I hired Attorney Nilsen in November, 2020 to prepare a I-601 waiver regarding an I-129F Petition K- finance visa for my fiance in Thailand. Attorney Nilsen did an excellent job on the I-601 waiver that was approved in early March, 2020. I was extremely pleased with the job Attorney Nilsen for me and I gladly paid her fee. However, after the waiver was approved in March, 2021, Attorney Nilsen never got back to me to advise me of the next step with the Embassy in Thailand. Over two months went by and I did not hear from the Embassy or Attorney Nilsen on how to proceed. I inquired myself in mid to late May, 2020 and the Embassy would not talk with me. I tried to notify attorney Nilsen and after two or three attempts she finally got back with me. The Embassy contacted her and she contacted me on the next procedure for my finance to be heard at the Embassy in Thailand for her Visa. I am upset that attorney Nilsen did not tell me the process right after the I-601 waiver approval so that we could of quickly got the next process started so my fiance could get her visa. We lost two and one half months time before being told what the next steps would be to schedule a visa interview. Once my fiance and I acquired the necessary documents and paid the visa fee we qualified to schedule a visa interview at the Embassy in Bangkok, However, Thailand was not scheduling visa interviews because of a covid-19 lockdown in Bangkok. I checked and saw they were scheduling visa interviews up until June, 2021. However, we are now waiting for the interview process to open up again when we could of been scheduled for an interview in May or June, 2021. We are an older couple, I'm 73 and my fiance is 57 and Attorney Nilsen's failure to inform us of the next process has caused us much frustration and anguish. Now visa interviews in Bangkok may not open again until September or October, 2021. That would be 6 or 7 months since the I-601 waiver was apporved. Attorney Nilsen offered to do the next process for me for another fee and I politely declined and was not compelled to use her sevices any longer because of her lack of diligence in our case. I informed attorney Nilsen of my displeasure with her through an email. To this day she never replied with an apology or that she was sorry for the unnecessary delay in our case. If she did I would not be writing this review and would of even considered using her services for the next process. I'm disappointed in attorney Nilsen's actions and hoped she would of displayed a little more professionalism.

My wife and I were dealing specifically with a claim for restitution in relation to a hit pedestrian in a DUI case. Admittedly, the $250 fee for a phone call struck me as odd as none of the other firms seemed to be requiring the same upfront cost. That said we wanted to cast a wide net in terms of attorneys and kept the meeting. Givelle was probably the 10th attorney we spoke to regarding our situation. Our frustration through the process was that many attorneys seemed intent to just handle pretty straight forward DUI cases. From our novice perspective, these attorneys did not seem to have a good grasp on the nuance of more complicated DUI cases and were for the most part not able to help us. Luckily, we were able to connect with Givelle. 5 minutes into our conversation, we knew that the $250 was going to be well spent. Our understanding of the situation by the time our consult was over was light years ahead of where it had begun. Givelle ended up not being the specialist we needed for the case in front of us, however after giving us much better insight in terms of what to expect from the courts she immediately connected us with an amazing attorney that has expertise in this niche arena. After spiraling for a bit, we finally feel like we are headed in the right direction thanks to Givelle's guidance. Prices are only expensive in the absence of value. That phone call was probably the cheapest $250 we've ever spent. If you're in a tough spot, this is a phone call you need to make.

Kim is an excellent, seasoned lawyer who tells it like it is-- but in a nice way. She is a leader with her own practice-- this experience and expertise in the field makes Kim a big fish, and she would do well to take on larger clients engaging in new or existing business or real estate transactions. I can tell she is committed to honoring her humanitarian values when doing business: Scala is generous and cares about the people behind the deal and making sure that the agreement works out for everyone involved. She advised me on engaging in a new business venture and I couldn't be more happy with her response and our interaction. Kim also was a small business owner herself-- so she understands the legality of an endeavor but also the other intangible rewards that make us entrepreneurs. Highly recommended for general business counsel, contracts law, strategic advising, real estate.

What Questions Should I Ask Before Hiring a Lawyer?

Hiring the right lawyer is crucial for the success of your case. Here are some important questions to ask during your initial consultation:

  1. What experience do you have with cases similar to mine?
Ensure the lawyer has relevant experience in the specific area of law pertaining to your case.

Understand the fee structure, including hourly rates, flat fees, retainer fees, and any additional expenses.
  3. Who will be handling my case?
Find out if the lawyer will handle your case personally or delegate tasks to other attorneys or paralegals.
  4. What is your approach to resolving cases like mine?
Learn about their strategy, whether they prefer negotiation, mediation, or litigation.
  5. What potential outcomes can I expect?

Can a Lawyer Represent Me in Courts Outside of Oakland, California?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
