I had been wanting for 27 years to see if it was possible to have my OTH discharge upgraded. I contacted Marc's firm and consulted with them, telling them my story to see if it there was any chance, they told me there was and assigned Marc to handle my matter. I was also in contact with Marc to tell him my side and he requested my military records and told me, after careful review that there was indeed a chance but he never set my expectations too high. I would have been satisfied if I learned that I was upgraded to a General Under Honorable, but after a year or so I Marc contacted me to let me know that I had received full relief with an Honorable Discharge. Let me start out by saying i had the privilege of working with Mr. Napolitana in December 2020. If you find yourself in a situation where you need a dedicated, knowledgeable, and experience attorney who knows military UCMJ inside and out, who will fight for you. i am facing a Admin Separation for drug abuse and i decide to hired a attorney. I was discharged in 2015 under the Temporary Disability Retirement List. A brief explanation of what it means is I was discharged with a disability rating from the DOD which allowed me to have Tricare benefits. TDRL is a temporary program. Based on your conditions at any point after your follow-ups or the end of the program you can be found Fit for Full Duty, receive a severance, or transfer to Permanent Disability Retirement List. I feel I had hard time grasping this process. There was a lack of communication on PERS-95’s end. Marc stepped in and eased so much of the anxiety I had. Anytime I had questions, concerns, or just to clarify information Marc was available through email or phone. I received a response in a timely manner and answered my calls. I feel that is very important for me to say because I have had my fair share of attorneys (for different reasons).
