I was arrested at my Denver home in the summer of 2017. Without mentioning any specifics regarding my case I was facing a total of 11 charges. Over two thirds of the charges were very serious non-violent felonies. I was completely innocent of all charges but was involved in the case because I was hired by a company to work part time (roughly 8-10 hrs/week). After being arrested I came to find out that the company I worked for and all of the owners were into some very shady dealings. Unfortunately every employee that worked for this company guilty or innocent was arrested & accused of being involved in a criminal conspiracy. I had no previous knowledge of Rob Bernhardt & his staff until a good friend of mine referred me to Rob. 1 day later Rob showed up in person at Denver County to meet with me and discuss the situation. There was very little pressure from him to hire but he did mention he was absolutely the person for the job as he only deals with criminal cases. After hiring Rob I knew immediately I had made the right decision. I had complete trust in him from day 1 and knew he was doing everything possible to fight the false charges against me. He continued to work extremely hard in consistently speaking with the DA on my behalf. I was facing many many years in jail and potential of being a convicted felon....I know Rob & his team spent hundreds of hours reading and combing through thousands of pages of discovery regarding my case, over 3 terabytes of data. It was a very large and complicated case that took over 9 months to be resolved and I couldn't be happier with the outcome. He was able to get all 11 charges dismissed & I know it was not an easy process. I would highly recommend Rob & his Office Manager/Paralegal Nic to anyone looking for representation. Rob is extremely trustworthy, has an amazing work ethic, knows Colorado Law inside and out, has great communication skills, and is a bulldog with the DA or the state when that's whats needed. When your reputation, your business, and most importantly your freedom is on the line and about to be taken away there is no other attorney I would trust or recommend more than Rob Bernhardt.

Near the beginning of 2015 I was falsely accused of a serious crime that threatened to ruin my reputation and greatly limit my freedom for life. When it first happened I hired a law firm that specialized in that type of crime and after putting down a large portion of my life savings, I thought that I had made a wise decision. The lawyer assigned to me was young and did not seem very enthusiastic about his work. Rather than work on a defense for me he referred me to specialists to pay more money for information that we would submit to the district attorney in hopes to compel them to take it easy on me. After spending thousands more on these services and getting nowhere with the DA, I was broke and heading to trial with a lawyer I couldn't trust... if I made another hefty deposit. Stuck in a bad spot, a friend of mine referred me to a lawyer who had helped him in a DUI case. It was Rob Bernhardt. After meeting him, I felt reinvigorated. I knew I was innocent and I had a lawyer I knew was going to battle with me. Rob gave me confidence and hope when no one else could. After making attempts to get somewhere with the DA, it was clear we would have to take them to court and win. With class and intellect, Bernhardt exposed the "witnesses'" and accuser's lies. He took on the prosecution's attempts to smear me. He rightfully proved to the jury that I was an innocent man. And in the end, I was acquitted. My life that was almost destroyed by a vindictive person and an overzealous district attorney was restored. My reputation saved. I cannot ever thank Robert Bernhardt enough for helping me in a time of dire straits and for doing so at a price I could afford. I recommend him to everyone who needs a lawyer and have referred multiple people to him. I would hire him again in a heartbeat.

I was originally referred to Maureen O'Brien at O'Brien, Thomas and Bibek, LLC law firm by my personal attorney. Maureen was unable to take my case due to illness but she recommended David and he accepted my case. David provided invaluable professional and discreet assistance in the court room while handling my case. He spoke to the judge and the district attorney on my behalf on several occasions while we were both in the court room. He negotiated a reduction in charges with the district attorney that changed my potential conviction of a felony to a misdemeanor. David also led me through the required paperwork and after I fulfilled my court ordered probation requirements, achieve early termination of my probation. I again, highly recommend David Thomas as a criminal defense attorney.

Dave accepted my case and went right to work. He provided great information, guidance and expertise. He was also very prompt with communication and professional throughout the entire criminal process. He guided me through the decision process of a plea agreement or a trial and gave me the pros and cons of both decisions.

Dave Thomas is an exceptional attorney! we highly recommend him, for anyone seeking an ethical, caring attorney, who will work to get the best resolution for your case. From our first meeting with Dave to discuss our son’s case, it was clear that he is a passionate advocate for his clients. In our time working with him, we never felt rushed or unheard. Dave always took the time needed to address our questions and concerns and to explain the often-confusing legal process. He was very upfront with us from the start, giving possible outcomes of the case and what we should expect. We appreciated his honesty in telling us what we needed to know and not what we wanted to hear. Well respected both in the community and within the legal system, Dave also has extensive courtroom experience. He has worked as both a district attorney and defense lawyer, allowing him to easily navigate the legal system. Dave is a consummate professional on every level. Putting our trust and faith in Dave, was the best decision we could have made.

Can a Lawyer Represent Me in Courts Outside of Golden, Colorado?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
