Could not be happier with Berry Law Firm. I kept getting denied claims or receiving percentages I felt weren’t right, and decided to use a law firm to help. The first couple of ones I tried wanted nothing to do with the cases and wouldn’t even listen to me about my disabilities as they weren’t interested in those types of cases. Berry Law firm accepted immediately, Taylor Wikum and Rosario were very communicative throughout the journey and prepared everything needed to help get me from 80% to 100% disability. Definitely worth it to use Berry Law and get the benefits you deserve without all the hassle.

They are very patient and understanding of my frustration with my process and the VA. I would recommend them to you especially if you are a Veteran.

Berry law Firm is great and so reliable. Prior to seeking assistance from the Berry Law Firm, I did ask help from a different source to get to the so called "finish line." It failed. This is why I am so grateful to Atty. Taylor Wikum and to Legal Assistant Rosario Torres, who were so adept and skillful in the successful upgrading of my disability claim from 70% to 100%. Both are so respectful, caring and patiently accommodating in our conversations, particularly in responding to all my concerns. They return my emails and telephone calls promptly. They made me feel a very important person. I am most certain to strongly recommend Berry Law Firm, Atty. Wikum and Legal Assistant Torres to those who need assistance to their VA clams!

Ryan made my bankruptcy process so easy. I was drowning in debt after after some life altering events. I didn't know where to start but knew I couldn't keep up with payments anymore. I scheduled a consultation and he walked me through the process of what would need to be done. I was in a really darkplace not knowing how to get out so thank you Ryan for everything and getting me this 2nd chance!

Ryan was incredibly helpful, kind and respectful throughout the entire bankruptcy process. He responded quickly to every query that I had and never made me feel like I was bothering him. It just goes to show that not all lawyers are blood sucking leeches; well at least I can say for certain Ryan Caldwell is not.

Ryan helped me with my bankruptcy case a few years ago and was so efficient and on top of everything. He made me feel comfortable through the process. To this day, if I need copies of anything, he responds quickly and sends them right away. He doesn’t put you off until later just because your case is over. I refer anyone considering bankruptcy to him.

I cannot speak highly enough of Jon Braaten. I contacted Jon needing representation from out-of-state. I do not live in Nebraska. Jon was extremely easy to get hold of and prompt. He heard me out and then clearly told me what his plan of action would be and what his anticipated outcome would be as well. Not only did Jon get me the outcome that I was looking for, to my surprise, he did all of this pro bono! I had searched online for an attorney and called several before discovering Jon. Jon came highly recommended online as well as by his peers! Jon is quick to action, highly organized, very knowledgeable, and has an amazing presence in the courtroom. I would highly recommend Jon for any legal needs you may have.

Ryan was so amazing to work with! I needed to move out of state due to my husbands work. Ryan and her team were with me every step of the way. My daughters father and I had to go to mediation first. Ryan knew we needed to strike while the iron was hot so she had all the paperwork ready to go for the mediator. The mediator was able to fix any differences so my daughters father could sign the paperwork right away at that appointment. Ryan and her team were quick to respond to emails. I felt supported, heard, and really enjoyed the entire process with her. If we had gone to court I know Ryan would have had my back and would have gone to battle for my daughter and I.

Dan and his team did an incredible job; Dan’s passion and commitment to us shown through in his time and dedication in educating us on our case as it evolved, he truly cares about his clients. Not only was Dan compassionate, but his knowledge and skill was second to none. Our case was one with complex medical issues and treatments; Dan's understanding of injuries, treatments, and medical terminology was impressive and leads me to believe he’s the best injury attorney that could’ve represented us.

***************** Buyer BEWARE!!*********** 1. This firm is a FATHER'S RIGHTS Firm ( I would have never gone there as a Mom had I known this -- nor is it disclosed anywhere. It became obvious over time, in her multiple failures to protect me) 2. Please notice that there are **very few positive** reviews for Steffanie Kotick on this page; this clearly conveys a message to the client. 3. Positive reviews are over 5 years old. It has been a long time since this attorney performed well for her clients. 3. These failures were: failed to show up at mutliple hearings gravely harming my case, NO showed at a Protection order hearing, blew off off an Intervenor hearing leaving me completely exposed! It wasn't calendared, her receptionist couldn't even find her. While we waited for her to show up, opposing counsel said he had reached out to her and NEVER heard from her. This cost me $12K!!!, plus my legal fees, lost income, an entire business, almost all its assets!!! She blew off at least three (3) hearing dates!, Made commitments for various actions that she failed to follow through on, failed to file a balance sheet and parenting plan for trial, at a contempt hearing: literally failed to present any of my evidence or ask me any questions from the narrative/affidavit provided and I was found guilty on counts where I was largely innocent and had multiple defense. I was lilterally thrown under the bus. I recall when the hearing ended, that sick in the pit of my stomach feeling. This was extremly negligent on her part she left me totally exposed, vulnerable and UNDEFENDED. 4. She reassured me she'd complete trial, then WITHDREW on the LAST DAY OF TRIAL, after a private conversation with Matt Catlett and Judge Post leaving me without a DEFENSE and scrambling to put together a 2.8 year old case in 8 weeks Pro Se. I lost everything as a result of it. The grave material harms are so severe as to be utterly debilitating and castastrophic . 5. "NE SHARED PARENTING FOUNDATION" recommended her -- as they supposedly help with hardship cases. No. BUYER BEWARE for NE SHARED PARENTING FOUNDATION. It appears that this entity works as a Father's Rights program as well. 6. Extremely poor communicator -- I had a crisis with assets and an email and call trail of a few months and she REFUSED and FAILED to address the issue before it came to a head -- then thousands of dollars of assets were lost. She RARELY communicated, unless I scheduled a sit down meeting where she'd make all sorts of promises to be more assertive and never did: she was given entire packets of affidavit/documents for opposing party's failure to pay medical bills, failure to fulfill complete and throuough discoveries, failure to complete a 2nd level parenting course, extreme amounts of failures to exercise parenting time...and she did NOTHING about any of it! 7. She left me defenseless, unprotected..and absolutely, unjustly destroyed my credibilty with the Judge. 8. She failed to coordinate, keep apprised and communicate with an expert witness. 9.She did nothing when the Judge failed to follow Statutes requring an ex parte PO or a hearing, I was denied both, and it was immediately dismissed - after there was a history of one being Ordered. 10. I produced all of my updated discoveries to her and she failed to produce them to the opposing counsel! This recklessly exposed me to the risk for contempt.

I had the privilege of working with Steffanie Kotik on a complex family law case, and I can’t recommend her enough. From the very start, she demonstrated a deep understanding of family law and offered strategic yet compassionate guidance that made a huge difference throughout the process. Steffanie wasn’t just thorough and diligent—she truly cared about my well-being and that of my family. What really stood out was her clear and consistent communication. She kept me updated regularly and was always available to answer any questions, no matter how small. This made a challenging time feel much more manageable. Steffanie’s ability to handle the complexities of my case with both professionalism and empathy played a big part in my case progression. Steffanie’s thoughtful and straightforward approach made sure I felt informed and prepared every step of the way. Her combination of empathy, directness, and tactical expertise is rare, and I’m incredibly grateful for her support. If you're looking for a lawyer who is not only highly competent but also genuinely cares about her clients, Steffanie Kotik is the one to call. I'm deeply grateful for her help and highly recommend her services.

Linsey camplin stole mine. The entire office assisted her with her THEFT from a DISABLED PERSON. Google "Derek Olson Porsche" I'm first result. F this place. Everyone knows the word I'm abriviating. Best of luck with your own trials! DONT LIE. DONT CHEAT. DONT STEAL. I'm out. BE CAREFUL! DEUCES!

This is the best firm ever, I would have lost my girls if I had kept my previous lawyer. She actually signed my girls away to my ex without my knowledge. With Justin cook and his law firm and the lawyers that work in his firm they helped me have a fighting chance in getting my girls back. I have nothing negative to say about them and never will. If you need a lawyer or looking for a firm who is honest and knows how to work hard. A firm who will give you what you’re paying for please hire them. You won’t regret it!!! Everyone in this company is hard working honest and professional.

Well, seeing how I just got out of prison, I'm kind of biased. Somehow I ended up getting more time than the statutes even allowed. 🙃 I was talked into telling on other people for, get this, what ended up being an increase in my sentence, not a reduction 🤔🤔 I hope I don't have to go through this 'justice system again

Doesn't follow through with cases. Horrible communication. Doesn't return emails, phone calls, nothing. When I actually got her to file the claim she just put an amount without asking me what I wanted first and then when there was no response from that she didn't follow through with the next step and now I'm having the same problems with the same entity I was before. Had she followed through with the first case I feel I wouldn't still be having issues with an entity I cannot avoid. If you want anything done this is not the firm you want.

One of the lawyers never returns phone calls and if she does it's a week later. Doesn't give chances to redeem. They are joined at the hip and the owner is the boss but the associate thinks she is.

What an Appeals Lawyer Can Do for You

An appeals lawyer specializes in representing clients in appellate courts, challenging or defending lower court decisions. If you believe that a legal error was made during your trial or that the court’s decision was unjust, an appeals lawyer can help you appeal the ruling to a higher court. They work to identify mistakes made during the trial, such as improper application of law, exclusion of key evidence, or jury misconduct. On the other hand, if you're defending a favorable judgment, an appeals lawyer can help protect the decision from being overturned.

Appeals lawyers don’t retry the case but instead focus on legal arguments and procedural issues to convince the appellate court to either overturn, modify, or uphold the lower court’s decision.

When Should I Hire an Appeals Lawyer?

Hiring an appeals lawyer is necessary when you are involved in a legal appeal, either as the appellant (the party appealing the case) or the appellee (the party defending the lower court’s ruling). Common situations in which you should hire an appeals lawyer include:

  • Appealing a conviction or ruling: If you’ve been convicted in a criminal case or lost a civil case and believe the decision was based on legal errors or improper procedures, an appeals lawyer can review the case and file an appeal on your behalf.
  • Challenging a sentence: In criminal cases, if you feel that the sentence is excessively harsh or not in line with legal standards, an appeals lawyer can work to reduce or modify the sentence.
  • Defending a lower court ruling: If the opposing party has filed an appeal to overturn a favorable ruling, an appeals lawyer can help defend the judgment and argue that the lower court’s decision should be upheld.
  • Complex legal issues: If your case involves complicated legal issues or interpretations of the law, an appeals lawyer can provide the necessary expertise to argue those points effectively before an appellate court.
  • Reviewing trial errors: Appeals lawyers can examine whether mistakes such as jury misconduct, improper exclusion or admission of evidence, or incorrect jury instructions occurred during the trial.

You should hire an appeals lawyer as soon as you decide to appeal or are informed that the other party is appealing the case, as appellate procedures are time-sensitive.

What Does an Appeals Lawyer Do?

An appeals lawyer provides specialized legal services to challenge or defend a lower court decision. Their role focuses on legal arguments, reviewing the trial record, and persuading the appellate court to either reverse or uphold the ruling. They can:

  • Review the trial record: Appeals lawyers meticulously review transcripts, evidence, and rulings from the original trial to identify any legal errors or procedural mistakes that could be grounds for appeal.
  • Prepare and file briefs: Appeals lawyers write legal briefs that present persuasive arguments to the appellate court. These briefs focus on the legal errors made during the trial and how they affected the outcome.
  • Present oral arguments: In many appeals, lawyers present oral arguments before a panel of judges, explaining why the lower court’s decision should be reversed or upheld based on legal principles.
  • Monitor case law developments: Appeals lawyers stay updated on changes in the law and precedents set by higher courts, which can be crucial in shaping the arguments they present during the appeal.
  • Provide legal advice on the likelihood of success: Appeals lawyers can offer a realistic assessment of your chances of winning the appeal based on the legal errors and evidence from the trial.

How Are Appeals Lawyers Paid?

Appeals lawyers typically charge for their services based on the complexity of the appeal and the amount of work required to prepare briefs and present arguments. Common payment structures include:

  • Hourly rate: Many appeals lawyers charge by the hour due to the significant amount of research, writing, and preparation involved in appeals. Hourly rates can range from $200 to $600 or more, depending on the lawyer’s experience and the case’s complexity.
  • Flat fee: For some straightforward appeals, a lawyer may charge a flat fee that covers all the work necessary to complete the appeal.
  • Retainer fee: In complex or high-stakes appeals, a lawyer may require a retainer, an upfront payment that covers the initial stages of the appeal. The lawyer then bills against this retainer for ongoing work.

It's important to discuss fees and costs upfront with your lawyer during the initial consultation to ensure you understand the financial commitment involved.

How Much Does an Appeals Lawyer Cost?

The cost of hiring an appeals lawyer varies depending on factors such as the complexity of the case, the lawyer’s experience, and the amount of work involved. General cost estimates include:

  • Straightforward appeals: For simpler appeals, such as those involving minor legal errors, fees can range from $5,000 to $15,000, depending on the scope of work.
  • Complex appeals: Appeals that involve complicated legal issues, multiple grounds for appeal, or high-stakes outcomes can cost anywhere from $20,000 to $100,000 or more, especially if the case requires extensive legal research, brief writing, and oral arguments.
  • Hourly rates: Many appeals lawyers charge hourly rates ranging from $200 to $600 per hour, with higher rates often associated with more experienced attorneys or particularly challenging cases.

Before proceeding with your appeal, it’s crucial to ask for a clear estimate of the costs involved so you can budget appropriately.

Top Questions to Ask an Appeals Lawyer

Before hiring an appeals lawyer, it’s essential to ask questions to ensure they are well-suited for your case and that you understand the appeals process. Important questions include:

  1. What experience do you have with appeals?
Ensure the lawyer has substantial experience handling appellate cases, particularly in the area of law relevant to your case (e.g., criminal, civil, family, etc.).
  2. How do you charge for appeals?
Ask whether the lawyer charges an hourly rate, a flat fee, or a retainer, and request an estimate of the total costs for handling your appeal.
  3. What is the likelihood of success for my appeal?
A good appeals lawyer should provide an honest assessment of your case’s strengths and weaknesses and the chances of winning the appeal.
  4. How long will the appeal process take?
Ask for an estimate of how long the appeal process might take, from filing the initial briefs to a final decision by the appellate court.
  5. Will you personally handle my appeal?
In larger law firms, junior attorneys or legal assistants may handle some of the research or drafting. Clarify who will be responsible for preparing and arguing your case.
  6. What is your approach to handling appeals?
Some lawyers may be more inclined to focus on procedural issues, while others emphasize broader legal arguments. Make sure the lawyer’s approach aligns with your goals.

How to Check the Credibility of an Appeals Lawyer

To ensure that you’re hiring a reputable appeals lawyer, take the following steps to verify their credentials and experience:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no history of disciplinary actions.
  • Look for appellate experience: Review the lawyer’s website or profile to ensure they specialize in appellate law and have successfully handled appeals similar to yours.
  • Check client reviews and testimonials: Look for client feedback on platforms like Avvo, Martindale-Hubbell, or Google to get insight into the lawyer’s track record and client satisfaction.
  • Ask for references: A credible lawyer should be willing to provide references from past clients who can speak to their expertise and success in handling appeals.
  • Look for recognition in appellate law: Membership in organizations like the American Academy of Appellate Lawyers (AAAL) or awards and recognition in appellate law can indicate a lawyer’s expertise in this specialized area.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with an appeals lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Trial transcripts and court records: The lawyer will need a complete record of the original trial, including transcripts, motions, exhibits, and the final judgment or order.
  • Legal briefs from the trial: If any briefs or motions were filed during the trial, bring copies so the appeals lawyer can review the legal arguments that were presented.
  • Written decision or verdict: Bring the court’s written ruling, verdict, or decision so the lawyer can identify any potential errors or issues to raise on appeal.
  • Questions about the appeal process: Write down any questions you have about the appeal’s timeline, costs, and potential outcomes.
  • List of potential legal errors: If you believe specific mistakes were made during the trial (e.g., improper evidence, legal misinterpretations), provide a list of those issues.

Being well-prepared for your consultation allows the lawyer to assess your case more effectively and provide the best guidance on how to proceed with your appeal.
