Ben Phillips is an outstanding attorney. Having Ben as my attorney was one of the best choices I made during a very challenging time. He came highly recommended to me, and I will always be grateful for those recommendations. Going through a divorce can be emotionally draining. However, with Ben as my attorney handling everything superbly, I was able to focus on being a mom to my 3 children. The moment Ben became my attorney, things started to quickly line up and shift in the right direction. It was a very complex financial case with a very litigious husband of high net worth who was hiding assets. Ben is extremely intelligent, quick-minded, and organized. He is highly respected by judges and peers alike. Litigation comes naturally to Ben as he is extremely eloquent and well-versed in the law. He is an excellent litigator. His perfectionism shows in his work, and his staff are all top notch as well. I am and will always be truly grateful for all that Ben has done for me as my attorney. I highly recommend Ben Phillips.

I had to endure a three year divorce process and learned a lot from it. First and mainly, I should have retained John "Ben" Phillips first off. I had three attorneys prior to retaining Ben and if you combined all three prior attorneys as a team, they could even come close to Ben's expertise in family law matters. The difference between an attorney and a great attorney is a great attorney can get the job done quickly. Ben is highly organized and he knows the law regarding divorce, child custody and all other aspects of family law. Ben is a great negotiator as well as a great listener. His handling of the division of community assets and child custody issues in my divorce case left me great satisfaction. My retirement funds were a huge concern of mine and through Ben's negotiating skills, provided me with more than favorable results. No one likes to go through a messy, complicated and emotional divorce. From my experience, I can tell you do not throw money away by just hiring an attorney(s). Retain the best attorney possible you can from the get-go who will work and fight for you with professionalism. I highly recommend Ben Phillips as absolutely the best family law attorney out there. Before my divorce I did know Ben but now I consider him a friend.

If you are looking for an attorney who is extremely smart, competent, effective, fair in billing, and empathic to your situation, then Ben is a great choice for your attorney. My divorce was complicated and my ex wanted to fight. Ben was able to keep the focus on the facts and keep track of the vast quantities of paper and rabbit trails that the other side created. He was quite organized and retained the relevant information such that when we finally did get to court, he knew exactly where to go to get the pertinent information/numbers. He did not allow the other side to "bully" me, which in fact they tried. I highly recommend Ben as an excellent lawyer who can handle just about anyone. By the way, don't be misled by his nice smile, young appearance and 6 years in practice... He is smart and he is a fighter!

“Because of Ben's expert advice, forethought and planning, I can say that I have shared in the most important moments of my son's life. I started out without any visitation agreement for my son. I went through over a dozen ex parte notices during a nasty divorce. At the end of the day I ended up with 50/50 custody and my son is attending the school of my choice. Ben was an attorney and a friend. Always taking the high road and always having a plan. From the start to the end Ben took every one of my many calls and always managed to make me feel like my case was at the top of his list and front of his mind. I am grateful for what Ben has done for my family.”

Ben Phillips is the finest attorney I have ever known. My marital dissolution was financially very complex with substantial assets at issue. He successfully managed the process, including a 4 day trial. He is professional, responsive, intelligent, articulate and, most of all, kind and compassionate. Words cannot express my gratitute to him, as well as Gerry Phillips, for all that was done for me.

James Sweeney is unparalleled in his professional and easy-going handling of his cases, the meticulous research he engages with, and the drive to success in his cases. I can say that because he won my case. He aims to win and has the drive to follow it through to the end. If you need an attorney to go to bat for you, James Sweeney would be welcome on any team as a pinch hitter to get the job completed with everything given to that goal.

Mr. Sweeney is one of the smartest people I have ever met in my life. He knows the law better than I could imagine and was able to help me win 2 court cases with the background and knowledge he has learned throughout the years. A family friend recommended him to me and I am surely grateful to have him on my team. I recomend Mr. James Sweeney and know he is the #1 defence attorney in Orange County California

All I had was a traffic ticket, so I went online to ticket snipers to remove it and they failed and offered no way to fix the issue. Mr. Sweeney refilled and has given me a strategy that I can stand behind. I'll update my review when I win the case!

Vanessa was assigned to my case and her and her team took care of everything. They made sure to communicate with me at every step and I can't say how much I appreciated it. My mother ended up getting into a car accident a few years later and I immediately reached out to Vanessa. I can't recommend them enough, they always get the job done!!

I would highly recommend Kalfayan Merjanian. They are there for you to help to answer any questions or just check in on how you are feeling. From day one until the closing of your case (5 years in my case) you have someone on your side. Thank you!

I was in a bad car accident last year and I was recommended to work with Kalfayan Merjanian and I’m glad I did. Getting into a car accident and all the aftermath of an accident is stressful, but working with this firm it made it all a breeze for me. They helped me find the medical care I needed and made appointments for me. Very communicative throughout the process. It was a pleasure working with everyone from this firm.

Can a Lawyer Represent Me in Courts Outside of Newport Beach, California?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
