My husband & I were in a stressful situation that had been ongoing for many years. We live in NH and the court requesting information was in UT. Att. Mumford & her colleague were recommended to us and we could only "hope for the best". We were so pleased with the professionalism, understanding, & compassion they held out for us as we took one tedious step at a time. We recognized very early on that we did "have the best"! We locked arms, let them guide us and represent us in court whenever it was needed, across the miles -- lasting almost a year. Although we have never met in person, we always knew that we had hired an exceptional attorney for our needs. I am so very grateful that this unfortunate situation has come to a conclusion. Without a doubt, we would hire Att. Mumford again...however, we prefer to not be caught in such an unfair legal situation again.

I had a nasty divorce, it took 6 years and in the process I ended up getting a stalking injunction against my mother in law for breaking into our home, vandalizing my property, visiting with our neighbors and spreading rumors and slander. I did that myself and ended up with 8 counts of stalking against her. She is so vindictive she ended up waiting about a year and then used the some of the same incidents that were counted against her... to try to get an injunction against me. She submitted it in one district court outside of Utah County where the judge flat denied her request. He wrote "This does not constitute stalking!" and underlined it... He wrote denied right on the front cover. 2 weeks later she filed the same thing in the fourth district. The damned judge did not even let me and my divorce attorney present or defend me. He just gave her the Stalking Injunction she asked for. (I think judges are afraid if something were to happen... and they did not give one out... they would be in a jamb) I hired Dallas to appeal this. He did... and the writing was BRILLIANT... really. If you really want to look it up... Appellate cases are not closed in Utah and the case is public. My name is John Andrew Armstrong. Hers is Candace Peterson... just google it. It took forever it seems, not for Dallas but for the State Appellate court to make their call. Needless to say, we won and were awarded attorney fees. Dallas is top notch, I have referred him before to others as well who have had positive experiences. He is safe, effective and smart. Well worth your trust.

Neil got me out of jail! I was arrested under false pretenses. The police office lied to a judge under oath saying I was a convicted felon and on probation. 100% FALSE. Neil saw the false statement on the affidavit of probable cause and contacted the county attorney who then ordered my release and he also convinced the officials that I did not have to pay any bail. And that no restrictions would be placed upon me. Neil was an answer to my prayer. In a subsequent hearing Neil cross-examined witnesses and did an amazing job in asking questions and cross examination. Later he was able to get the criminal case 100% DISMISSED! Highly recommend.

We had no idea how to proceed with doing a quit claim deed. We had been told by others that said these were simple things to do and could handle it ourselves by buying forms and filling them out and sending them in. Why give money to a lawyer that could be "better spent" else where! We did not want to take any chances as we were dealing with a family estate staying within the family. We were given the name of a lawyer by a friend. Mr. Sager made us very comfortable with a welcoming handshake that made us feel he was confident in himself and knew he could do a good job for us. We feel he did a thorough job and kept us well informed of why he was doing each step and of all the procedures that needed to be done and the time frame for them. We have already recommended Mr. Sager to others and will continue to do so in the future. And no, we do not feel the money could have been "better spent" else where!

Richard came highly recommended by a close family friend. He was able to negotiate a deal for me that was very satisfactory for me. I was facing up to 2 years of jail time and a massive amount of fines !! He was able to get me a deal that allows me to pay back my debt to society without having to be incarcerated and as a bonus he was able to get my fine reduced. He also came to visit me in jail in a very speed time. And his Pricing was very reasonable, fair, and affordable. His ability to build instant rapport with the Prosecution was critical in negotiating my deal. After my positive experience with Richard, I would highly recommend anybody seeking Legal Representation to hire, Retain, whatever you call it.... RICHARD DELONEY !!

Scott Crook is hands down the best attorney when it comes to Utah employment law, non-competition agreements, litigation, and business law in general. I’ve worked with several attorneys over the years and Scott has been the only one I’ve been truly impressed with. Scott worked with me on my case for approximately 7 months, as such, I’ve had the opportunity to interact with him on a regular basis. He is timely in his responses, thoughtful in his execution, and a true ally you want on your side. Scott never made me feel like I was asking a “dumb question”, and he always sought to ensure I understood every facet of my case throughout the entire process. I was so impressed with his services on my particular case that I will be using his firm for some of my companies’ other legal needs. I can’t recommend Scott or his practice enough. Experienced, dependable and level-headed. If you’re looking for an attorney who cares about his clients and their pursuits: Scott is your guy.

She was my lawyer when I was In jail and I was in a very delicate situation. I have an eternal amount of respect for her because she is extremely professional. Colleen gives everyone tons of respect and defends with lots of character, she displays a priority to make peace with oneself and the community. I felt as if I was stuck, and immediately upon meeting her I felt important. I knew the true intentions of everything. Even though at times I may have gotten confused, Colleen was an enormous blessing because she taught me. It was always important for her to show me to keep a positive learning composure. While I began to see only problems, she kept showing me solutions. Quickly, I knew that I was going towards good things and I learned that I needed to do my part. Colleen and her agency helped me to see how to grow. I am only keeping my best mood and behavior, working with my best intentions to aspire great things for all of the community. I am sure I will never be in trouble again, I am at peace with myself and I am eager to keep building healthy relationships with everyone as possible. Thank you so much Colleen! Mr. Johnson represented myself in a family law matter. The entire process from start to finish took a little over one year and the process was pretty pricey, but.... it was worth every penny. Mr. Johnson was amazing at keeping me informed and talking with me prior to making decisions. Each and every time we were in court he continued to amaze me at how knowledgeable and powerful he was. He is truly a very skilled attorney; in my opinion, I would say the best. Mr. Johnson always made me feel like I was his most important client and always responded to my calls/emails immediately. By the end of the trial Mr. Johnson and I had built a relationship that I never thought possible with an attorney. He always had my best interests in mind and went out of his way to make sure my requests were fulfilled. Mr. Johnson has changed my life so dramatically and for the best. I do not know where I would be today with out him. In the instance that myself or a family/friend should need legal help in the future I would not hesitate to call Mr. Johnson first. My son found himself in a jam back when he barely turned eighteen, as a matter of fact, it was two weeks past his eighteenth birthday. Well, he had never been in trouble with the law like this and when the threat of prison actually seems real it felt as if the world was coming to an end. I called a numerous amount of attorneys. Wow, they charge ridiculous fees, some over 10,000 which we could definitely not afford. Finally a friend of a friend referred us to David. I wouldn't of found him because he doesn't advertise. He gets his clients based on word of mouth. He was God sent! Not only did he charge us a flat, more reasonable fee. He even allowed us to make monthly payments. He did an awesome job for us and he was able to get my son probation arrangement. I recommend everyone I know to him. We all make mistakes and he understands this. Everyone I've sent to him has also been pleased with him. He's fair, trustworthy, honest. He actually does this to help people it seems (not for the money like other attorneys) I highly recommend you will not be disappointed.

What an Appeals Lawyer Can Do for You

An appeals lawyer specializes in representing clients in appellate courts, challenging or defending lower court decisions. If you believe that a legal error was made during your trial or that the court’s decision was unjust, an appeals lawyer can help you appeal the ruling to a higher court. They work to identify mistakes made during the trial, such as improper application of law, exclusion of key evidence, or jury misconduct. On the other hand, if you're defending a favorable judgment, an appeals lawyer can help protect the decision from being overturned.

Appeals lawyers don’t retry the case but instead focus on legal arguments and procedural issues to convince the appellate court to either overturn, modify, or uphold the lower court’s decision.

When Should I Hire an Appeals Lawyer?

Hiring an appeals lawyer is necessary when you are involved in a legal appeal, either as the appellant (the party appealing the case) or the appellee (the party defending the lower court’s ruling). Common situations in which you should hire an appeals lawyer include:

  • Appealing a conviction or ruling: If you’ve been convicted in a criminal case or lost a civil case and believe the decision was based on legal errors or improper procedures, an appeals lawyer can review the case and file an appeal on your behalf.
  • Challenging a sentence: In criminal cases, if you feel that the sentence is excessively harsh or not in line with legal standards, an appeals lawyer can work to reduce or modify the sentence.
  • Defending a lower court ruling: If the opposing party has filed an appeal to overturn a favorable ruling, an appeals lawyer can help defend the judgment and argue that the lower court’s decision should be upheld.
  • Complex legal issues: If your case involves complicated legal issues or interpretations of the law, an appeals lawyer can provide the necessary expertise to argue those points effectively before an appellate court.
  • Reviewing trial errors: Appeals lawyers can examine whether mistakes such as jury misconduct, improper exclusion or admission of evidence, or incorrect jury instructions occurred during the trial.

You should hire an appeals lawyer as soon as you decide to appeal or are informed that the other party is appealing the case, as appellate procedures are time-sensitive.

What Does an Appeals Lawyer Do?

An appeals lawyer provides specialized legal services to challenge or defend a lower court decision. Their role focuses on legal arguments, reviewing the trial record, and persuading the appellate court to either reverse or uphold the ruling. They can:

  • Review the trial record: Appeals lawyers meticulously review transcripts, evidence, and rulings from the original trial to identify any legal errors or procedural mistakes that could be grounds for appeal.
  • Prepare and file briefs: Appeals lawyers write legal briefs that present persuasive arguments to the appellate court. These briefs focus on the legal errors made during the trial and how they affected the outcome.
  • Present oral arguments: In many appeals, lawyers present oral arguments before a panel of judges, explaining why the lower court’s decision should be reversed or upheld based on legal principles.
  • Monitor case law developments: Appeals lawyers stay updated on changes in the law and precedents set by higher courts, which can be crucial in shaping the arguments they present during the appeal.
  • Provide legal advice on the likelihood of success: Appeals lawyers can offer a realistic assessment of your chances of winning the appeal based on the legal errors and evidence from the trial.

How Are Appeals Lawyers Paid?

Appeals lawyers typically charge for their services based on the complexity of the appeal and the amount of work required to prepare briefs and present arguments. Common payment structures include:

  • Hourly rate: Many appeals lawyers charge by the hour due to the significant amount of research, writing, and preparation involved in appeals. Hourly rates can range from $200 to $600 or more, depending on the lawyer’s experience and the case’s complexity.
  • Flat fee: For some straightforward appeals, a lawyer may charge a flat fee that covers all the work necessary to complete the appeal.
  • Retainer fee: In complex or high-stakes appeals, a lawyer may require a retainer, an upfront payment that covers the initial stages of the appeal. The lawyer then bills against this retainer for ongoing work.

It's important to discuss fees and costs upfront with your lawyer during the initial consultation to ensure you understand the financial commitment involved.

How Much Does an Appeals Lawyer Cost?

The cost of hiring an appeals lawyer varies depending on factors such as the complexity of the case, the lawyer’s experience, and the amount of work involved. General cost estimates include:

  • Straightforward appeals: For simpler appeals, such as those involving minor legal errors, fees can range from $5,000 to $15,000, depending on the scope of work.
  • Complex appeals: Appeals that involve complicated legal issues, multiple grounds for appeal, or high-stakes outcomes can cost anywhere from $20,000 to $100,000 or more, especially if the case requires extensive legal research, brief writing, and oral arguments.
  • Hourly rates: Many appeals lawyers charge hourly rates ranging from $200 to $600 per hour, with higher rates often associated with more experienced attorneys or particularly challenging cases.

Before proceeding with your appeal, it’s crucial to ask for a clear estimate of the costs involved so you can budget appropriately.

Top Questions to Ask an Appeals Lawyer

Before hiring an appeals lawyer, it’s essential to ask questions to ensure they are well-suited for your case and that you understand the appeals process. Important questions include:

  1. What experience do you have with appeals?
Ensure the lawyer has substantial experience handling appellate cases, particularly in the area of law relevant to your case (e.g., criminal, civil, family, etc.).
  2. How do you charge for appeals?
Ask whether the lawyer charges an hourly rate, a flat fee, or a retainer, and request an estimate of the total costs for handling your appeal.
  3. What is the likelihood of success for my appeal?
A good appeals lawyer should provide an honest assessment of your case’s strengths and weaknesses and the chances of winning the appeal.
  4. How long will the appeal process take?
Ask for an estimate of how long the appeal process might take, from filing the initial briefs to a final decision by the appellate court.
  5. Will you personally handle my appeal?
In larger law firms, junior attorneys or legal assistants may handle some of the research or drafting. Clarify who will be responsible for preparing and arguing your case.
  6. What is your approach to handling appeals?
Some lawyers may be more inclined to focus on procedural issues, while others emphasize broader legal arguments. Make sure the lawyer’s approach aligns with your goals.

How to Check the Credibility of an Appeals Lawyer

To ensure that you’re hiring a reputable appeals lawyer, take the following steps to verify their credentials and experience:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no history of disciplinary actions.
  • Look for appellate experience: Review the lawyer’s website or profile to ensure they specialize in appellate law and have successfully handled appeals similar to yours.
  • Check client reviews and testimonials: Look for client feedback on platforms like Avvo, Martindale-Hubbell, or Google to get insight into the lawyer’s track record and client satisfaction.
  • Ask for references: A credible lawyer should be willing to provide references from past clients who can speak to their expertise and success in handling appeals.
  • Look for recognition in appellate law: Membership in organizations like the American Academy of Appellate Lawyers (AAAL) or awards and recognition in appellate law can indicate a lawyer’s expertise in this specialized area.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with an appeals lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Trial transcripts and court records: The lawyer will need a complete record of the original trial, including transcripts, motions, exhibits, and the final judgment or order.
  • Legal briefs from the trial: If any briefs or motions were filed during the trial, bring copies so the appeals lawyer can review the legal arguments that were presented.
  • Written decision or verdict: Bring the court’s written ruling, verdict, or decision so the lawyer can identify any potential errors or issues to raise on appeal.
  • Questions about the appeal process: Write down any questions you have about the appeal’s timeline, costs, and potential outcomes.
  • List of potential legal errors: If you believe specific mistakes were made during the trial (e.g., improper evidence, legal misinterpretations), provide a list of those issues.

Being well-prepared for your consultation allows the lawyer to assess your case more effectively and provide the best guidance on how to proceed with your appeal.
