In a day and age when qualified, ethical, experienced, fairly-priced, communicative attorneys are as rare as a Sumatran rhino, along comes Desmond Tuck. I have been working with Mr. Tuck for over 20 years on various issues, most notably matters involving real estate. Without delving into details, I can safely say that you will be unlikely to find anyone better if you tried. He knows the law, but he also knows how to make it work to your advantage. Most importantly, he will never tell you what you want to hear just so you hire him. If you want a lawyer to sugar-coat and tell you things to make you feel nice (when they are undeserved), he is not the one for you. If, on the other hand, you want to receive help that is based on reality and in the context of our disastrously dysfunctional California legal system, Mr. Tuck is the only one I would count on. Knowing how to navigate the system in a logical, rationale, and informed manner is one of his biggest (of many) strengths. As far as trust is concerned, I know that is a concern of many when it comes to lawyers in general. So, imagine a world where you were 100% sure your lawyer was expertly looking out for your best interest without doing it all just to keep the meter running. Sound too good to be true? You haven’t called Mr. Tuck yet. After all this time being his client, I trust him more than some in my own family. So, there you have it: trustworthy, ethical, experienced, extremely competent, informed, and fair in every way. He redeems all those “other” lawyers…you know who they are.

I had a tenant who was involved in a very serious problem and I knew I needed legal advice (beyond the customary landlord references) to terminate the lease. Desmond researched the issue and explained my options in what could have been a lengthy & complicated process. Luckily, it resolved itself without our participation and with his expert advice, it was brought to a conclusion.

I was in an innuendo with my Home Purchase. We went through all the steps with due diligence since we have been on a contract. The Seller refused to sign on the day of the closing and went hiding. Not knowing what to do, I have been referred to Atty. Desmond Tuck. I will get to the point instead of adorning him with tons of adjectives, which he deserves by all means. Atty. Desmond was able to analyze and derive the possibilities within 30 minutes of the initial consultation. Without any delay he acted on my case putting a lis pendens on the property and getting ready to prepare the seller perform per the contract as per the law. i.e., Specific Performance through Arbitration. His letters to the opposite side was intransigent, coherent and extremely clear about what we are pursuing. He acted on the case promptly making the seller come out of the hideout and offering to pay damage for walking away from the deal. He negotiated on my behalf and obtained about 10% sales price of the purchase contract + all the out of pocket costs which included my escrow deposit, litigation costs, cost of inspection and appraisal. He made all that happen in a matter of 20 days. Here are few things that make him an outstanding lawyer. Plain fact and no gibberish. He does a due diligence in keeping you informed. I am an Engineer and so good with numbers. He derives possible outcomes of a litigation from his wealth of experience and intuition which tells me he has actually paid attention at his law school. He has the correct education and handles your case putting himself in your shoes. He possesses exemplary work ethics and he is an honest human being who would not just go by the texts. He will work with you and make a plan that is most appropriate for you. He will consider your limitation and take or advise steps that you would be comfortable with. He could have gone on with my case and make himself more money. But instead he advised me to full stop to it knowing my objective was not to deal with court but to find a suitable home. He worked towards helping my broker get his fees although he was under no obligation to put any effort there. In addition to that, he is a very approachable human being you would actually like to talk to and get to know as well. I could not be happier with his service. A top-notch lawyer and I would call him an Ideal Lawyer. Coming from a different country and culture, being with the top academic and professional peers in my life, it is definitely not difficult for me to attest to someone’s intelligence and quality. Atty. Desmond Tuck is a A+ scorer in my list. He will by far exceed your expectation of a lawyer. A friend in need indeed. I had worked with many lawyers in the past for corporate patents, my personal immigration as an Outstanding Researcher , company acquisition. I have met many top 10 school JDs and I must say, Atty. Desmond takes his cases personally and he is passionate about what he does. Unlike me, he does not talk more and waste time, he is to the point, eloquent and an action oriented person. You will not regret having him serve you. I can attest to that. Thanks to him for making my life easier.

I had been involved in a motorcycle accident. A friend of mined who works with Desmond recommended him. My friend is in the real estate business and deal with millions of dollars annually. Desmond handles most of his legal need. Initially I was intimidated to call Desmond, since my claim was very minimal relative to his type of work. My friend told me that Desmond handles every case small or other with the same level of importance. I called Desmond, and that was exactly the case. He gave me five star services, he is professional, friendly and experience. He kept me inform and involved. Eventually I got compensated to my satisfaction.

Great lawyer. I had been to 3 previous lawyers with my divorce case and Mr. Davis turned the case around even though he said he did not think he could repair the damage that had already been done. I did not get everything I should have gotten but I sure got more than I had already lost due to 3 previous incompetent lawyers. He was very aggressive and the other attorney could not keep up wih him.

I started with Andrew as my civil lawyer, and after frustration with my family lawyer, I hired Andrew for my family case too. Andrew and his colleague, Lindsey, are the strongest attorneys I would vouch for. Extremely knowledgeable, experienced, and professional. My former attorney made (/forced) me a settlement to share legal and physical custody of my minor. That was nothing but a disappointment. It made my case stretch over and over. When Andrew and Lindsey took over my case, I ended up getting full legal and physical custody of my daughter while the judge was boldly against me in every single hearing and trial. But Andrew navigated the case for me and made me gain full custody of my daughter. Andrew was transparent in presenting the case. He allowed me to express myself in the court. I have to add that Andrew is very fair and reasonable in his fees and charging me. I could not think of any better service.

We sat down and told him what I wanted in an operating agreement and he did a good job on the first draft and we signed 2 days later without much back and forth. He did everything I asked and gave me good advice. I am very satisfied.

Lana’s advice solved many outstanding issues with my relative’s criminal case. Most experts give advice that is very general and not applicable in real life legal situations. Lana’s information allowed me to make decisions that maximized my relative’s chances of success. I’ve found that our legal system is fickle in nature, advice and strategy must revolve around probabilities of success. Lana’s guidance allowed me to execute a series of steps to achieve the best possible outcome. Without Lana, I may have made the wrong decision in my quest to help my relative. My dialogue with her proved to be priceless.

Can a Lawyer Represent Me in Courts Outside of San Mateo, California?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
