SaraEllen Hutchinson is an excellent lawyer in consumer protection. I was trying to handle a problem myself with one of the credit reporting agencies. It was going on for 7 months, and not only was I getting nowhere, it was actually getting worse. I was scared, angry, and completely locked out of my credit report, while ID thieves were in. I called SaraEllen's office on a Friday at 5:00 pm. She emailed me the same evening, and by Monday morning she was handling my case. She has a strong working relationship with other lawyers, and within 2 months she had everything corrected. She represented me and handled everything with professionalism, and her knowledge of the credit protection laws. I am so happy with the outcome, and if I ever need need help in this area of law again, I won't hesitate hiring her!

My attorney SaraEllen, has given me the opportunity to have a fresh start in building a career for myself. SaraEllen has helped me get through a very emotional and terrifying experience with debt collection at the age of 20. She has been motivated and strong willed through out my whole case and also helping me dispute other problems that I wasn't even sure was possible without having to just bite the bullet and take it as it came at me. She was very knowledgable and taught me how to stand up for myself in situations that I knew nothing about. SaraEllen is a person who I would definitely recommend to anyone who is in need of help with any circumstances similar to mine. Thank you so much, SaraEllen you are the absolute BEST!

David Corbett represented us in an appeal in the Washington State Court of Appeals, where he worked on our behalf to reverse a large default judgment. Even though the ultimate result was a split decision, we were both impressed by David and the high quality of his work. Because we are residents of Toronto, Canada, we never met David in person, but he was always available by phone or email on short notice, and consistently responsive to our concerns. He was also very good at explaining what was going on in the case as it progressed. We strongly recommend him to anyone who needs counsel for a civil appeal in Washington.

I am writing this review from the perspective of a client who has a case which has yet to be resolved. Therefore, my review of Mr. Corbett's work on my behalf is not influenced by a favorable or unfavorable outcome. Integrity and brilliance best describe David Corbett. He has the unique ability to know what the response will be from his opponent, prior to formulating an argument. This allows Mr. Corbett the ability to know if his argument will be strong or weak. Mr. Corbett researches the applicable laws and previous rulings on similar cases so thoroughly that he is able to clearly articulate how the law applies to the case at hand. Not all judges and lawyers will research the applicable laws thoroughly. For this reason, Mr. Corbett is able to articulate effectively on behalf of his clients. He has constantly kept me informed about his research, and his work on my behalf. I have seen how his work developed because he shared his thoughts with me as he worked on my case. He has restored my faith in the law, and in justice, regardless of the outcome of my particular case. If there is justice in the modern court system, he will find it. On the subject of integrity, I have actually seen him with a stop watch in his hand so that he is only billing a client for time that is used on their behalf. I have never known any attorney to be so conscientious. I consider the work Mr. Corbett has done on my behalf to be one of the best investments I have ever made. I trust him completely, and I highly recommend him.

Our small private company was the plaintiff in a complex anti-trust case which involved one of the largest media companies in the world. As our lead attorney throughout those years, John did a very effective job of navigating the difficult and murky waters of anti-trust litigation, building an impressive case and ultimately bringing that case to trial. More importantly, John was able to effectively litigate in our behalf so that the otherwise overpowering actions of our competitor and its allies were confined enough that we could survive and grow during the years it took to bring the matter to trial. I found John’s integrity, work ethic and genuine concern for our employees and customers to be memorable and often, inspiring. Over the years, I’ve also found that the lessons learned while working with John have repeatedly been of significant and recurring benefit (including the ongoing reduction of legal expenses that might otherwise have been incurred).

Christy McKinley assisted us on a legal matter with an unscrupulous landlord. The landlord was trying to take advantage of us after the termination of a residential lease by charging us for ore-existing damage. Once we got Christy involved, the truth started coming out and let’s just say the landlord had a lot of explaining to do. She left no stone unturned. The landlord was betting on the odds that we would not consult an attorney, which proved to be a mistake in his part. Christy is detail oriented, and a hard worker. She is a tremendous asset on any legal case you may need to litigate. Highly..highly recommended.

I used Tim Gosselin on an insurance matter where the company violated the law but wouldn't pay. The insurance commissioner's office gave me the usual "we can't do anything and you have to see an attorney" garbage. I went to his office at 4:00 on a Friday and found him to be very laid back. He looked at all my paperwork and recommended a letter. By Saturday I had a copy of the letter in the mail. It was very good--forceful but not threatening. By the next Friday the insurance company paid the claim in full! Tim only charged about $200 for everything--other attorneys wanted that just to talk to me. Call the other insurance attorneys in the phonebook, and Tim is the cheapest. And from my experience, the best.

Kampbell Legal Planning was highly recommended to me by a trusted friend. Our wills needed updating and we required guidance on estate planning for blended family. When I think of my time with Cindy Wysocki, Esq., tears of deep gratitude literally come to my eyes as I recall her strength and gentleness, her humor and sharp critical thinking, her willingness to get into the ultimate fighting cage we call the judicial system and her reluctance to throw a punch, and her commitment to fairness and open-hearted compassion. To the lawyer or firm across the virtual table, Cindy must seem formidable and relentless. To me as her client-friend, she was comforting, encouraging, and grounding. I never had to yield my voice or stuff down my questions. AND, Cindy held my concerns and fears, my heightened emotions and (sometimes) clear intuitive insights respectfully while guiding them in positive, productive ways. And best of all, Cindy knew me well enough at the end of a grueling process to be able to then assist and guide me in my needs to safeguard my estate and financial assets to be sure to leave them secure for the ones I love the most. Above all, I am forever grateful to Cindy for accompanying me as a caring fellow human being during one of the most devastating times of my personal life journey. She stayed by my side through unprecedented conditions, with unconditional care and concern, as one of the few who did in my life. Cindy is a legal Bodhisattva!!

Ms. Bloomfield undertook our disability discrimination case against a large law enforcement agency. Through numerous changes in my employer's chain of command, Stephanie's focus and commitment easily identified the legal issues and violations of federal law. Her strong arguments propelled the case forward, and her experience in deposition resulted in their witnesses admitting untruthfulness under oath. As many persons know, a court case is about far more than a final judgment: it is about righting wrongs and ensuring they never happen again. Ultimately, she was able to ensure these violations were a matter of public record - something that was a priority for me, as I had unsuccessfully attempted to resolve this for years. Stephanie helped set a precedence in representation for disabled employees who might be intimidated if they experience hostility and retaliation for requesting accommodation. Stephanie successfully represented me - a judgment was entered against my employer. This would not have happened without her passion and her genuine concern for her client. I felt less like a client, and more like someone who had a strong ally in the courtroom. She answered countless questions, and was far more knowledgeable than I. In cases where my Google research had offered suggested legal considerations - she thoroughly addressed any of my misconceptions and was unfailingly patient with my frequent communications. She was responsive and intelligent - a true privilege to watch her at work. She was incredibly sharp in catching inconsistencies, and was able to destroy the defense's arguments without being unprofessional. I was impressed with Stephanie's perseverance against an agency that seems intimidating to many. With her knowledge and experience, it was of immeasurable relief to see her take on the issues with confidence. I am grateful to Ms. Bloomfield for her determination to right the wrongs in my case.

What an Appeals Lawyer Can Do for You

An appeals lawyer specializes in representing clients in appellate courts, challenging or defending lower court decisions. If you believe that a legal error was made during your trial or that the court’s decision was unjust, an appeals lawyer can help you appeal the ruling to a higher court. They work to identify mistakes made during the trial, such as improper application of law, exclusion of key evidence, or jury misconduct. On the other hand, if you're defending a favorable judgment, an appeals lawyer can help protect the decision from being overturned.

Appeals lawyers don’t retry the case but instead focus on legal arguments and procedural issues to convince the appellate court to either overturn, modify, or uphold the lower court’s decision.

When Should I Hire an Appeals Lawyer?

Hiring an appeals lawyer is necessary when you are involved in a legal appeal, either as the appellant (the party appealing the case) or the appellee (the party defending the lower court’s ruling). Common situations in which you should hire an appeals lawyer include:

  • Appealing a conviction or ruling: If you’ve been convicted in a criminal case or lost a civil case and believe the decision was based on legal errors or improper procedures, an appeals lawyer can review the case and file an appeal on your behalf.
  • Challenging a sentence: In criminal cases, if you feel that the sentence is excessively harsh or not in line with legal standards, an appeals lawyer can work to reduce or modify the sentence.
  • Defending a lower court ruling: If the opposing party has filed an appeal to overturn a favorable ruling, an appeals lawyer can help defend the judgment and argue that the lower court’s decision should be upheld.
  • Complex legal issues: If your case involves complicated legal issues or interpretations of the law, an appeals lawyer can provide the necessary expertise to argue those points effectively before an appellate court.
  • Reviewing trial errors: Appeals lawyers can examine whether mistakes such as jury misconduct, improper exclusion or admission of evidence, or incorrect jury instructions occurred during the trial.

You should hire an appeals lawyer as soon as you decide to appeal or are informed that the other party is appealing the case, as appellate procedures are time-sensitive.

What Does an Appeals Lawyer Do?

An appeals lawyer provides specialized legal services to challenge or defend a lower court decision. Their role focuses on legal arguments, reviewing the trial record, and persuading the appellate court to either reverse or uphold the ruling. They can:

  • Review the trial record: Appeals lawyers meticulously review transcripts, evidence, and rulings from the original trial to identify any legal errors or procedural mistakes that could be grounds for appeal.
  • Prepare and file briefs: Appeals lawyers write legal briefs that present persuasive arguments to the appellate court. These briefs focus on the legal errors made during the trial and how they affected the outcome.
  • Present oral arguments: In many appeals, lawyers present oral arguments before a panel of judges, explaining why the lower court’s decision should be reversed or upheld based on legal principles.
  • Monitor case law developments: Appeals lawyers stay updated on changes in the law and precedents set by higher courts, which can be crucial in shaping the arguments they present during the appeal.
  • Provide legal advice on the likelihood of success: Appeals lawyers can offer a realistic assessment of your chances of winning the appeal based on the legal errors and evidence from the trial.

How Are Appeals Lawyers Paid?

Appeals lawyers typically charge for their services based on the complexity of the appeal and the amount of work required to prepare briefs and present arguments. Common payment structures include:

  • Hourly rate: Many appeals lawyers charge by the hour due to the significant amount of research, writing, and preparation involved in appeals. Hourly rates can range from $200 to $600 or more, depending on the lawyer’s experience and the case’s complexity.
  • Flat fee: For some straightforward appeals, a lawyer may charge a flat fee that covers all the work necessary to complete the appeal.
  • Retainer fee: In complex or high-stakes appeals, a lawyer may require a retainer, an upfront payment that covers the initial stages of the appeal. The lawyer then bills against this retainer for ongoing work.

It's important to discuss fees and costs upfront with your lawyer during the initial consultation to ensure you understand the financial commitment involved.

How Much Does an Appeals Lawyer Cost?

The cost of hiring an appeals lawyer varies depending on factors such as the complexity of the case, the lawyer’s experience, and the amount of work involved. General cost estimates include:

  • Straightforward appeals: For simpler appeals, such as those involving minor legal errors, fees can range from $5,000 to $15,000, depending on the scope of work.
  • Complex appeals: Appeals that involve complicated legal issues, multiple grounds for appeal, or high-stakes outcomes can cost anywhere from $20,000 to $100,000 or more, especially if the case requires extensive legal research, brief writing, and oral arguments.
  • Hourly rates: Many appeals lawyers charge hourly rates ranging from $200 to $600 per hour, with higher rates often associated with more experienced attorneys or particularly challenging cases.

Before proceeding with your appeal, it’s crucial to ask for a clear estimate of the costs involved so you can budget appropriately.

Top Questions to Ask an Appeals Lawyer

Before hiring an appeals lawyer, it’s essential to ask questions to ensure they are well-suited for your case and that you understand the appeals process. Important questions include:

  1. What experience do you have with appeals?
Ensure the lawyer has substantial experience handling appellate cases, particularly in the area of law relevant to your case (e.g., criminal, civil, family, etc.).
  2. How do you charge for appeals?
Ask whether the lawyer charges an hourly rate, a flat fee, or a retainer, and request an estimate of the total costs for handling your appeal.
  3. What is the likelihood of success for my appeal?
A good appeals lawyer should provide an honest assessment of your case’s strengths and weaknesses and the chances of winning the appeal.
  4. How long will the appeal process take?
Ask for an estimate of how long the appeal process might take, from filing the initial briefs to a final decision by the appellate court.
  5. Will you personally handle my appeal?
In larger law firms, junior attorneys or legal assistants may handle some of the research or drafting. Clarify who will be responsible for preparing and arguing your case.
  6. What is your approach to handling appeals?
Some lawyers may be more inclined to focus on procedural issues, while others emphasize broader legal arguments. Make sure the lawyer’s approach aligns with your goals.

How to Check the Credibility of an Appeals Lawyer

To ensure that you’re hiring a reputable appeals lawyer, take the following steps to verify their credentials and experience:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no history of disciplinary actions.
  • Look for appellate experience: Review the lawyer’s website or profile to ensure they specialize in appellate law and have successfully handled appeals similar to yours.
  • Check client reviews and testimonials: Look for client feedback on platforms like Avvo, Martindale-Hubbell, or Google to get insight into the lawyer’s track record and client satisfaction.
  • Ask for references: A credible lawyer should be willing to provide references from past clients who can speak to their expertise and success in handling appeals.
  • Look for recognition in appellate law: Membership in organizations like the American Academy of Appellate Lawyers (AAAL) or awards and recognition in appellate law can indicate a lawyer’s expertise in this specialized area.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with an appeals lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Trial transcripts and court records: The lawyer will need a complete record of the original trial, including transcripts, motions, exhibits, and the final judgment or order.
  • Legal briefs from the trial: If any briefs or motions were filed during the trial, bring copies so the appeals lawyer can review the legal arguments that were presented.
  • Written decision or verdict: Bring the court’s written ruling, verdict, or decision so the lawyer can identify any potential errors or issues to raise on appeal.
  • Questions about the appeal process: Write down any questions you have about the appeal’s timeline, costs, and potential outcomes.
  • List of potential legal errors: If you believe specific mistakes were made during the trial (e.g., improper evidence, legal misinterpretations), provide a list of those issues.

Being well-prepared for your consultation allows the lawyer to assess your case more effectively and provide the best guidance on how to proceed with your appeal.
