“He fought hard for me when the insurance company was jerking me around.”
2
Provides helpful explanations and guidance to clients on their case

3
Difficulty in obtaining information and documents related to the case
“Regardless of how many times I have asked for copies of documentation I never received any!”

so far, ive gotten excuses and a rude staff about how they will not release info about my mother even though i have power of attorney. First impression is all bad. Its obvious he makes excuses not to talk with you. the response I got when i called twice was, he got your message and will call you when he calls you. So far this has been extremely unprofessional and now have to drive 2.5 hrs to join my mother as i do not trust she is in good hands. I would advise a more empathetic attorney with better reviews. I have a business and would never run mine in such manner.

Having Mr. Pluta as my lawyer was great. He fought hard for me when the insurance company was jerking me around. I've already sent a friend who had a good experience too

The exact same thing is happening as the review above this one . Never returns calls, always to busy even when he says to drop by and get an update. The insurance company has all the medical records he does not. So they are building their case as we stand by and watch. All the staff can do is ask the same question over and over are you back to work?

My wife & I met with David to assist us with Estate planning and the drafting of a will, living trust, and other associated documents. Our experience meeting with David was that he was very knowledgeable, trustworthy and personable. He discussed our various options and made sure we understood the ramifications of various decisions. His turnaround on preparation of the documents was impressive and really quick. He was accomodating in meeting with us on short notice to complete the documents and arrange signing. Overall we were pleased with the services we were provided and would have no hesitation in recommending David to others.

I worked with David over the course of 1 year on formation of my start-up restaurant. My primary concerns were having an attorney who was well-rounded, I could trust and would inform me "start to finish" on legal aspects of my business launch. David exceeded my expectations and I would highly recommend him to others.

I worked with David on forming a living trust for my wife and my self. He was upfront with us about what the process would take, and his response time and he was true to his word. I have called him a few times since we completed our trust and he answered basic questions for me at no cost. I would recommend David to anyone who is looking to avoid probate.

I was 23 when this situation occurred. I was coming home after a graveyard shift to find my daughter awake at 5 in the morning with her mother and a man I had never met inside my home. Drugs on the table and both of them belligerently drunk. The stranger made threatening advances and one thing led to another and I ended up fearing for my life and shooting him twice. I have never found myself in any serious legal trouble before this incident but I was later charged with 2 felonies (assault with a deadly weapon, intent to terrorize). I had one and only one offer for the majority of 4 years. The court's offer was flat out 7 years in prison. The situation being as serious as it was I knew I needed the best lawyer by my side regardless of charge or distance. I spent many hours scouring reviews and online results of every local lawyer in Bakersfield and Mark definitely stood out from the crowd. Results don't lie and Mark's price wasn't any more than any other lawyer of his caliber. I knew from our very first meeting that I had made a great choice and instantly retained him, and so our 4 year journey began. Mark's a master of his craft and knows all the ins and outs of the court system. My case was dragged on for four years in my favor. With COVID-19 all major courts processes were slowed down for nearly two years. I believe this case was not a race but a slow and steady marathon. Although you may want your case done as quickly as possible, which can certainly happen.. I felt Mark's ability to drag my case out until the perfect timing was a game changer. Some lawyers want to get you in and out and wipe their hands clean of your case, but Mark was willing to stay patient and diligent and work with me long term which I greatly appreciated. His staff was always helpful and informative through the whole process. There were no hidden fees or agendas and they always made me feel confident in everything they helped with. Fast forward to just a few weeks ago and my prayers have been answered. The day before trial was set I accepted a miraculous new offer which I was so happy to accept. Mark's work paid off and he was able to get the DA to offer me NO FELONIES, 1 MISDEMEANOR ASSAULT THAT WILL BE DISMISSED WITHIN A YEAR. This means I was put in a horrible situation that I felt I needed to use deadly force and I shot someone, got charged with 2 major felonies, was facing 7 years in prison, and Mark somehow got me sentenced with the same charge as someone could receive for a street fight! If you're reading this, look no further. When you are dealing with your life on the line you don't have any room to leave this up for chance. You need a strong, experienced, reputable lawyer, who will stay by your side no matter how long it takes and will give you the confidence and relief you need during your difficult times.

I couldn't be more pleased with Kurt Van Sciver and his firm for my contested inheritance case. Kurt was very professional and efficient, is a good listener and his questions always cut to the chase, was patient in explanations of the legal requirements and many phases of the documentation, handled the negotiations for a settlement without me having to be present, kept me well apprised for meeting him at the 3 court appearances and filed the many papers that were a part of closing this up legally. His cost estimate was spot on and he stayed within budget. I would definitely recommend him for Trust & Estate Law.

I live out of state and needed a layer to handle a probate. I emailed 5 in California and he was the only one that responded. He worked quickly on this case and finalized everything in a timely manner.

Kurt and his staff are truly amazing. I have gone through hell and back and he helped me get out of a very ugly probate situation. He was calm, even when I was not. He was clear and concise and remained very organized when I was not. His demeanor was much more respectful than the Nichols could ever be. Kurt never had a bad word about my ex-family, yet Nichols did towards me. Kurt will always be there for you on your journey with patience and excellence.

  4. What is your approach to resolving cases like mine?
Learn about their strategy, whether they prefer negotiation, mediation, or litigation.

Can a Lawyer Represent Me in Courts Outside of Bakersfield, California?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
