I recently had the unfortunate experience of working with David Martucci from Martucci & Associates, a law firm in Orange County, CA. My ex-spouses attorney, David Martucci, not only provided false documents and presented fraudulent false statements under oath in court, but also repeatedly refused to meet and confer with me over 10 times, showed up to court unprepared, and failed to file important trial documents. To make matters even worse, David produced a written transcript of a video and changed the facts from the video to say that I owned 100% of a company that I only owned 1% of despite having personal knowledge and documentation showing my true ownership only being 1%. This was a baseless and misleading representation that caused significant harm a d long term damages to my case. David also presented a Profit & Loss Statement from a company that I was working for and lied to the court saying that it was my company when in fact I am just a W2 employee with zero ownership. His lies have greatly impacted the outcome of my hearing. He has no problem presenting false evidence in court if it benefits his client. I also witnessed David leaving in the same car as my ex-wife after court. Seems a little weird if you ask me. I would caution others to carefully consider their options before retaining this law firm. While I understand that every case is unique, my personal experience left me with a lack of confidence in the legal system. Honesty, competence, professionalism, and a strong commitment to their clients' best interests are critical in the legal system, and I did not feel that these values were upheld with David martucci from Martucci & Associates. To make matters worse, the firm's website looks completely unprofessional, as if it was created by a child. It is important to note that this review is not intended to harm the reputation of the law office or the individual attorney. Instead, it is meant as a warning to others to thoroughly research their options and choose a legal representative who operates with honesty, competence, professionalism, and who accurately represents the facts in court.

Mr.Martucci is very passionate when it comes to divorce matters. He truly cares about his clients. I was fortunate to find him right here in San Clemente when I was playing golf. I have to say that he is very different than your typical attorney. I have lived in the OC area for a long time now, and it is tough to find a genuine attorney these days.

My family and I were extremely fortunate to be represented by Jesse Gessin. When I met Jesse I was facing up to 10 years in federal prison, with a recommended sentence 18 to 24 months. The case was a slam dunk for the federal prosecutors. I couldn't have given them more evidence against me if I had tried! I thought I was going down for a federal firearms offense. Then I met Jesse who was able to eventually get the case dismissed. When I went to my first meeting with Jesse I was frustrated, angry and worried for my family and myself. I had no previous criminal history and did not know what was coming. I couldn’t stop thinking of what I was putting my family through. I was going to lose my freedom, my job of almost 20 years and my specialized license. I was a wreck, to put it mildly. Jesse was right to the point, decisive, and hands on from day one. Jesse listened to my side of the story. He understood my anxiety. He never blew smoke to put me at ease. Instead he showed me how hard he was working for me, which helped with my anxiety and made my family feel better. Jesse left no stone unturned even with the overwhelming evidence against me. During the case, I knew exactly what was taking place, what my options were and what the outcome was likely to be. Jesse always communicated honestly with me. The government originally rejected Jesse’s offer for an alternate sentencing program. The government said that because my case dealt with a serious firearms offense, I was not eligible. Jesse did not let up. In Jesse's eyes I truly was innocent until proven guilty and he pressed the case forward. After Jesse prepared the case for trial, the government agreed to let me into the alternate sentencing program. Today, my case has been dismissed and I didn’t lose my specialized license! It was a long two years, but I am so thankful I had Jesse in my corner.

I met Jesse Gessin in August 2013 at an arraignment hearing, I was charged with a white collar crime. My indictment carried a very stiff statutory time of 20 years. I had been convicted in Federal Court previously of white collar offenses. So I was terrified that would aggravate the current case in many ways. Jesse visited me regularly while I was in custody and we talked by phone weekly, He was always easy to reach and always visited me on the dates he told me he would. He kept me abreast of all correspondence with the Government and sent me copies. Jesse reviewed the case methodically to determine if I had a plausible defense. There were many taped conversations where I had been talking to an undercover FBI Agent unknowingly; after Jesse had completed a thorough review of the case he told me that he was perfectly willing to take the case to trial, but my best course of action would be a plea agreement that I could live with. Jesse began dialogue with the prosecutor on a plea agreement to determine the government’s position. Jesse kept me calm through this procedure because the initial conversation with the Government was more incarceration than I could imagine. Jesse visited me and told me the Federal Sentencing Guidelines as well as any enhancements can be argued in court at the time of sentencing. I had been to several court appearances with Jesse representing me, I could tell the Judge and Prosecutor both had a lot of respect for Jesse in the courtroom, this was comforting for me to see. Jesse came to see me and told me the government had offered a deal, 60 months with three financial enhancements. The financial enhancements raised the amount of incarceration 20+ months. He said he had researched the enhancements and had a good argument on all three. He then went back to the prosecutor and negotiated a plea agreement whereby the government would leave the enhancements in the plea agreement, but would let the judge decide the sentence based on arguments at sentencing. I accepted the deal because of my faith in Jesse. The day of sentencing Jesse did nothing short of amazing; his argument convinced the Judge that two of the three enhancements did not apply to my case. I was sentenced to 30 months by the Judge. I received 30 months because of Jesse’s knowledge in sentencing procedure and his dedication to see that I received a fair sentence. I would highly recommend Jessie Gessin to anyone who needs an Attorney that they can trust.

I wasn't expecting to need a lawyer, but I called Mr. Payne about a family law matter a few months ago. He met with me and took the time to really listen to what was going on. I felt like he really cared about what was best for me and my kids. He took care of everything and made sure I didn't get taken to the cleaners. I was impressed with how hard he worked on my case and how much time he put in to make sure I was satisfied. Great attorney.

I hired Charles Payne for estate planning. The first thing that impressed me is that I was dealing with Charles, not his secretary or paralegal. He met with me to discuss the information needed for my estate plan. I immediately was impressed at the knowledge and skill that Charles has. He made me comfortable when discussing issues such as my advanced directive, being younger the conversation is a little weird so I was thankful to have a caring, easy to talk to attorney. Charles Payne offers significantly lower prices for estate planning documents and offers a very personalized service. I will be referring everyone I know to Charles Payne to handle their estate planning needs.

Can a Lawyer Represent Me in Courts Outside of San Clemente, California?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
