When I hired Tim I was looking a serious charges. He did everything to make sure I understood what was going on with my case at all times and when had any questions or concerns I never had a problem getting ahold of Tim. After a very long year we Ultimately went to trial where Tim was amazing and fought for me to be found not guilty on all charges. Without a doubt the best choice I could have made and I will never forget what he did for me.....THANK YOU TIM!!!

I appreciate the passion, patience, and prompt attention my particular case received. My attorney, Thomas Jarrard was outstanding; he really showed full dedication towards getting me a quick and positive outcome on my case. He provided me with a sense of confidence after the Global law firm I previously worked at assigned a Partner in an attempt to deny me of my rights under USERRA. Thomas Jerrard is extremely knowledgeable, and reached a resolution, after a single phone call to said Partner at old firm, which ended in my favor and without needing to endure a trial. I would recommend anyone to this law firm and trust Mr. Jerrard and his team can handle any case or situation with total satisfaction.

If you are in the military/veteran having employment issues related to your service aka USERRA law violations then look no further—Thomas is the lawyer for you. Thomas is in a league of his own. He is talented, hardworking and an exceptional lawyer. He is extremely knowledgeable, candid, and efficient in his work. Thomas is an expert in USERRA laws, and get results quickly. Thomas immediately provided me with relief that I would receive a just outcome in my case; and outlined all the issues/case laws and claims they would proceed on. I already knew after my first ZOOM call interaction with him that I had secured a winning team. Thomas wins his cases, because he knows what he’s doing, and how to get it done. Thomas was responsive and throughout while handling my case. I am grateful for the times I would call him, and he could sense the urgency and anxiousness in my tone; and would immediately start sending out emails to get answers to my questions. Thomas gave me the confidence I needed that my case would be in good hands as I left for active duty orders — and he exceeded those expectations. Thanks to Thomas I was able to get a resolution beyond my wildest imagination before even returning home! I am forever grateful and indebted to Thomas for his help. This isn’t Allstate, but you’re definitely in good hands with Thomas. Thank you Thomas not only for your service to this country, but your continued service in representing military service members. You are appreciated.

We have retained Mr. Kerley in several cases. In each case, he was able to pinpoint the exact issues and focus on developing a well planned strategy. Mr. Kerley's ability to hone in on the actual matter before the court, his thoughtful strategies and thorough research led to our prevailing in each case. Mr. Kerley's presence and demeanor at trial was firm and deliberate, appropriate for each audience. I have relied on Mr. Kerley's representation since the early 90's. Back then it was for defending large commercial companies in litigation including general liability, auto liability and medical malpractice. Currently Mr. Kerley is retained for defending municipalities primarily in general liability litigation. He is very responsive and well liked among our multiple members who have been represented by him. His knowledge and application of the law is exceptional; and he has the ability to effectively explain the impact of the law to given situations. He has displayed an impressive track record in settling cases when appropriate through negotiations or mediation; and a high rate of success at trial. He is professional, trustworthy and has produced exceptional results.

Why Nick Pontarolo should represent you if you have been injured on the job! Read this Post to the end and you will clearly see why you need Nick and this Firm! I'm 65 years old and have worked hard Construction Labor for most of my life until I injured my shoulder at the end of 2018. That is when I opened my first "Workers Comp Claim" and after many Exams, Tests and Scans, an Orthopedic Surgeon told me that I had "Stage 4 Osteoarthritis" on top of other serious complications that would have caused me to need a Shoulder Replacement in the very near future, especially if I kept working at my trade. I did not seek any legal counsel at the time and had to go back to work "light duty" in spite of my ongoing condition. I then was immediately reinjured after being taken off of "light duty" in middle of 2019! I saw the "Company's Preferred Doctor" that wouldn't even prescribe pain medication, despite the obvious pain I was in. I decided to call a good friend of mine that is an Employment Attorney in Portland to ask his advice. He told me that he would find me good Attorney in Spokane and through his research he gave me a short list and Nick Pontarolo's name was right on top. I called Nick and he took immediate action and control as he represented and guided me through a maze of "BUREAUCRATIC RED TAPE" involving Doctors, Employers, Attorneys, Therapists, Vocational Rehabilitation Councilors and even more. Because of Nick's connections, I have had one of the premier Shoulder Surgeons in the Country replace my shoulder and some of the best rehabilitation experts throughout the region working with me as well. While all this was going on, I never missed a "Time Loss' compensation check for 4+ years. I'm now retired, and my claim just closed and without Nick's professional representation and expertise for these last 4+ years, I truly believe that I would have lost everything I've ever worked for my entire life. Nick, You treated me like family and did an incredible job and for that I am forever grateful... Patrick PS- Also, I want to thank all the Attorney's and Office Staff for the combined team effort and supporting rolls you all played for my well-being and all while I was enjoying the view from the 12th floor of the Chase Bank Building Downtown Spokane.

My husband was heavily medicated as he was under hospice care for stage 4 cancer. I was medicated due to depression. Mr Curran was recommended to us by Spokane Hospice as someone who would come to our house to update my husband's will. I do not believe Mr Curran did his best work for us. My husband was very distraught and agitated, I did my best not to upset him anymore than necessary, and signed off on his will. Unfortunately, even though he asked if I understood what I was signing off on, I still signed, walked away crying and let the witnesses finish up with the lawyer. I understood that the will said everything was going to his children, but I also assumed I could contest the will, as signing was an act of kindness to a dying man, who repeatedly told me not to worry, that I was being taken care of. When Mr Curran left our home, he took my phone with him. It was three days of me looking before he called to say he had it. When my husband passed away his sisters were the executors of the estate. Imagine my suprise when 5 weeks after his passing, after living in this house for 10 years, I was served with an eviction notice... 3 days to get out, served on me by his sister and written up by none other than Mr Curran. Was he my husband's lawyer or his sister's lawyer? I felt there was some conflict of interest... probably wrong on that point, but still I don't think he took in my husband's mental state, or mine, into consideration. He most certainly did not consider what happened to me afterwards, and Oh My Gosh. He took my phone.

Accusations of racism should, for the most part, be taken seriously. However, far too often the race card is pulled by folks who either shed responsibility for their own actions or subscribe to the thought of always being a victim. I do not know the person who posted the racism post about Pat and the only judgment I can make is based on my experience. I am an African American man, and Pat represented me in a year long case and treated my family and me great. Dawn tolerated my numeroius emails and phone calls (usuahly 3 or 4 a day). She showed tremendouse patience and alwas showed compassion as I navigated the process. The things described in the previous post is FAR from the experience I had with Pat and Dawn. I have referred several people, and I will always use him in the future. Unfortunatly, the internet allows anyone to post anything about anybody- without the burden of providing proof of his or her accusations. Patt Fannin and Dawn White handled my case perfectly and provided nothing but great service to my family and this African American man- I love the way I was treated. THANK YOU PAT AND DAWN!

This Lawyer had my case for over a year then dumped my case... But that's not the worst part .. the insurance company made a offer to settle and he never discussed this with me.. I only found out thru his paralegal that they wanted to settle... I had to get new lawyer and settle the case 10 months later for only a fraction of what the original settlement offer was.... Thanks Pat you really screwed me..... Also if your a minority stay away from this lawyer.....He plays the have and have nots game on what he feels you deserve.... He will catch and kill your case .. David Gardner was the trustee on my Chapter 7 Bankruptcy. He failed to check out my creditors. He did NOT sell my home for the price listed on the Purchase and Sale Agreement wherein he sold it $25,000.00 under the purchase price as recorded on the Real Estate Purchase & Sale Contract. He overpaid the Mortgage Company after I repeatedly informed him that the pay-off amount was $20,000 plus over what I actually owed! David's mission to sell my home gave him a huge pay-off! Carl Hueber is either a legal super genius, or extremely lucky. He filed a losing appeal that made it possible to fix a losing PRP to get my conviction overturned. What!? Yeah. I'll explain that later, but first... Hueber first represented me at resentencing. He shook the prosecutor's hand before it began, after which I felt hiring him was a huge mistake: the handshake didn't look like the one you see before a fight. Hueber wasn't all that impressive in the courtroom, and his motions all failed(two different things, but related). However, he was a good salesman, and suckered me into getting him a bunch of money to file an appeal. Here's where the lucky or super genius comes in. The PRP filed by another attorney had omissions(at my request because I am a moron) that, by technicality, would/may have caused it to lose unless it were appended. By filing the appeal he kept the sentence from becoming final. This prevented the case from being time barred from collateral attack. This allowed the PRP to be appended. This got my conviction overturned... After a decade. Hueber also represented me at a bond hearing. Backstory: Before trial I was out on my own recognizance(OR). I paid $0 bail. It was just my promise to show up to court. After trial, I filed a motion for an appeal bond, which was granted. My sentence was 9 years to life, I did 10 years, and had my conviction was overturned(retrial ordered). I never missed a single day of court, have no criminal record at all, and my behavior was exemplary. With no conviction, my sentence basically done, being out on OR the first trial, no failure to appears, no priors, nothing... the bail amount he procured was six figures, and not much lower than when I had just a couple months into that 11 to life sentence. Yes, it was 11 and then turned into 9, but that's another story. I don't know if my review was that helpful, or if Hueber was all that helpful. He's either lucky, or a super genius. That makes him either a bad attorney, or a bad-ass attorney. These are just the facts. Basis for the rating. THE APPEAL: Six stars or No stars. RE-SENTENCING AND BOND: The rest of his representation was as disappointing as the average attorney, so three stars. Weighing it all in, and the importance of each - the average is 3 stars with a deviation of 2 stars. That means he should have 1 star or 5 stars and this review was pointless.

In 2009 I was in a mva accident with a corporate company. ( fyi Police report stated I was 100 percent not at fault) I thought hiring Scott cifrese was a good idea because he knew the corporate law world. I was sadly mistaken only after the settlement was finalized. First off Scott was extremely hard to get ahold of and rarely returned phone calls from me in a timely manner if at all. Something deep down told me that he didn't care. (As lawyers only work as hard for you as they care to) I pressed forward hoping I made the right choice. During the settlement I did make a loan shark mistake which I thought Scott should have advised me not to. Or maybe helped me out knowing I had a solid case. He also never contacted anyone in my insurance company which pip would of covered and helped me not be put in the position to go to a settlement loan shark. But the biggest point to this review is about a year after my settlement i find some news out. First off during mediation when we settled, scott told me i have no doctors that back me and say the injuries i still suffer from today are directly related to my car accident. Basically saying i dont have much of a case. So a year after that im in descussion with my doctor who treated me during this time for my chronic injuries. I was still upset and made a comment on how he did not think my injuries were directly related to the mva. He looked at me with confusion and told me that in his legal inogouration (his statement for the case) hhe stated my chronic pain and further injuries were indeed directly related to the mva. I do feel strongly there was malpractice on Scott's part. I also feel he was either paid off or pushed me through the system to get his money with minimal effort.

What an Appeals Lawyer Can Do for You

An appeals lawyer specializes in representing clients in appellate courts, challenging or defending lower court decisions. If you believe that a legal error was made during your trial or that the court’s decision was unjust, an appeals lawyer can help you appeal the ruling to a higher court. They work to identify mistakes made during the trial, such as improper application of law, exclusion of key evidence, or jury misconduct. On the other hand, if you're defending a favorable judgment, an appeals lawyer can help protect the decision from being overturned.

Appeals lawyers don’t retry the case but instead focus on legal arguments and procedural issues to convince the appellate court to either overturn, modify, or uphold the lower court’s decision.

When Should I Hire an Appeals Lawyer?

Hiring an appeals lawyer is necessary when you are involved in a legal appeal, either as the appellant (the party appealing the case) or the appellee (the party defending the lower court’s ruling). Common situations in which you should hire an appeals lawyer include:

  • Appealing a conviction or ruling: If you’ve been convicted in a criminal case or lost a civil case and believe the decision was based on legal errors or improper procedures, an appeals lawyer can review the case and file an appeal on your behalf.
  • Challenging a sentence: In criminal cases, if you feel that the sentence is excessively harsh or not in line with legal standards, an appeals lawyer can work to reduce or modify the sentence.
  • Defending a lower court ruling: If the opposing party has filed an appeal to overturn a favorable ruling, an appeals lawyer can help defend the judgment and argue that the lower court’s decision should be upheld.
  • Complex legal issues: If your case involves complicated legal issues or interpretations of the law, an appeals lawyer can provide the necessary expertise to argue those points effectively before an appellate court.
  • Reviewing trial errors: Appeals lawyers can examine whether mistakes such as jury misconduct, improper exclusion or admission of evidence, or incorrect jury instructions occurred during the trial.

You should hire an appeals lawyer as soon as you decide to appeal or are informed that the other party is appealing the case, as appellate procedures are time-sensitive.

What Does an Appeals Lawyer Do?

An appeals lawyer provides specialized legal services to challenge or defend a lower court decision. Their role focuses on legal arguments, reviewing the trial record, and persuading the appellate court to either reverse or uphold the ruling. They can:

  • Review the trial record: Appeals lawyers meticulously review transcripts, evidence, and rulings from the original trial to identify any legal errors or procedural mistakes that could be grounds for appeal.
  • Prepare and file briefs: Appeals lawyers write legal briefs that present persuasive arguments to the appellate court. These briefs focus on the legal errors made during the trial and how they affected the outcome.
  • Present oral arguments: In many appeals, lawyers present oral arguments before a panel of judges, explaining why the lower court’s decision should be reversed or upheld based on legal principles.
  • Monitor case law developments: Appeals lawyers stay updated on changes in the law and precedents set by higher courts, which can be crucial in shaping the arguments they present during the appeal.
  • Provide legal advice on the likelihood of success: Appeals lawyers can offer a realistic assessment of your chances of winning the appeal based on the legal errors and evidence from the trial.

How Are Appeals Lawyers Paid?

Appeals lawyers typically charge for their services based on the complexity of the appeal and the amount of work required to prepare briefs and present arguments. Common payment structures include:

  • Hourly rate: Many appeals lawyers charge by the hour due to the significant amount of research, writing, and preparation involved in appeals. Hourly rates can range from $200 to $600 or more, depending on the lawyer’s experience and the case’s complexity.
  • Flat fee: For some straightforward appeals, a lawyer may charge a flat fee that covers all the work necessary to complete the appeal.
  • Retainer fee: In complex or high-stakes appeals, a lawyer may require a retainer, an upfront payment that covers the initial stages of the appeal. The lawyer then bills against this retainer for ongoing work.

It's important to discuss fees and costs upfront with your lawyer during the initial consultation to ensure you understand the financial commitment involved.

How Much Does an Appeals Lawyer Cost?

The cost of hiring an appeals lawyer varies depending on factors such as the complexity of the case, the lawyer’s experience, and the amount of work involved. General cost estimates include:

  • Straightforward appeals: For simpler appeals, such as those involving minor legal errors, fees can range from $5,000 to $15,000, depending on the scope of work.
  • Complex appeals: Appeals that involve complicated legal issues, multiple grounds for appeal, or high-stakes outcomes can cost anywhere from $20,000 to $100,000 or more, especially if the case requires extensive legal research, brief writing, and oral arguments.
  • Hourly rates: Many appeals lawyers charge hourly rates ranging from $200 to $600 per hour, with higher rates often associated with more experienced attorneys or particularly challenging cases.

Before proceeding with your appeal, it’s crucial to ask for a clear estimate of the costs involved so you can budget appropriately.

Top Questions to Ask an Appeals Lawyer

Before hiring an appeals lawyer, it’s essential to ask questions to ensure they are well-suited for your case and that you understand the appeals process. Important questions include:

  1. What experience do you have with appeals?
Ensure the lawyer has substantial experience handling appellate cases, particularly in the area of law relevant to your case (e.g., criminal, civil, family, etc.).
  2. How do you charge for appeals?
Ask whether the lawyer charges an hourly rate, a flat fee, or a retainer, and request an estimate of the total costs for handling your appeal.
  3. What is the likelihood of success for my appeal?
A good appeals lawyer should provide an honest assessment of your case’s strengths and weaknesses and the chances of winning the appeal.
  4. How long will the appeal process take?
Ask for an estimate of how long the appeal process might take, from filing the initial briefs to a final decision by the appellate court.
  5. Will you personally handle my appeal?
In larger law firms, junior attorneys or legal assistants may handle some of the research or drafting. Clarify who will be responsible for preparing and arguing your case.
  6. What is your approach to handling appeals?
Some lawyers may be more inclined to focus on procedural issues, while others emphasize broader legal arguments. Make sure the lawyer’s approach aligns with your goals.

How to Check the Credibility of an Appeals Lawyer

To ensure that you’re hiring a reputable appeals lawyer, take the following steps to verify their credentials and experience:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no history of disciplinary actions.
  • Look for appellate experience: Review the lawyer’s website or profile to ensure they specialize in appellate law and have successfully handled appeals similar to yours.
  • Check client reviews and testimonials: Look for client feedback on platforms like Avvo, Martindale-Hubbell, or Google to get insight into the lawyer’s track record and client satisfaction.
  • Ask for references: A credible lawyer should be willing to provide references from past clients who can speak to their expertise and success in handling appeals.
  • Look for recognition in appellate law: Membership in organizations like the American Academy of Appellate Lawyers (AAAL) or awards and recognition in appellate law can indicate a lawyer’s expertise in this specialized area.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with an appeals lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Trial transcripts and court records: The lawyer will need a complete record of the original trial, including transcripts, motions, exhibits, and the final judgment or order.
  • Legal briefs from the trial: If any briefs or motions were filed during the trial, bring copies so the appeals lawyer can review the legal arguments that were presented.
  • Written decision or verdict: Bring the court’s written ruling, verdict, or decision so the lawyer can identify any potential errors or issues to raise on appeal.
  • Questions about the appeal process: Write down any questions you have about the appeal’s timeline, costs, and potential outcomes.
  • List of potential legal errors: If you believe specific mistakes were made during the trial (e.g., improper evidence, legal misinterpretations), provide a list of those issues.

Being well-prepared for your consultation allows the lawyer to assess your case more effectively and provide the best guidance on how to proceed with your appeal.
