Attorney Review/Reference We live in Texas and our son is stationed at Vandenberg Air Force Base in California Our son got a dear john from his wife the day after he was deployed to the Middle East and informed that she had filed for divorce and she would be sending the papers. While deployed he would call to speak to his two year old daughter and read her a bedtime story. He had to leave these on voicemail as his calls a world away were not picked up. He returned to a tumultuous household six months later and divorce proceedings were initiated by his wife they had been married approximately a year and a half. He had to hire an attorney and chose Ms. Mellanie Marshall. Divorce is a terrible and damaging event to all parties and especially when children are involved. Ms. Marshall was very patient in dealing with a highly frustrated client. As a member of the military he could be deployed or transferred at any time. This was a concern as a custody issue and was emotionally crushed that he might not be a part of his daughter’s life. M.s Marshall provided my son a realistic scenario of the possible outcomes but also was able to remain a calming influence to her client. She thoroughly researched the parties involved to come up with her game plan. She was interested in what was in the best interest of her client as well as the child. She was able to work with the opposing attorney to reach what would have been a reasonable accommodation to reduce the turmoil in the little girl’s life as well as the divorcing couple. The opposing attorney was unable to get her client to be reasonable with conditions that would allow both parents to be involved with the child. As a result, the opposing attorney was unable to work with her client and removed herself as her representative. In court Ms. Marshall was competent, thorough and I believe more than reasonable. The outcome that Ms. Marshall achieved was fantastic. My son has a custodial arrangement that allows him to be an integral part of his daughters’ life. She took a toxic situation and turned it into lemonade. My son has renewed his spirit and his daughter is happy. She now has an opportunity to interact with other children her age at the on base child development center. If you want a good attorney in dealing with a messy divorce situation you can’t go wrong with Marshall Law (firm). Robert and Donna Austin, Texas.

Put me at ease from day one by explaining my options, rights under CA Law, and best & worst case scenarios, then quickly working my case as soon as I hired her. While I hope to never need her services again I'm sure glad I found her to handle my divorce and will recommend her without hesitation if ever asked about family lawyers in Kern County. Exceptional attorney in all respects!

I contacted Mellanie about terminating a gaurdianship. She was incredibly easy to talk to and instantly made me feel better just by being so understanding and clear about what the steps were and the best way to go about things. I am relieved I found her and feel she is the best choice to represent me. Hopefully when this is all over I can get my son back home where he belongs. To anyone new to dealing with situations where you need a lawyer please do not hesitate to call her. You will feel at ease after just the first initial consultation! Thank you Mellanie for our phone call yesterday you truly seem like a wonderful person.

I hired attorney Marshall to defend me in a Domestic Violence case. Attorney Marshall did an excellent job during the trial and the court dismissed the restraining order after attorney Marshall tore up my lying ex on direct examination. Other attorneys congratulated attorney Marshall on the excellent job she did after the trial. I highly recommend this attorney.

My wife & I met with David to assist us with Estate planning and the drafting of a will, living trust, and other associated documents. Our experience meeting with David was that he was very knowledgeable, trustworthy and personable. He discussed our various options and made sure we understood the ramifications of various decisions. His turnaround on preparation of the documents was impressive and really quick. He was accomodating in meeting with us on short notice to complete the documents and arrange signing. Overall we were pleased with the services we were provided and would have no hesitation in recommending David to others.

I worked with David over the course of 1 year on formation of my start-up restaurant. My primary concerns were having an attorney who was well-rounded, I could trust and would inform me "start to finish" on legal aspects of my business launch. David exceeded my expectations and I would highly recommend him to others.

I worked with David on forming a living trust for my wife and my self. He was upfront with us about what the process would take, and his response time and he was true to his word. I have called him a few times since we completed our trust and he answered basic questions for me at no cost. I would recommend David to anyone who is looking to avoid probate.

I was 23 when this situation occurred. I was coming home after a graveyard shift to find my daughter awake at 5 in the morning with her mother and a man I had never met inside my home. Drugs on the table and both of them belligerently drunk. The stranger made threatening advances and one thing led to another and I ended up fearing for my life and shooting him twice. I have never found myself in any serious legal trouble before this incident but I was later charged with 2 felonies (assault with a deadly weapon, intent to terrorize). I had one and only one offer for the majority of 4 years. The court's offer was flat out 7 years in prison. The situation being as serious as it was I knew I needed the best lawyer by my side regardless of charge or distance. I spent many hours scouring reviews and online results of every local lawyer in Bakersfield and Mark definitely stood out from the crowd. Results don't lie and Mark's price wasn't any more than any other lawyer of his caliber. I knew from our very first meeting that I had made a great choice and instantly retained him, and so our 4 year journey began. Mark's a master of his craft and knows all the ins and outs of the court system. My case was dragged on for four years in my favor. With COVID-19 all major courts processes were slowed down for nearly two years. I believe this case was not a race but a slow and steady marathon. Although you may want your case done as quickly as possible, which can certainly happen.. I felt Mark's ability to drag my case out until the perfect timing was a game changer. Some lawyers want to get you in and out and wipe their hands clean of your case, but Mark was willing to stay patient and diligent and work with me long term which I greatly appreciated. His staff was always helpful and informative through the whole process. There were no hidden fees or agendas and they always made me feel confident in everything they helped with. Fast forward to just a few weeks ago and my prayers have been answered. The day before trial was set I accepted a miraculous new offer which I was so happy to accept. Mark's work paid off and he was able to get the DA to offer me NO FELONIES, 1 MISDEMEANOR ASSAULT THAT WILL BE DISMISSED WITHIN A YEAR. This means I was put in a horrible situation that I felt I needed to use deadly force and I shot someone, got charged with 2 major felonies, was facing 7 years in prison, and Mark somehow got me sentenced with the same charge as someone could receive for a street fight! If you're reading this, look no further. When you are dealing with your life on the line you don't have any room to leave this up for chance. You need a strong, experienced, reputable lawyer, who will stay by your side no matter how long it takes and will give you the confidence and relief you need during your difficult times.

I couldn't be more pleased with Kurt Van Sciver and his firm for my contested inheritance case. Kurt was very professional and efficient, is a good listener and his questions always cut to the chase, was patient in explanations of the legal requirements and many phases of the documentation, handled the negotiations for a settlement without me having to be present, kept me well apprised for meeting him at the 3 court appearances and filed the many papers that were a part of closing this up legally. His cost estimate was spot on and he stayed within budget. I would definitely recommend him for Trust & Estate Law.

Kurt and his staff are truly amazing. I have gone through hell and back and he helped me get out of a very ugly probate situation. He was calm, even when I was not. He was clear and concise and remained very organized when I was not. His demeanor was much more respectful than the Nichols could ever be. Kurt never had a bad word about my ex-family, yet Nichols did towards me. Kurt will always be there for you on your journey with patience and excellence.

Can a Lawyer Represent Me in Courts Outside of Bakersfield, California?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
