Pros

Thorough, strategic, and aggressive representation in criminal defense cases
“He was thorough, kept me up to speed as the case developed, and he was aggressive: he prepared my case from the outset as though he was preparing to win at trial, and that probably caught the DA off guard.”
2

“Mr. Hallinan masterfully negotiated a deal that avoided every condition I wanted to avoid. But most amazing of all, somehow Mr. Hallinan negotiated to have two pistols returned to me, that the police had confiscated.”
3
Excellent communication and keeps clients informed throughout the process
“Mr. Hallinan was a constant professional, he remained in constant communication with me throughout the court process. Mr. Hallinan explained to me the positives and the negatives regarding my case.”

In September 2023, my brother (25, from Arizona) got arrested (in San Francisco, California) after attempting to enter a conference within a community both of us grew up in and have been apart of since 2008. His car keys were knocked out of his suit pants during a tackle incident at the security clearance after he had trouble leaving when asked. According to my brother there was a misunderstanding of an email conflicting with him not being invited to the conference. After being tackled and handcuffed, he told the officers he had a concealed firearm in his vehicle, 5 minutes away, as he felt it was a danger for his keys to be off of his person. I was at this conference, and saw some of this happen live. My peers in our place of work were laughing, and making memes about this for months. There are many videos and pictures of the whole ordeal. They put 6 charges on him that night, including "possession of armor piercing ammunition" and "high capacity magazines" The SF media created a narrative off of the charges and the prosecution ran with it moving to deny bail within the first week, just as my family was even beginning to cope with this new reality. Public consensus of the incident caused a rift in the community between those who knew him for years prior and know he would never do what was being inferred by the media, and those who didn't know him and were led to believe it. Our family used this as fuel to ensure we stuck with this case mentally and financially, no matter how hard it felt and how much of an uphill battle it was at times. We went through two public defenders, and another private attorney before landing on Nechay Law in late March 2024. Nechay tried many angles of defense for this non violent gun storage charge. All previous charges except "having a concealed firearm in a vehicle" were wiped, and the remaining was moved to a misdemeanor which a change of plea got him out of jail after 1 year, 4 days. The prosecution was going for conviction on the felony level to get him 6 years, based upon the narrative they shaped up. Nechay (even after 7 months of other attorneys handling the case) was able to reverse and put to rest the previously life ruining, retribution hungry narrative. The best scenario out of all of this is he will be getting more familial attention and help to deal with previous traumas such as a car crash that totaled his very expensive car, two home break-ins, and his business faltering. Rebuilding for him will be a hard but rewarding journey, and Nechay has allowed that second chance of the sanctity of life to happen through her expertise. I cannot recommend enough. Our family is eternally grateful for Valery and her firm's service.

Adam was recommended to me through another lawyer and I'm so thankful that that happened. We corresponded via text before hoping on a phone call. I still can't believe how kind and empathetic and knowledgable he was. He's exactly the kind of person and lawyer that you want in your corner.

I can't recommend Valery Nechay enough as an attorney. Her knowledge in so many areas of the law is truly impressive. She went above and beyond to make sure every detail was covered, and I always felt supported and informed throughout the whole legal process. Even with her busy schedule, Valery always found time to answer my questions, no matter how small. She made me feel like I was in the hands of someone who genuinely cares and knows her stuff. Valery is not just knowledgeable and dedicated, but also incredibly compassionate. I'm so grateful for everything she did for me.

I was thoroughly impressed with Mr.Gasner's expertise and professionalism while handling my case. I initially contacted Mr. Gasner for a consultation to explain my case and get his opinion. After our consultation, I was impressed by his knowledge regarding my case and laws pertaining to it so I hired him. He was able to achieve the results that I had hoped, for and that other lawyers had failed to achieve. He was upfront with me from the beginning regarding what the timeline would be and what objections we might face from the DA. I highly recommend him!

Adam was recommended to me from a friend when I got into some legal troubles with the state of CA. At 28 years old my life turned upside down, uncertainty and doubt of how my future would turn out was not favorable. But to turn a bad situation better Adam's extensive knowledge and experience help break down the best options I had. His honesty helped save me time and money from going to a trial. That would have been more costly and had an more unfavorable outcome. Ultimately, with Adams guidance I took the plea bargain, since it seem like the best option for my future. Fast forward to a decade later because of Adams knowledge and the previous plea bargain I was able to expunge my criminal record. That second chance lift a lot of burden off my shoulder and made me feel like a new person able to pursue more employment opportunities and provide a better quality of living for my family.

As a scrappy startup, working with David from the early days of our business, we were able to secure multiple deals with major publishing and entertainment entities in Japan which were not only critical contributors to our success but also withstood the rigors of 2 exits. David's solid knowledge of the entertainment industry combined with his Japanese language ability and expertise in dealings with Japan were perfect to support our business.

Can a Lawyer Represent Me in Courts Outside of San Francisco, California?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
