Pros
1
Thorough, diligent, and professional legal representation
“She was through, diligent, and very professional. She pointed out during the hearing the discrepancies, not following procedures, and changes in answers from the deputies.”
2
Expertise in DUI/DWI cases and ability to achieve favorable outcomes
“She immediately got to work and believed in my defense as much as I did if not more. I knew right away that I had made the right decision hiring Michelle as she was very knowledgeable, professional and clearly experienced with defending charges such as mine.”
3
Excellent communication and keeping clients informed throughout the process
“Michelle kept me in the loop and demystified the process of my case. I felt that her commitment and confidence kept me calm and less fearful of the process. I was always kept informed every step of the way, and facilitated a favorable conclusion.”
4
Compassionate and non-judgmental approach
“They were very kind and non-judgmental. Thanks to their help my case is now dismissed.”
5
Impressive track record of successful case outcomes
“Michelle was able to prove how my breath results did not add up with the rest of my behavior (good driving, passing one leg stand test) and was able to show the flaws with breathalyzers along with expert witness, Mr. Flaxmayer. I am so happy with the outcome of my case and could not be more grateful.”
Cons
1
Potential lack of transparency and honesty in certain cases
“In retrospect, I feel like I was scammed by her. She made clear statements to me that the plaintiff did not have a strong case because the DA 'could not prove the necessary intent'. However, she later recommended that I plead guilty and accept a 'Diversion' offer, which completely contradicted her initial statements.”
2
Concerns about the effectiveness of the private investigator used
“However, a few weeks later (and after having been billed $150 for his time) I finally learned that Mr. Dagostino had failed to obtain any evidence and that he hadn't accomplished anything more than a simple phone call request from anyone could have accomplished.”

I found Michelle after interviewing a few attorney's and I knew instantly that I wanted her to represent me. She was straight forward just like I asked her to be. I was sick with worry and absolutely terrified. I had never been in trouble with the law before. The waiting is the worst part however Michelle was good at putting me at ease through out the process. If I needed to speak with her I could reach her etc... I have used Michelle 2 times and both times she has worked miracles. Honestly I would not choose anyone else to represent a DUI case in any form. Plus she does much more....

I randomly selected Michelle Behan from a list of possible defense attorney’s and, in retrospect, I wish I hadn’t. She is not a completely honest attorney and, in retrospect, I feel like I was scammed by her. In our very first conversation (after she read my one page summary of the incident involving charges of assault for “touching with intent”) she made clear statements to me that the plaintiff did not have a strong case because the DA “could not prove the necessary intent”. She added that it was unlikely that the Plaintiff’s witness would even show up for the court case. I was pleased to hear this and when she offered to handle the case for a lump sum, I agreed and her assistant quickly billed me for it. In that initial conversation she also stated that it was important to move quickly to obtain the video evidence of the incident which I agreed with. In that regard she said that she engages a Private Investigator (a Mr. Dagostino) for just such purposes and that he would cost me an extra $75 an hour. I agreed to this given her recommendation and knowing that we needed to move quickly. However, a few weeks later (and after having been billed $150 for his time) I finally learned that Mr. Dagostino had failed to obtain any evidence and that he hadn’t accomplished anything more than a simple phone call request from anyone could have accomplished. Despite my ongoing efforts to push this matter along with emails and phone call messages to Behan, it in fact took about three months for hern to finally obtain the video evidence which coincidentally happened just after I sent her a strong email asking why we simply hadnt subpoenad this evidence to begin with. In the meantime, we had a second conversation where she recommended that I plead guilty and accept a “Diversion” offer which completely contradicted her initial statements to me about the strength of our case. At that point it was obvious to me that she didn’t care what the video evidence showed and that she had completely changed her posture on my case now that I had already paid her and engaged her. Despite later reviewing the video evidence with me, I realized that she never was prepared to defend my case along the lines of her initial assurances. This lack of honesty on her part only made my whole experience with this matter doubly frustrating. I clearly recommend that you do not use this attorney in a defense situation.

I was terrified when I got arrested for a DUI. I took a chance and called on a Saturday and left a message. Within 10 minutes I was called by Michelle. After we spoke I felt much better. They got my case dismissed soon after. I can't thank them enough!

I am in the military and intentionally sought out an attorney that could understand the additional issues a service member experiences on top of the normal problems when going through a terrible experience with an arrest and the courts. Michelle and her team worked with me for over a year to resolve my case, which resulted in a dismissal. She kept me informed at all times, remained honest throughout the process, and provided me tips that helped convince the prosecutor to drop all three of the charges. I could not have been happier on the outcome. I sincerely felt Ms. Behan fought for my rights every step of the way and always maintained my best interests, especially when it seemed the prosecutor, the local law enforcement, and the military would not allow me a voice in my defense. At times, I nearly gave up and offered a plea in order to "make it go away," but Ms. Behan believed fiercely in my innocence and wouldn't let me put myself or my case in further jeopardy. Ms. Behan and her team are a top notch defense team that do not quit until their client receives the best defense possible. Amazing work!

We were referred to Ms. Behan by a friend whose brother has hired Ms. Behan for his DUI. We are happy that we went with Ms. Behan. She is very professional, knowledgeable, and dedicated to her clients. She helped my father lower his sentence from a felony to a misdemeanor. We highly recommend her.

The Moss Law Firm is probably the most competent Law Firm that we have delt with of all my adult life! Our son was looking at horrific time on Probation not to mention Jail time. Miss Moss was able to have my son’s 1st plea removed and change it to 4 years of Probation; two of those years would be stringent, but after the two years was able to have the Judge review the case and have him placed on a much less stringent Probation. This attorney cares about her clients! And will work hard to have the best possible outcome for her clients! As far as our family is concerned, we could not be happier considering the circumstances. Sincerely, Alex G.

Jacque Mingle beautifully carried through on multiple aspects of her training, as exemplified through her professional expertises: She was instrumental in overseeing the Guardianship Case on behalf of my ill, age-advanced mother (Alzheimer's), where concepts of elder law were at play, forefront and center. Because a contested, complicated Trust was involved, Jacque Mingle's Estate Planning background became invaluable. I would bet that Jacque Mingle has pretty much seen it all. (And she's so humble that, for the longest time, I thought that her specialty only allowed for her to handle Guardianship cases.) Later in the process, when I was erroneously, anonymously accused of elder abuse, much of it related to family dynamics and greed, Jacque Mingle stepped forward with patience and support, quietly leading the way to better days to come. Though Jacque Mingle changed law offices during this lengthy journey, she never missed a beat and kept her eyes on the tasks at hand. Not once did I feel that her personal/professional life had been disrupted during her move toward becoming a Partner, or while changing office locations, coincidentally during the time of Coronavirus... I cannot thank Jacque Mingle enough for always staying on target, while sometimes having to tirelessly engage in job requirements (evenings, laboring from home), particularly when there were time crunches. Jacque Mingle reached out with a kind heart, and was empathetic. She's humble and brilliant, so does not focus on her own star having to shine. I could count on Jacque Mingle's guidance, coupled with her integrity and strong work ethic--she helped me to move this case from a basic nightmare (after my mother fearfully bit a policeman on a hot summer day) to a workable solution, all tailored to my Mom's best interests. Since we live overseas, and have advocated for my mother's long-term best care and considerations, I could never thank Jacque Mingle enough for following through on everything, and then some, which we had discussed during our first consultation together. It's amazing how this all played out: I had contacted my mother's Scottsdale attorney for a referral, after which I ended up seeking counsel in Tucson from a complete stranger, who ended up becoming my new best friend, if even for a relatively short while (roughly 18 months). Should we ever need any further assistance down the road, Jacque Mingle would still be my first choice for legal needs. Jacque Mingle has allowed us to move forward from some very dark days, and she helped us to focus on the rays of sunshine at the end of a cold, narrow tunnel. I will be forever grateful to Jacque Mingle for doing everything right to have thus earned my respect. Jacque Mingle is a great asset to any appropriate legal situation, especially when personal strength, perseverance, and a warm smile are desperately needed in a timely manner. She's a good investment of one's time, energy, funds. Having survived numerous disappointments during the past couple of years, I can honestly say that Jacque Mingle is a positive constant in Tucson, Arizona, who still remains. Thank you, Jacque, for being able to balance your professionalism with your humanity.

We hired Mr. McFadden for a child court case. We reside out of state, so finding an attorney to represent us was initially very difficult. The first time I spoke with Mr. McFadden, I knew he was the attorney for us. He was always very responsive and readily available to talk to. He helped ease our anxiety and concern and knew the law extremely well. He was knowledgeable and fought hard for us. He made suggestions and helped us understand Arizona law. He was wonderful in court and we are so very happy with the outcome. We now have much more parenting time with our children and the other parent is now more cooperative. We have Mr. McFadden and the judge to thank for that. If we need a lawyer in Arizona in the future, we will definitely be going back to Mr. McFadden. He can be very blunt at times, but in my opinion, that was what was needed. He holds nothing back and is aggressive in the courtroom. He is exactly what we needed.

Can a Lawyer Represent Me in Courts Outside of Tucson, Arizona?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
