Richard Hess is really an expert in estate planning. He made estate planning easy even for me, an immigrant, where English is not my first language. He also has a free consultation and his staff is very friendly. He used his years of expertise to steer me in the right direction for my specific estate plan. Richard is fun and will make you laugh. Many years ago he was an engineer and also an ER nurse, and he draws on these past careers to give exceptionally unique valuable advice.

Cannot recommend this guy at all. He overcharges for his cookie cutter trust documents, and on top of that he is egotistical, does not take zoom calls, and caused a lot of trouble for our family. This is one someone you want to work with during a time of grief.

Six years ago we hired Richard Hess to draw up a revocable trust for us. Everything was fine until a couple of months ago; we realized we needed to make some changes to the trust. Richard was very busy and it took over a month to set up an appointment with him. He doesn't do zooms so we had to settle for a phone call meeting. A couple of days before the meeting we asked if we could move the meeting up a half an hour. We were told no, because Richard had another client right after our phone call. So we had to keep the meeting scheduled for the original time. 15 minutes after our scheduled meeting I called the office and was told RICHARD was running late with another client. 30 minutes after our scheduled time RICHARD called us. When RICHARD finally called us he said "I understand you want to make some changes to your trust". He didn't apologize for starting the phone call late. We could not complete all our requests for changes in half an hour. When we asked him why he was late calling us he replied "I'm sorry but, I am a very busy lawyer, one of the busiest lawyers." We asked him "really, is that all you have to say?" Then he replied "well maybe you should find another lawyer. " We then asked RICHARD for a digital copy of our trust and he refused and told us to scan the over 200 pages ourselves. His behavior was the most unprofessional we have ever seen, especially from a "busy lawyer." We will NOT be using him in the future.

Mr. Ainer helped me assess the viability of a trust for an elderly bi-polar family member. He indicated their need for a self-directed trust to protect assets that could be quickly absorbed due to medical costs. Today, my elderly family member feels less prone to worry about the future for themselves and loved-ones should sudden long-term grave illness occur. Mr. Ainer, took special time and care to look at every aspect of securing the assets, while still providing access. The process was well thought out and documented impeccably. Mr. Ainer also supported me in understanding the complexities of another trust I had to personally administer as the trustee. He proivded direction on some litigations occurring and remedy approaches. Mr. Ainer, additionally, presented the option of Arbitration in a contentious matter with a "contentious" law firm regarding fees. He sought to help decrease my expenses, while maximizing the return I could experience from a favorable decision. I've come to know Mr. Ainer and also his partner, Mr. Fraker as highly skilled, knowledgeable and trustworthy. I'm very highly recommending them for your needs in legal matters. The firm is caring, supporting, and trustworthy. I'm a person who has had an extreme number of attorney over the last 6 years and have experience several different kinds. Those that will take your money, while on the verge of getting disbarded, to those who will want to drop your case just prior to trial after several years of representation. Hopefully, you can have the opportunity to be in trust-worthy legal relationship with Mr. Ainer, its a totally rewarding experience.

Patrick was the only attorney who was ready to defend and not settle against false accusations brought against us. And he won with a clear mindset about how things will unfold in a complicated case. I interviewed 6 other attorneys for the case. Only he was able to articulate this winning strategy, which he then executed to win the case without settling. In fact we received the reward.

Can a Lawyer Represent Me in Courts Outside of Saratoga, California?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.

Bring a valid photo ID for verification purposes.
