Our Asset Protection and Medicaid application started with an attorney in Leesburg, VA. The trusts they wrote and the strategies they used to protect the assets made our case unnecessarily complex almost to the point of failure. It later surfaced that they were not qualified to file a Medicaid application in the state of Florida. This attorney said we would have to find a qualified Florida attorney at our own expense. We learned what a bad attorney is. We chose Jason Penrod of Family Elder Law for the Medicaid application. Family Elder Law reviewed the trusts from our Leesburg attorney and explained clearly to us how the battery of trusts the Virginia attorney had created were inadequate and could jeopardize the process and require going through probate; something even a basic trust can avoid. Family Elder Law took control after seeing the substandard work from the Leesburg attorney and drafted a Qualified Income Trust (QIT) to replace a poorly written Living Trust and corrected other Trusts. Their revised Trusts contained the proper language required for the States of Florida, Maryland, and Virginia where the assets were located. We now know what a good attorney is. We also worked with the staff of Family Elder Law and they earned our trust and confidence with their in-depth knowledge, clearly stating the direction we would proceed, and why this was a better strategy than what the Virginia attorney had started. Everyone, including Jason, were willing to clearly answer our numerous questions. When we emailed or sent a text, they responded within minutes not days. They knew how the different Trusts were essential to achieving a successful outcome. They clearly guided us in the roles and responsibilities for managing these Trusts and how to avoid possible costly errors. Several years have passed since we placed our faith in Jason and my mother-in-law sadly has since passed. I can say that fulfilling her final wishes were positive.

I met Jason a few years ago when he helped my father with my elderly aunt's transition from Texas to a Florida ALF. Now several years later Jason and his associates have helped me navigate the uncharted waters with my mother and father and all of their needs. You never know how quickly life can change. My mother suffered an injury that rendered her unable to care for herself and my father. We were totally unprepared for everything that had to be taken care of in a short amount of time. Jason and his staff have been an invaluable help to me. Not only with the legal aspects but they were there for me emotionally. I had no idea where to start. Jason and his associates knew exactly what needed to be done and when. I was able to concentrate on my parents and not worry about the legal details. My father has since passed away which brought other changes to our situation. I am currently working with Samantha Carter. There are no words to express my gratitude for everything she has helped me with. She is always there to answer my questions. I never dreamed how complicated life can be. But just knowing that Jason and Samantha are there has taken a huge burden off my shoulders. I would recommend them without hesitation to anyone with elderly parents.

Jay McClendon took over half of my oldest sisters Trust Fund. She was Down Syndrome and elderly plus he took his sweet time, four years to move it from one place to another charging the Trust Fund everyday of the week. And left her less than 9K pl the Trust Fund Co charged the account for handling it. Jay McClendon takes advantage of people especially if he knows a person is not savvy in knowing the law. And doesn't try to explain anything.
