Michael's appeal saved my medical malpractice case by winning the main claim in my case. Thank you, Michael ! Michael's expertise and commitment made this happen. Michael has been supportive and always available through this process. He is trustworthy, altruistic, and down to earth. I must add Michael's lack of greed and willingness to work with his clients on the financial part of the appeal was another reason it was possible for me to go forward with the appeal. After having a malpractice attorney with 40 years of experience that was able to significantly hurt my case was devastating to me. No one should have to go through that. Michael was able to put the pieces of my case together and convince the Appellate Court that the lower court erred on a decision, which really hurt my case. If I didn't have Michael to do my appeal, I'm not sure where I would be today in terms of my case. I can now proceed with confidence that my case will be settled or won. Michael is the best ! He's in it to win it. I can't say it enough times, I am so grateful and thankful for Michael and his firm. Don't settle for less than the best.

I was at a point in a medical malpractice case where a judgment summary left me deciding, do I go forward with an appeal or not. The original attorney who represented me no longer wanted to remain on my case. I knew my case had merit to it, so I decided to pursue an Appeals Attorney. I called Hegge and Confusione and spoke to Michael Confusione. I immediately had a good feeling about him. He listened to me, he was non-judgmental, and spoke to me in a down to earth manner. My appeal was done by the time promised and I couldn't believe how accurate it was. It tells the story of my case exactly how it happened. I felt Michael understood my case better than my original attorney. His effort in doing my appeal shines through and through. I can't express enough how happy I am that I found Michael to do my appeal for me. I don't believe anyone could have done a better job. Thank you Michael !

Throughout our relationship, Drew Molotsky made every effort to reach a fair and equitable settlement of my divorce through mediation, rather than settle the issue in court. However, my former spouse rejected every offer ultimately leading to a trial. On the morning of the trial, at the direction of the judge, one final attempt was made to reach a settlement. At Drew’s suggestion, I agreed to a more generous offer than those previously made, to avoid the cost of a trial. That offer was rejected and the trial began that afternoon. In the court room, Drew controlled the tone and direction of the testimony. His detailed presentation included 21 detailed exhibits in support of my financial interests. As a result, the judge ruled that my former spouse would receive considerably less than she would have, had she accepted my final offer. The ruling led to precisely the equitable outcome I hoped to achieve from the outset. Drew’s dedication to the law, his work ethic, his genuine concern for me as a client, were evident to me throughout our relationship. If an equitable financial settlement is your first priority arrange a consultation with Drew.

Anyone who has gone through a divorce knows how critical it is to have a top-notch attorney. When it comes to issues like custody, child support, and a fair settlement, the attorney you choose makes all the difference in the outcome of these negotiations. I am so grateful to have had Drew Molotsky represent me throughout my entire proceeding. Drew's attention to every detail, the time he took to address all of the issues, and his vast knowledge and experience in family law all played a huge role in extremely positive outcomes for me and my family. Drew was always available to me, talking me through some very rough spots, and giving me the confidence I needed through his constant support and legal know-how. His calm and professional demeanor went a very long way in all of our interactions, and he was able to address every single issue (many of which were extremely complicated) with absolute legal acumen and clarity. Both in and out of the courtroom, Drew is the consummate professional, always displaying incredible integrity and a passion to fight for clients like me. My case was a very complicated one. My ex-husband was trying to take my children from me based on the fact that I left a fundamentalist religious lifestyle and my coming out as a gay woman. Most women in my situation do not fare very well, particularly women from the community in which I lived. Drew was able to guide me through some very precarious legal situations and give me the right advice at every turn. Not only did he have to deal with the issues of custody and child support, but he also had to navigate through a very complicated situation that pitted an entire community against me and my children. Drew always talked through every issue with me and addressed each one with such skill and clarity. Through it all, he always showed tremendous integrity and compassion. He was so much more than my lawyer. He became a true advocate for me and my children, pouring his heart and soul into every single aspect of my case. Because of Drew, my family was able to start an entirely new life. I was able to live the life I always wanted, my children were able to go to the schools they wanted, and they are now doing great in college. Because of Drew, we gained our freedom, and we will always be grateful to him.

Drew Molotsky came highly referred to me, and for good reason! He has been doing what he does for nearly 3 decades now - and it shows! Drew took my case when no one else would even touch it. My case was in very bad shape. Everything was stacked up against me no matter what I did to comply and sort things out. (This was a dcpp matter in which they had actually managed to wrongfully remove my children from me a couple of months before I found this amazing attorney.) Dcpp was doing a very good job at twisting things and making me look really bad on paper. They were actually requesting a competency evaluation be done on me. (Look that up if you don’t know what I am talking about … scary stuff.) The judge seemed to be moving toward that end. Drew came in and listened to everything I had to tell him. I did my best to not overwhelm him and he was very patient with me. He obtained all of my records. He reviewed everything. He came to me on an extremely real yet professional level and let me know what it really looked like from the outside looking in. He told me what he could (and could not) do. He let me know what was realistic and advised me on when and how to move. He let me know that I needed to listen to him and take things for what they were and work it to turn in my favor. I did the work necessary for my case to go well but Drew definitely advised me and truly did what any good attorney would. He listened to me about my progress, concerns, and what I really wanted to get out of each hearing. Sometimes he told me some of the things I wanted were unlikely but that he would try to throw things in if he had the chance. I trusted his wisdom as my attorney. I sat back, didn’t speak out, and let him talk for me. He managed on so many occasions to get that 1 or 2 more things that I wanted “thrown in there,” so to speak. He truly paid attention to my case … and, boy, can he express what you can be so frustrated trying to explain while you endure reliving the painful details! He listened attentively to years of complicated backstory and actually understood and retained the information I gave. He literally consolidated it into a perfectly delivered 1 paragraph worth of verbal dialogue! This man is gifted and amazing! To top it all off, when he finally had the chance to speak on my behalf, he did so in such a bold and respectful manner. He truly got the needed attention and put the people disparaging me into their proper place. He advocated for me as though I was a close friend of many years or even his own family member. He gave the judge a clear perspective on who I was as I did the work and my reports, also, spoke for themselves. Talk about results?!! - I got back all 3 of the children that were taken from me. My case with dcpp is now completely closed. The judge quickly ditched the idea of evaluating me to assess my competence. Family matters are nothing to take lightly. They are unique, painful, and complicated. The pain turns into anger and it can show. Sometimes we just mess things up by opening our own mouths. My advice to you would be to just let Drew do the work that others cannot effectively deliver for you. If you go elsewhere you surely gamble with the most precious thing you have on this side of heaven. Family is everything. Best wishes!

What an Appeals Lawyer Can Do for You

An appeals lawyer specializes in representing clients in appellate courts, challenging or defending lower court decisions. If you believe that a legal error was made during your trial or that the court’s decision was unjust, an appeals lawyer can help you appeal the ruling to a higher court. They work to identify mistakes made during the trial, such as improper application of law, exclusion of key evidence, or jury misconduct. On the other hand, if you're defending a favorable judgment, an appeals lawyer can help protect the decision from being overturned.

Appeals lawyers don’t retry the case but instead focus on legal arguments and procedural issues to convince the appellate court to either overturn, modify, or uphold the lower court’s decision.

When Should I Hire an Appeals Lawyer?

Hiring an appeals lawyer is necessary when you are involved in a legal appeal, either as the appellant (the party appealing the case) or the appellee (the party defending the lower court’s ruling). Common situations in which you should hire an appeals lawyer include:

  • Appealing a conviction or ruling: If you’ve been convicted in a criminal case or lost a civil case and believe the decision was based on legal errors or improper procedures, an appeals lawyer can review the case and file an appeal on your behalf.
  • Challenging a sentence: In criminal cases, if you feel that the sentence is excessively harsh or not in line with legal standards, an appeals lawyer can work to reduce or modify the sentence.
  • Defending a lower court ruling: If the opposing party has filed an appeal to overturn a favorable ruling, an appeals lawyer can help defend the judgment and argue that the lower court’s decision should be upheld.
  • Complex legal issues: If your case involves complicated legal issues or interpretations of the law, an appeals lawyer can provide the necessary expertise to argue those points effectively before an appellate court.
  • Reviewing trial errors: Appeals lawyers can examine whether mistakes such as jury misconduct, improper exclusion or admission of evidence, or incorrect jury instructions occurred during the trial.

You should hire an appeals lawyer as soon as you decide to appeal or are informed that the other party is appealing the case, as appellate procedures are time-sensitive.

What Does an Appeals Lawyer Do?

An appeals lawyer provides specialized legal services to challenge or defend a lower court decision. Their role focuses on legal arguments, reviewing the trial record, and persuading the appellate court to either reverse or uphold the ruling. They can:

  • Review the trial record: Appeals lawyers meticulously review transcripts, evidence, and rulings from the original trial to identify any legal errors or procedural mistakes that could be grounds for appeal.
  • Prepare and file briefs: Appeals lawyers write legal briefs that present persuasive arguments to the appellate court. These briefs focus on the legal errors made during the trial and how they affected the outcome.
  • Present oral arguments: In many appeals, lawyers present oral arguments before a panel of judges, explaining why the lower court’s decision should be reversed or upheld based on legal principles.
  • Monitor case law developments: Appeals lawyers stay updated on changes in the law and precedents set by higher courts, which can be crucial in shaping the arguments they present during the appeal.
  • Provide legal advice on the likelihood of success: Appeals lawyers can offer a realistic assessment of your chances of winning the appeal based on the legal errors and evidence from the trial.

How Are Appeals Lawyers Paid?

Appeals lawyers typically charge for their services based on the complexity of the appeal and the amount of work required to prepare briefs and present arguments. Common payment structures include:

  • Hourly rate: Many appeals lawyers charge by the hour due to the significant amount of research, writing, and preparation involved in appeals. Hourly rates can range from $200 to $600 or more, depending on the lawyer’s experience and the case’s complexity.
  • Flat fee: For some straightforward appeals, a lawyer may charge a flat fee that covers all the work necessary to complete the appeal.
  • Retainer fee: In complex or high-stakes appeals, a lawyer may require a retainer, an upfront payment that covers the initial stages of the appeal. The lawyer then bills against this retainer for ongoing work.

It's important to discuss fees and costs upfront with your lawyer during the initial consultation to ensure you understand the financial commitment involved.

How Much Does an Appeals Lawyer Cost?

The cost of hiring an appeals lawyer varies depending on factors such as the complexity of the case, the lawyer’s experience, and the amount of work involved. General cost estimates include:

  • Straightforward appeals: For simpler appeals, such as those involving minor legal errors, fees can range from $5,000 to $15,000, depending on the scope of work.
  • Complex appeals: Appeals that involve complicated legal issues, multiple grounds for appeal, or high-stakes outcomes can cost anywhere from $20,000 to $100,000 or more, especially if the case requires extensive legal research, brief writing, and oral arguments.
  • Hourly rates: Many appeals lawyers charge hourly rates ranging from $200 to $600 per hour, with higher rates often associated with more experienced attorneys or particularly challenging cases.

Before proceeding with your appeal, it’s crucial to ask for a clear estimate of the costs involved so you can budget appropriately.

Top Questions to Ask an Appeals Lawyer

Before hiring an appeals lawyer, it’s essential to ask questions to ensure they are well-suited for your case and that you understand the appeals process. Important questions include:

  1. What experience do you have with appeals?
Ensure the lawyer has substantial experience handling appellate cases, particularly in the area of law relevant to your case (e.g., criminal, civil, family, etc.).
  2. How do you charge for appeals?
Ask whether the lawyer charges an hourly rate, a flat fee, or a retainer, and request an estimate of the total costs for handling your appeal.
  3. What is the likelihood of success for my appeal?
A good appeals lawyer should provide an honest assessment of your case’s strengths and weaknesses and the chances of winning the appeal.
  4. How long will the appeal process take?
Ask for an estimate of how long the appeal process might take, from filing the initial briefs to a final decision by the appellate court.
  5. Will you personally handle my appeal?
In larger law firms, junior attorneys or legal assistants may handle some of the research or drafting. Clarify who will be responsible for preparing and arguing your case.
  6. What is your approach to handling appeals?
Some lawyers may be more inclined to focus on procedural issues, while others emphasize broader legal arguments. Make sure the lawyer’s approach aligns with your goals.

How to Check the Credibility of an Appeals Lawyer

To ensure that you’re hiring a reputable appeals lawyer, take the following steps to verify their credentials and experience:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no history of disciplinary actions.
  • Look for appellate experience: Review the lawyer’s website or profile to ensure they specialize in appellate law and have successfully handled appeals similar to yours.
  • Check client reviews and testimonials: Look for client feedback on platforms like Avvo, Martindale-Hubbell, or Google to get insight into the lawyer’s track record and client satisfaction.
  • Ask for references: A credible lawyer should be willing to provide references from past clients who can speak to their expertise and success in handling appeals.
  • Look for recognition in appellate law: Membership in organizations like the American Academy of Appellate Lawyers (AAAL) or awards and recognition in appellate law can indicate a lawyer’s expertise in this specialized area.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with an appeals lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Trial transcripts and court records: The lawyer will need a complete record of the original trial, including transcripts, motions, exhibits, and the final judgment or order.
  • Legal briefs from the trial: If any briefs or motions were filed during the trial, bring copies so the appeals lawyer can review the legal arguments that were presented.
  • Written decision or verdict: Bring the court’s written ruling, verdict, or decision so the lawyer can identify any potential errors or issues to raise on appeal.
  • Questions about the appeal process: Write down any questions you have about the appeal’s timeline, costs, and potential outcomes.
  • List of potential legal errors: If you believe specific mistakes were made during the trial (e.g., improper evidence, legal misinterpretations), provide a list of those issues.

Being well-prepared for your consultation allows the lawyer to assess your case more effectively and provide the best guidance on how to proceed with your appeal.
