I recently had the unfortunate experience of working with David Martucci from Martucci & Associates, a law firm in Orange County, CA. My ex-spouses attorney, David Martucci, not only provided false documents and presented fraudulent false statements under oath in court, but also repeatedly refused to meet and confer with me over 10 times, showed up to court unprepared, and failed to file important trial documents. To make matters even worse, David produced a written transcript of a video and changed the facts from the video to say that I owned 100% of a company that I only owned 1% of despite having personal knowledge and documentation showing my true ownership only being 1%. This was a baseless and misleading representation that caused significant harm a d long term damages to my case. David also presented a Profit & Loss Statement from a company that I was working for and lied to the court saying that it was my company when in fact I am just a W2 employee with zero ownership. His lies have greatly impacted the outcome of my hearing. He has no problem presenting false evidence in court if it benefits his client. I also witnessed David leaving in the same car as my ex-wife after court. Seems a little weird if you ask me. I would caution others to carefully consider their options before retaining this law firm. While I understand that every case is unique, my personal experience left me with a lack of confidence in the legal system. Honesty, competence, professionalism, and a strong commitment to their clients' best interests are critical in the legal system, and I did not feel that these values were upheld with David martucci from Martucci & Associates. To make matters worse, the firm's website looks completely unprofessional, as if it was created by a child. It is important to note that this review is not intended to harm the reputation of the law office or the individual attorney. Instead, it is meant as a warning to others to thoroughly research their options and choose a legal representative who operates with honesty, competence, professionalism, and who accurately represents the facts in court.

Bankruptcy is never an easy decision—it can be overwhelming and even a bit scary. But hiring DiMarco Warshaw was the easiest and best decision I ever made. From start to finish, their team provided white-glove service, not just a "fill out this paperwork, and we'll get back to you" experience. Darren DiMarco was amazing! His communication throughout the entire process was above and beyond—he made sure I felt comfortable and fully informed every step of the way. I also had some federal IRS tax debt to discharge, which comes with its own complexities. Andy Warshaw expertly guided me through all of my options, ultimately helping me discharge significant tax debt. Thanks to Darren, Andy, and the entire team at DiMarco Warshaw, I now have a fresh start and a brighter financial future. They changed my life, and I am eternally grateful. If you are seeking information on bankruptcy or debt relief, I highly recommend reaching out to them. You will not find a more professional, compassionate, and knowledgeable team!

I don’t even know how to express how amazing this team of caring professionals are. Due to an accident my husband was in, we experienced months of recovery and missing work. With no other option our credit card payments had to be the thing that got pushed to the side to be able to keep our heads above water. This isn’t an easy thing to do and once the dust settles, is even harder to face and make the decisions on how to move forward to dig yourselves out of the hole. Darren is the most nonjudgmental person and gave us hope and reassurance that we could get all this handled from the first phone call. His main focus wasn’t on getting paid, unlike many debt consolidation company’s we had spoken to that were referred by the accredited organizations I had reached out to. He got all our info and had a realistic solution within a day of our initial call. He did exactly what he said he was going to do. His team responded to any matters quickly and efficiently. I felt like I had super hero’s fighting for the best for us. We have tackled almost every account with a solution that pleased all party’s involved and finally feel the light at the end of the tunnel. They took a situation that felt like we were being suffocated by and gave us hope and a fresh start! We cant say enough positive things to really express how wonderful the experience was and is, but if you felt any of this reflects your situation, this is the team you are looking for! Thank you again!

Our Corporation asked Mr. Tucker to provide guidance on a complex insurance claim and for direct legal representation if it were to become necessary. Over the 2+ years that it took to resolve the case, Mr. Tucker did an outstanding job of alerting us to issues and guiding our actions. He made every effort to help us stay out of litigation. At the same time, he directed us to prepare a solid database as if we were going to go to trial. When the insurance company chose to involve their attorney, Mr. Tucker represented us. He provided excellent, knowledgeable counsel, which, with the solid database that had been established, led to a positive outcome. Mr. Tucker is very easy to work with. He listens, responds appropriately to issues, is knowledgeable, checks with outside sources as needed, and can be quite aggressive if the situation calls for it. We are exceptionally pleased with the support and legal representation provided by Mr. Tucker and highly recommend him.

Mr. Tucker always remained up front and honest about the details and possibilities relative to the case. He did a great job of keeping our firm informed and consistently performed professionally in his duties. He was thorough in considering potential issues that could have presented themselves as a result of decisions made during the case process. If the necessity arises, I would surely look to hire Mr. Tucker to represent our firm.

What Questions Should I Ask Before Hiring a Lawyer?

Hiring the right lawyer is crucial for the success of your case. Here are some important questions to ask during your initial consultation:

  1. What experience do you have with cases similar to mine?
Ensure the lawyer has relevant experience in the specific area of law pertaining to your case.
  2. How do you charge for your services, and what are the estimated costs?
Understand the fee structure, including hourly rates, flat fees, retainer fees, and any additional expenses.
  3. Who will be handling my case?
Find out if the lawyer will handle your case personally or delegate tasks to other attorneys or paralegals.
  4. What is your approach to resolving cases like mine?
Learn about their strategy, whether they prefer negotiation, mediation, or litigation.
  5. What potential outcomes can I expect?
While no lawyer can guarantee results, they can provide an assessment of possible scenarios based on their experience.
  6. How will you communicate with me throughout the process?
Establish expectations for updates, preferred communication methods, and response times.
  7. What is the expected timeline for my case?
Get an estimate of how long the process may take from start to finish.

Can a Lawyer Represent Me in Courts Outside of San Clemente, California?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
