I came to Mr Weber who after speaking to several rude attorneys answered his phone at 6pm he was out the door but took his time to talk to me about the bankruptcy I was looking for. He took his time and answered all my questions without trying to rush me off the phone. Pleased I called back the next day and made the first appointment. My husband and I hired him. His office and staff especially Kim returned all my calls and questions prompty. Mr Weber even called me back on a Saturday with a question I thought about! All I can say is his services were superb. I had my hearing today and my file was the only one done correctly and I didnt need to make a second court appearance. 12 other people ahead of me all had attorneys that did not have the files prepared. I highly recommend this office.

I came to Joseph Weber with a judgment against me that I couldn’t pay. I didn’t know what to do. I knew Joe specialized in bankruptcy but that was not what I preferred. Joe agreed with me and I hired him to negotiate and settle my case with the collectors. Although this was not listed as one of Joe’s “specialties” he ended up saving me over 40 thousand dollars! I was able to pay the judgment and go on with my life. Honestly, Joe was one of the most sincere people I have ever worked with. Felt like he really cared during the whole process. My highest recommendation goes to Mr. Weber.

Even though Mr. Weber's firm does not take Chapter 11 cases, he called promptly and was very helpful and assisting and directing me in he right direction. I wish I could have retained him.

Although he took his time on the first meeting to explain what was involved, the actual follow up was very poor. No explanations, no respond to my requests. Very intimidating and arrogant.

Finding out you may lose your home and have so many bills that make you too scared to answer the door and phone is very stressful. Families can't afford to get sick these days with-out falling behind. You start to just stop opening bills because your income and savings are sucked dry within a few years suffering with being sick. Getting a certified letter with a "sale date" of your home is a wakeup call. I researched bankruptsy and looked at a few different firms. It is daunting trying to find and hire someone to save you can be overwhelming. I was lead to Joseph Weber in Costa Mesa, so i called and went in for the first appointment without my husband. I was scared. 3 appointments later we finally filed chapter 13. He AND his support staff were amazing. They let me cry and reassured me our family will get through this with their help. Long story, short, it was the BEST decision i have ever made. Yesterday i sat waiting for our hearing listening to case after case. It seemed like everyone was getting denied or dismissed. Attorneys not prepared or missing items etc etc. when we were called up with Mr Firman (Joe's associate) I was beyond scarred that this nightmare would end bad. IT DIDN'T! Our team had everything that was needed. The mediator even mentioned he remembered his review the night before had no need for notes (i found out that it meant we had our sh!t together) and it was the fastest case of the hour. Max 3 minutes. Compared to 20-25 minutes of watching several offers not accepted. I would bet that all the others in that room wished they had our attorney's team. I walked out stunned and relieved. I wish I could express how much it meant to me, but i figured i'd tell my story in an honest review. I owe my current happiness to them. They helped save our family home. One more thing. Once he was hired (retained), he told me to start answering the phone and front door. He gave me his card and told me to tell whoever was calling about our bills and/or lawyers trying to serve us, to call his number and to advise them they need to call/contact his office. It was an amazing feeling of power and finally helped control all the harassment. I am still not yet healthy BUT I can now focus on me. Thank you Mr Weber, Mr Firman and staff. You are all wonderful. And they have "our back" for the next 5yrs!! Please forgive any poor spelling & grammar in this review and story. I hope that my message is loud and clear. Ty, Lou

It gives me great pleasure to supply this commendation for a man of great wisdom and insight, Mr. Bill Cumming, our attorney who successfully defended our case. I was impressed by his services. He took time to explain legal terminology and methods employed in our case using speech that gave us clarity and understanding. His listening ear is one of his many hallmarks. Mr. Cumming took great care to manifest the road ahead of us and the direction and delays which might confront our course. The case against us was cruel and overwhelming, and stretched over many years. We received first class treatment, always professional and courteous. We also sensed compassion and empathy in just the right amounts. During the long route, Mr. Cumming, in his tireless approach, showed himself to be a strong defender, encouraging us along the way as our case took some turns. Mr. Cumming was skillful, sharp and accurate. Our defender never lost his cool under fire. His task and preparation was entire and thorough. I was impressed to note the late or early hours of his communications. In summary, I am certain that no better services of legal defense could exceed the work of Mr. Cumming. My observations are that he is brilliant and has great insight. We are so very thankful for his efforts and work on our behalf.

I was approached by my primary multi billion $ supplier to purchase my company. I was sure I could negotiate the deal myself and use a local Minnesota attorney for the details. After my first phone conversation I realized I was hopelessly out of my league. I was put in contact with a consultant I had worked with previously and he suggested I include Bill Cumming of Cumming and Associates as my attorney. What a home run that turned out to be. My stress level initially was off the charts when I saw the scope of the due diligence required to close the sale. Obviously, Bill handled the legal portions. He proactively told me not to be overly concerned about my legal record keeping because he knew most small business owners didn't have time to keep track of all the details and he could help me with that. The peace of mind that gave me was tremendously comforting. Bill didn't make me feel embarrassed that I didn't always do a good job keeping my corporate minutes up to date while trying to run my company. The finished due diligence product he delivered was well received by the purchaser even though Bill pushed back on some of their proposals. I struggle with legalese and was pleased with the attention to detail Bill paid, to my benefit. All in all, what would have been one of the most difficult experiences of my business life turned out to be remarkably smooth thanks to Bill's efficiency, demeanor and sense of humor.

Recently, I was faced with the prospect of trying to sell the business I had owned and managed for 35 years to a Fortune 500 company. Having never negotiated such a complex process, I (wisely) decided to enlist the services of a reputable consultant, and his first recommendation was that I should hire a stellar attorney--one with solid experience, integrity, and careful attention to detail. Fortunately for me, he suggested I contact Bill Cumming. In retrospect, I can say that hiring Mr. Cumming was one of the best business decisions I've ever made. He is honest, affable, knowledgeable, accessible, and very efficient. Over the following 12 weeks, he handled all the legal complexities of our negotiations, making certain my interests were protected at every turn, and at the end of the process, produced a very favorable outcome. (He also refunded the unused portion of his initial retainer fee!) Needless to say, Bill Cumming has earned my undying respect and gratitude. I can recommend him and his staff without reservation.

  4. What is your approach to resolving cases like mine?
Learn about their strategy, whether they prefer negotiation, mediation, or litigation.

Can a Lawyer Represent Me in Courts Outside of Costa Mesa, California?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
