I met with Mr. Falzone last week for a consultation at his Alameda office, which was most convenient for me. After our meeting I have no reservations about referring his family law practice to other locals. He was very welcoming, I'd almost say soothing in a way, as I felt a lot better leaving than I did going in. He was able to answer all of my questions clearly without making me feel dumb for asking, and let me take more of his time than I expected. I'm not ready to hire him on retainer yet, but when the time comes, he's the guy I'll call.

I saw Mr. Falzone for help with a long-term child support issue. My child support has been in arrears for more than four years. I was concerned about my children and my relationship with my ex-husband. He helped resolve the situation and helped me get the child support arrears from my ex. This allowed me to assist my daughters with their college expenses. At every step, he explained my options and kept me informed. I was able to resolve this issue with a minimum of expense and his counsel helped to keep communication with my ex civil and direct. Until I worked with Mr. Falzone I was certain attorneys were only concerned with their retainers and generating bills. As the sole support for my daughters costs were a concern. I did my research and was fortunate to have him represent me. I was and continue to be very satisfied with his service and I strongly recommend Mr. Falzone for assistance in resolving marital and support issues. He cares about what is best for you and for your children. The fees I paid was truly a great value and money well spent. I had tried to handle my situation on my own without success. Mr. Falzone delivered, and he listened to my concerns.

Lawsuits of any kind are a nightmare. The best ones are where you get in and out of them as quickly and cheaply as possible. Frankly it doesn't matter if you are the plaintiff or defendant; lawsuits are bad from any angle in my opinion. I used the legal services of Mr. Falzone this past year. He was so bright and smart and moved my legal situation along very rapidly with a kind and caring way. He was the second attorney I had hired as had fired the first one because I felt that the original attorney was deliberately making the case go slow so he could make more money from it. Mr. Falzone came in quickly to the case and had a grasp of the case just from our initial half hour conversation and he took action immediately. He also worked to mediate the situation as he said it would cost less if both parties got along and were not going at this case as a way to argue more. He is very smart, savvy and also knows how the courts work and the personalities of different judges around the San Francisco Bay. I think it is important to have a lawyer who gets along with people and tries to avoid nasty confrontations. That saves you lots of hours of their billable time and also lots of anxiety. I felt he really cared about what I needed done and was on my side. I also felt like his fees were very reasonable and he was very open and honest and fair with his billing. I also felt like he really "heard me" and also was totally approachable on any subject regarding the case. I not only thought he did a fantastic job on my case; I also felt he was a really decent, kind, understanding person; rare in these times! If you hire him, I think you are smart for doing that and lucky for getting him as your attorney. I can't thank him enough for what he did for me.

I highly recommend Gerard’s A. Falzone’s family law services. At the time that I contacted him, I was really in a bind. My 16 year old daughter had been physically abused by her Mother who suffers from bipolar disorder. She did not feel safe returning to her Mother’s house, and I needed to know how to protect her as quickly as possible. I had left messages at 6 different attorneys that day, and only 3 returned the calls. Gerard answered my call the first time, and I was able to meet with him later that day. My case was in Marin County, but the fact that he has offices in the East By as well as the North Bay made meeting with him much easier. He is very experienced in the area of family law, and explained to me what channels I would need to take to protect her, and gain custody. His knowledge and confidence in my case, based on the facts, set my mind at ease, and helped me get through a very difficult time. Within a few days I was able to legally gain temporary custody, and within 2 months gain full legal and physical custody. My daughter’s life has become stable since then, and we both owe Gerard a debt of gratitude. John Hyde

Can a Lawyer Represent Me in Courts Outside of Alameda, California?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
