When my mother, who lives in California, was sued by a major bank as a guarantor, we initially hired a local Utah attorney since the litigation was filed in Utah. Unfortunately, it became clear that this first attorney was not competent. That’s when we brought in Marianne Dawson-Man, Esq., to assistwith litigation strategy, settlement efforts, and oversight. Marianne quickly identified the gaps in the first attorney’s work and advised us through the process of replacing him with new local counsel. Since the case was in Utah, we had to engage additional Utah attorneys to manage court filings, procedural compliance, and appearances. Unfortunately, the second Utah attorney we hired proved to be both ineffective and unresponsive, missing key moments and failing to stay on top of important emails and documents. To keep the case on track, we brought in two more Utah attorneys, but they focused more on administrative tasks. Marianne had to guide them to engage strategically with opposing counsel, as they often deferred to the bank’s demands without pushback. Throughout the process, Marianne provided the litigation strategy and direction that had been missing from the case. Some attorneys discouraged us from pursuing an indemnification agreement—worrying it could complicate negotiations or trigger third-party involvement—but Marianne recognized how essential it was to protect my mother’s interests. She remained persistent and insisted on safeguards to minimize my mother’s liability and ensure her assets were protected. Marianne also managed aggressive opposing counsel from the bank, along with a third party's legal counsels that aligned with the bank’s efforts to shift the full burden of liability onto my mother. Thanks to her strategic persistence and leadership, we secured a favorable settlement that included an indemnification agreement—a key protection that other attorneys had advised against pursuing. Not all attorneys are the same. Marianne provided the leadership, strategy, and advocacy we needed to overcome complex challenges and secure the best outcome possible. Without her involvement, I am certain we would not have achieved this result. I highly recommend Marianne Dawson-Man to anyone seeking an attorney who can lead complex cases, anticipate challenges, and deliver real results.

I was really pleased with the service of Berstein Law APC. Thank you very much for the ordeal you took into hands and help me make the right decision. This law firm helped get through my business issues. Their attorneys are exceptional and give advice relating to business or business law anytime I call them. I recommend especially if you have business near Newport Beach and Huntington Beach.

I called different law firms and Berstein Law was the only firm I called that someone ( not an answering machine) actually answered my call. Within a short period of time, I consulted with one of the lawyers who was very professional and competent. Days after hiring Berstein Law, everything was resolved. Additionally, Bernstein Law kept my legal costs at a minimum. Without any reservation, I strongly recommend Berstein Law to anyone or any business seeking legal advice, help, and/or representation.

James Sweeney is unparalleled in his professional and easy-going handling of his cases, the meticulous research he engages with, and the drive to success in his cases. I can say that because he won my case. He aims to win and has the drive to follow it through to the end. If you need an attorney to go to bat for you, James Sweeney would be welcome on any team as a pinch hitter to get the job completed with everything given to that goal.

If you are ever in a tough bind, I would highly suggest Ashley Daniel as your Criminal Defense Attorney. With his previous experience working on the other side of the opposition as a District Attorney, he is able to view things holistically as other attorneys would lack experience in. In return, this would benefit the entire situation, whether or not the allegations are true. Ashley makes every effort to go above and beyond for you. He tries to help people genuinely by earning an honest living. His prices are reasonable to his scope of practice. His dedication is over the top with his clients and it shows in his tenacious approach. With that said, it is always best to consider an attorney who will listen to you as a friend and will provide you with the help you are in. Give him a call and I am sure it would not be regrettable.

Vanessa was assigned to my case and her and her team took care of everything. They made sure to communicate with me at every step and I can't say how much I appreciated it. My mother ended up getting into a car accident a few years later and I immediately reached out to Vanessa. I can't recommend them enough, they always get the job done!!

I was in a bad car accident last year and I was recommended to work with Kalfayan Merjanian and I’m glad I did. Getting into a car accident and all the aftermath of an accident is stressful, but working with this firm it made it all a breeze for me. They helped me find the medical care I needed and made appointments for me. Very communicative throughout the process. It was a pleasure working with everyone from this firm.

What Questions Should I Ask Before Hiring a Lawyer?

Hiring the right lawyer is crucial for the success of your case. Here are some important questions to ask during your initial consultation:

  1. What experience do you have with cases similar to mine?
Ensure the lawyer has relevant experience in the specific area of law pertaining to your case.
  2. How do you charge for your services, and what are the estimated costs?
Understand the fee structure, including hourly rates, flat fees, retainer fees, and any additional expenses.
  3. Who will be handling my case?
Find out if the lawyer will handle your case personally or delegate tasks to other attorneys or paralegals.
  4. What is your approach to resolving cases like mine?
Learn about their strategy, whether they prefer negotiation, mediation, or litigation.
  5. What potential outcomes can I expect?
While no lawyer can guarantee results, they can provide an assessment of possible scenarios based on their experience.

Can a Lawyer Represent Me in Courts Outside of Newport Beach, California?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
