Michael Polk wisely guided me through the South Carolina probate process following the death of my brother John Young. John was a retired South Carolina attorney. I was my brother's personal representative and live in New Hampshire. John's children and I are grateful for the clear, efficient, personal and professional instructions.

Mike Polk turned a horrific probate experience with Richland county into a walk in the park. He is a true man of his word. First of all he gave us a price with doing our grandfather’s probate but then it turned out we had to combine our grandmother's probate along with his and also transfer 3 properties into our name. (Thats two different probates and three properties) He went well beyond his job but stuck to what he quoted us from the beginning. He went through numerous obstacles from different counties relating to the properties but all I know is one day he called and said come sign off I’m done and I’m not going to change the price since that’s what I said from the beginning. Of course we didn’t agree with him and payed him extra. All paperwork from changing deeds and address was done. He was a very well spoken and somewhat a quiet guy but we got him joking around and laughing with us.😂😂 The office is very clean and neat and well put together.

My husband and I were referred to Mike Polk at Belser Law Firm to write up a will and trust for us. Mike was excellent with explaining everything to us in terms that we could understand. He was very patient and kind. The office is in a lovely old building in downtown Columbia with a beautiful conference room where we could discuss our needs and wants. We would highly recommend this law firm and especially Mike if you are wanting to plan for you and your family's future.

In February 2021, I made the decision to hire David Paavola to handle my 90 year old Mother's Eminent Domain case vs. the SC Department of Transportation regarding her prominent 1 acre piece of property on US #1 at I-20 in Lexington SC. This was a major restructure of the traffic patterns in that area and is still in progress today. David was well-versed and definitely more than capable of this type of case. He came highly recommended to me. He was very personable from our first meeting at the site and demonstrated both his knowledge and desire to handle this case for us. He was ALWAYS quick to respond to any correspondence or phone calls I initiated and certainly kept me informed as to where the case stood. Due to the fact that they were destroying the value of this corner piece of property that had 2 in-and-out entrances and a traffic light and leaving us the property in front within 6-feet of the front door of a new acceleration traffic lane and with a "fly-over" on the side, we were offered payment for only half of the land. We needed the DOT to purchase the entire amount as it was now uninhabitable for a 90 year old person and we needed to relocate her. This entire process took exactly 2 years due to the State Government being slow to do things. As we proceeded to take this matter to court, David produced an exceptional video of the situation at hand, before and after circumstances , and included my mother. She and my late dad bought this property and built the existing house there in 1951. That day at the conclusion of our meeting and David's presentation, SCDOT agreed to pay the full amount of our appraisal that we were asking. I was also never surprised by any additional legal fees during the 2 years I worked with him . The entire experience, although personally difficult for my family, was handled most professionally and with great expertise. I would highly recommend David Paavola to anyone who asked.

I had a tough case that most attorneys would have turned down, but Mr. Samuels is not like most attorneys. He knew what he was getting into would be a challenge, but he took it on and persevered. I was impressed with his knowledge and experience, which far exceeded my expectations. His paralegal, Katherine, was also an MVP. She was on top of things, always prompt and courteous and smart like a whip! They made me feel like I was their only, most important client and both my family and I appreciate everything they have done. I can finally get back on my feet and move forward.

Elizabeth Franklin Best is an outstanding attorney. Betsy more than lived up to her qualifications and reputation! I knew from the initial phone call that she was the one. She was honest and direct. She did not over-promise or confuse us. She listened and explained the options. She developed a strategy and followed it through. Elizabeth was thorough and did the leg work necessary to get my Uncle out of prison after serving 19 years of a 480-month sentence. She kept us informed of the progress and the outcome was Amazing! The motion was granted several weeks later. Although my Uncle passed days before his release, Betsy was always available to answer questions and provide support and direction for anything else that came along. Thank you, Elizabeth Frankin Best you are THE BEST! Vickie Corley

My son was sentenced 50 years in SCDC at 19 years old and devastated the whole family, because he never should have been sentenced that harshly. Mrs. Best came to prison and spoke to him and gave him hope and life to fight for an appeal! All he remembers as we continue to fight is Mrs. Elizabeth Franklin-Best! We will never forget the words and compassion along with hope she gave to us! There have never been a lawyer in our experience that is generally concerned about justice. I will recommended Mrs. Best every time to anyone.

Daniel has defended my state agency and its employees in a large number of cases. He represents the best qualities of a hard-nosed defense lawyer. His superior legal knowledge and research has obtained summary judgment and other favorable rulings in cases where I never thought we would prevail. In discovery, I say without qualification that he takes and defends depositions better than any attorney that I have had the pleasure to work with. As a case in point, he recently deposed an opposing expert witness for twelve hours because the expert was purposefully trying to be evasive in answering questions. This witness is a polished expert who is used to being able to lead opposing counsel around by the nose and avoiding giving any answer that would hurt his side of the case. Daniel is better than any other attorney I have watched at boxing in an expert and not allowing them to get around an issue with generalities. He has tried several cases for us and has obtained a good result in every one. He has the ability to completely eviscerate opposing witnesses without turning off the jury. Daniel has always kept me fully informed of all important developments in cases where he represents us. I have never had to call him for an update, as he has always been proactive in contacting me first. In short, when my agency is sued and we need the most knowledgeable and tenacious defense counsel in our arsenal, Daniel is one of my top choices.

In circumstances such as a complex family law case, it’s imperative to find the right attorney. If you are reading this right now, and you are searching for a family law attorney, you may be grappling with the most difficult situation of your life; I certainly was. When child protective services only partially did their job in my home state, and multiple law enforcement agencies failed us, I was left to fight in family court to protect my children from their perpetrator. With abuse occurring in multiple states, a complicated timeline, multiple investigations and murky jurisdiction, a lot of lawyers would have run away. Ms. Warner was undaunted by the challenge; she stayed the course, and prevailed. She truly cares about her clients. Because of Ms. Warner’s work, my children know they are safe and sound, the nightmares have stopped, and now they can thrive. Ms. Warner helped me protect the most important people in my world, and I will forever be thankful to her.

Dylan Glick was my attorney and he did an amazing job advocating for me against my auto insurance company after what I felt was an unfairly denied claim. This was not a huge case as the value of the car is around $10,000, but he fought for me like I was a $1MIL dollar client. He was able to obtain a settlement that I was happy with. Great communication, always returned my calls and emails promptly. Would definitely use again and would highly recommend.

Hi JAKE. On 11/07/2022 my son laid in a hospital with multiple severe broken bones . A friend gave me Jake’s number. It was late in the evening. I called the office & left a message. He called me back right away. During Christopher’s next few months we were in constant contact. I’m a paralegal & it has been my experience after working with multiple attorneys. You can leave message & they call whenever it’s convenient , the fact that he called me back ASAP I MADE THE Decision to hire him on the spot..during every single process jake was super delighted to hear. The his team was amzing and wonderful. This law office team was awesome at making this case seamless via modern software. ha he was wonderfull in keeping me and Chris informed. I did the same for almost 6 months 2-3 days a week I would send him progress notesThe case had quite of bit of hiccups due to the insurance for the car that hit him had minimum coverage. Jake faught for Chris to get him a settlement that would be fair for a broken pelvis, broken feamer and multiple contusions. Thank you so much for everything. Chris is doing great. It only took him 7 months to get back to work. He took his settlement got a place remotely in Greenville NC. His employer matched his settlement as a bonus. Gave him a raise offered him a better job and will pay 1/2,,They also paid for his moving expenses. The company matched his settlement & gave him a raise with a very commendable letter. Thanking him for his hard work & jumping back in. Chris is a welder, not an easy job. Chris now has a nice home & a new job with his loyal employer Did I mention that we have never been in his office and we have never met Jake Finkel in person.. stop looking cause you will miss out on working your case .. Thank you Jake. I’m a very proud & blessed mama. P.S. I know that Jake shorted himself of his monetary gain in order for Chris to get more money.

I had the unfortunate displeasure of dealing with this unsavory law office and specifically with Ryan McCabe. My issue was in connection with an HOA financial matter. McCabe was totally unpleasant and treated me like I was so far beneath him. I'm not surprised because in my opinion they are bottom feeder attorneys as the legal representation for local HOA's. I wouldn't give you a plug nickel for any of them. I'm sure they will respond with a disclaimer that they have no idea who I am, so they can deflect the truth. Anyone that's dealt with them knows exactly what I'm talking about. I don't recommend doing business here.

I was as well dealing with a very close loss and was in a hospice house for three months. I have called left messages and messages on their website, I also called the HOA company and they are saying they can’t call this Law Office to find out the disconnect or get someone. I’m very confused, disappointed and frustrated with this situation!! I have been sent to your office via HOA. I have tried to contact your office regarding so responding to say I am not a client shows how much research you’re willing to do. Response in 48hr is a joke I’ve left 3 messages and a reply on the contact us web part of your website.

What an Appeals Lawyer Can Do for You

An appeals lawyer specializes in representing clients in appellate courts, challenging or defending lower court decisions. If you believe that a legal error was made during your trial or that the court’s decision was unjust, an appeals lawyer can help you appeal the ruling to a higher court. They work to identify mistakes made during the trial, such as improper application of law, exclusion of key evidence, or jury misconduct. On the other hand, if you're defending a favorable judgment, an appeals lawyer can help protect the decision from being overturned.

Appeals lawyers don’t retry the case but instead focus on legal arguments and procedural issues to convince the appellate court to either overturn, modify, or uphold the lower court’s decision.

When Should I Hire an Appeals Lawyer?

Hiring an appeals lawyer is necessary when you are involved in a legal appeal, either as the appellant (the party appealing the case) or the appellee (the party defending the lower court’s ruling). Common situations in which you should hire an appeals lawyer include:

  • Appealing a conviction or ruling: If you’ve been convicted in a criminal case or lost a civil case and believe the decision was based on legal errors or improper procedures, an appeals lawyer can review the case and file an appeal on your behalf.
  • Challenging a sentence: In criminal cases, if you feel that the sentence is excessively harsh or not in line with legal standards, an appeals lawyer can work to reduce or modify the sentence.
  • Defending a lower court ruling: If the opposing party has filed an appeal to overturn a favorable ruling, an appeals lawyer can help defend the judgment and argue that the lower court’s decision should be upheld.
  • Complex legal issues: If your case involves complicated legal issues or interpretations of the law, an appeals lawyer can provide the necessary expertise to argue those points effectively before an appellate court.
  • Reviewing trial errors: Appeals lawyers can examine whether mistakes such as jury misconduct, improper exclusion or admission of evidence, or incorrect jury instructions occurred during the trial.

You should hire an appeals lawyer as soon as you decide to appeal or are informed that the other party is appealing the case, as appellate procedures are time-sensitive.

What Does an Appeals Lawyer Do?

An appeals lawyer provides specialized legal services to challenge or defend a lower court decision. Their role focuses on legal arguments, reviewing the trial record, and persuading the appellate court to either reverse or uphold the ruling. They can:

  • Review the trial record: Appeals lawyers meticulously review transcripts, evidence, and rulings from the original trial to identify any legal errors or procedural mistakes that could be grounds for appeal.
  • Prepare and file briefs: Appeals lawyers write legal briefs that present persuasive arguments to the appellate court. These briefs focus on the legal errors made during the trial and how they affected the outcome.
  • Present oral arguments: In many appeals, lawyers present oral arguments before a panel of judges, explaining why the lower court’s decision should be reversed or upheld based on legal principles.
  • Monitor case law developments: Appeals lawyers stay updated on changes in the law and precedents set by higher courts, which can be crucial in shaping the arguments they present during the appeal.
  • Provide legal advice on the likelihood of success: Appeals lawyers can offer a realistic assessment of your chances of winning the appeal based on the legal errors and evidence from the trial.

How Are Appeals Lawyers Paid?

Appeals lawyers typically charge for their services based on the complexity of the appeal and the amount of work required to prepare briefs and present arguments. Common payment structures include:

  • Hourly rate: Many appeals lawyers charge by the hour due to the significant amount of research, writing, and preparation involved in appeals. Hourly rates can range from $200 to $600 or more, depending on the lawyer’s experience and the case’s complexity.
  • Flat fee: For some straightforward appeals, a lawyer may charge a flat fee that covers all the work necessary to complete the appeal.
  • Retainer fee: In complex or high-stakes appeals, a lawyer may require a retainer, an upfront payment that covers the initial stages of the appeal. The lawyer then bills against this retainer for ongoing work.

It's important to discuss fees and costs upfront with your lawyer during the initial consultation to ensure you understand the financial commitment involved.

How Much Does an Appeals Lawyer Cost?

The cost of hiring an appeals lawyer varies depending on factors such as the complexity of the case, the lawyer’s experience, and the amount of work involved. General cost estimates include:

  • Straightforward appeals: For simpler appeals, such as those involving minor legal errors, fees can range from $5,000 to $15,000, depending on the scope of work.
  • Complex appeals: Appeals that involve complicated legal issues, multiple grounds for appeal, or high-stakes outcomes can cost anywhere from $20,000 to $100,000 or more, especially if the case requires extensive legal research, brief writing, and oral arguments.
  • Hourly rates: Many appeals lawyers charge hourly rates ranging from $200 to $600 per hour, with higher rates often associated with more experienced attorneys or particularly challenging cases.

Before proceeding with your appeal, it’s crucial to ask for a clear estimate of the costs involved so you can budget appropriately.

Top Questions to Ask an Appeals Lawyer

Before hiring an appeals lawyer, it’s essential to ask questions to ensure they are well-suited for your case and that you understand the appeals process. Important questions include:

  1. What experience do you have with appeals?
Ensure the lawyer has substantial experience handling appellate cases, particularly in the area of law relevant to your case (e.g., criminal, civil, family, etc.).
  2. How do you charge for appeals?
Ask whether the lawyer charges an hourly rate, a flat fee, or a retainer, and request an estimate of the total costs for handling your appeal.
  3. What is the likelihood of success for my appeal?
A good appeals lawyer should provide an honest assessment of your case’s strengths and weaknesses and the chances of winning the appeal.
  4. How long will the appeal process take?
Ask for an estimate of how long the appeal process might take, from filing the initial briefs to a final decision by the appellate court.
  5. Will you personally handle my appeal?
In larger law firms, junior attorneys or legal assistants may handle some of the research or drafting. Clarify who will be responsible for preparing and arguing your case.
  6. What is your approach to handling appeals?
Some lawyers may be more inclined to focus on procedural issues, while others emphasize broader legal arguments. Make sure the lawyer’s approach aligns with your goals.

How to Check the Credibility of an Appeals Lawyer

To ensure that you’re hiring a reputable appeals lawyer, take the following steps to verify their credentials and experience:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no history of disciplinary actions.
  • Look for appellate experience: Review the lawyer’s website or profile to ensure they specialize in appellate law and have successfully handled appeals similar to yours.
  • Check client reviews and testimonials: Look for client feedback on platforms like Avvo, Martindale-Hubbell, or Google to get insight into the lawyer’s track record and client satisfaction.
  • Ask for references: A credible lawyer should be willing to provide references from past clients who can speak to their expertise and success in handling appeals.
  • Look for recognition in appellate law: Membership in organizations like the American Academy of Appellate Lawyers (AAAL) or awards and recognition in appellate law can indicate a lawyer’s expertise in this specialized area.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with an appeals lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Trial transcripts and court records: The lawyer will need a complete record of the original trial, including transcripts, motions, exhibits, and the final judgment or order.
  • Legal briefs from the trial: If any briefs or motions were filed during the trial, bring copies so the appeals lawyer can review the legal arguments that were presented.
  • Written decision or verdict: Bring the court’s written ruling, verdict, or decision so the lawyer can identify any potential errors or issues to raise on appeal.
  • Questions about the appeal process: Write down any questions you have about the appeal’s timeline, costs, and potential outcomes.
  • List of potential legal errors: If you believe specific mistakes were made during the trial (e.g., improper evidence, legal misinterpretations), provide a list of those issues.

Being well-prepared for your consultation allows the lawyer to assess your case more effectively and provide the best guidance on how to proceed with your appeal.
