr. Newborn provided important information and support when I called him (upon referral by the PCBA LRS) regarding a bad last-minute situation in my potential purchase of a house. He confirmed my legal rights with normal layperson's terms and an understanding approach.”
2
Effective at resolving legal disputes and achieving favorable outcomes for clients
“Douglas Newborn was retained to help resolve a renter/tenant disagreement that had reached an impasse. Mr. Newborns brought a more-than-satisfactory resolution to the issue in less than a week, avoiding stressful confrontations and court time.”
3
Communicates clearly, responds promptly, and keeps clients updated on case progress
“Atty. Newborn and the office personnel were always professional. Our calls were returned if we had questions and my father was kept current about case progression.”
4
Demonstrates professionalism, expertise, and dedication in handling clients' legal matters
“Doug represented us in a dispute with a developer/builder related to refund of our earnest money deposit. We found him to be professional, efficient and a good communicator with us. The issue was resolved favorably within days at a reasonable cost for us and I firmly believe that Doug's professional/non-adversarial approach with the other party was key to that outcome.”
Cons
1
Difficulties in recovering money from unscrupulous defendants in civil cases
“The down side to this case, which has nothing to do with Atty. Newborn who did a fantastic job, is that my father will probably never recover his money because the COURT SYSTEM/LAWS do not protect the victim/plaintiff from defendants who liquidate assets to avoid liens or collection of payment and or disappear prior to the case being decided in court.”

I spoke with David about a situation that I wasn’t sure whether I had a case or not. I explained the best I could to him my situation, and through our conversation with him, asking me questions and telling me how the system works I believed that I would be wasting his time Going forward. However, even though this was a consultation and David knew that he wasn’t going to have me as a client. He gave me valuable information that I can use going forward and discussing my issue with the doctor that almost killed me. His advice was worth everything to me. We were able to talk freely and I felt that David was more of a friend than just an attorney I had called up. Although hopefully I don’t have to consult with David again, if I ever do get this position again he is gonna be my first call. He was very honest and straightforward and took more time than I expected to go through my situation. Definitely this man is very intelligent and well-versed on his field. I would definitely hire this man.

David Sumner is everything one could hope for in an attorney when one's loved one has suffered a catastrophic injury. He is smart, informed, compassionate and the most diligent, hardworking individual I have encountered. My husband's hospital file alone was over 3,000 pages and he studied every one of them, multiple times. He methodically built a case, based on evidence, in order to counter the misrepresentations put forth by attorneys for the defense. He obtained expert witnesses that were truly expert and put out a large sum of his own money in order to help our case go forward. He kept in contact with us and we always knew what was going on The most helpful thing for me, as we went through tough years with my husband's condition and the lack of concern from the hospital about their role, was his compassion and determination to fight the good fight on behalf of one who could not fight the fight himself. His hard work brought about a good settlement and we are forever grateful.

Mr. Sumner won our case and showed hard work and extensive research for out case. He amazed us with his knowledge of medical terms and procedures during the trial. Our case started four years ago and was delayed two years because of the virus, and in the end we won. He and his associate John Vingelli worked very well together and are very professional.

What Questions Should I Ask Before Hiring a Lawyer?

Hiring the right lawyer is crucial for the success of your case. Here are some important questions to ask during your initial consultation:

  1. What experience do you have with cases similar to mine?
Ensure the lawyer has relevant experience in the specific area of law pertaining to your case.
  2. How do you charge for your services, and what are the estimated costs?
Understand the fee structure, including hourly rates, flat fees, retainer fees, and any additional expenses.
  3. Who will be handling my case?
Find out if the lawyer will handle your case personally or delegate tasks to other attorneys or paralegals.
  4. What is your approach to resolving cases like mine?
Learn about their strategy, whether they prefer negotiation, mediation, or litigation.
  5. What potential outcomes can I expect?
While no lawyer can guarantee results, they can provide an assessment of possible scenarios based on their experience.
  6. How will you communicate with me throughout the process?
Establish expectations for updates, preferred communication methods, and response times.
  7. What is the expected timeline for my case?
Get an estimate of how long the process may take from start to finish.

  10. Are there alternative ways to resolve my legal issue?
Discuss options like mediation, arbitration, or settlement to resolve the issue efficiently.

Can a Lawyer Represent Me in Courts Outside of Tucson, Arizona?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
