I found the communication to be less effective than I had hoped. There were instances where my questions went unanswered, and I felt a bit lost in the process without sufficient guidance. I believe there may be opportunities for improvement, especially when assisting new buyers, particularly within the Hispanic community. I do not recommend him

I sought the services of Tracey for the sale of my home based on the recommendation of my real estate agent, who I trust without question. Lucky me. Trace was responsive, attentive and experienced. Her advice was frank and direct, which I appreciate, and her team worked seamlessly. I would not hesitate to engage her again.

Nicholas Carre is not to do business with he is not reliable and very unprofessional. He is only there for money and once he gets it that’s it he will not finish up his part of the deal. So I recently sold my home back in March of 2024 and I made a contract agreement with the buyers to hold money in an escrow account and once the issues was completed the money was suppose to be released to me instead I have not got anything and I been reaching out to him and his office since April and he just ignore the calls… ignore the emails. I even went down to the office in person and they told me I couldn’t speak to him he not there I waited and still nothing.. if someone ever recommends him do not use him at all he has now been dodging me and my boyfriend for almost a year now.. I repeat do not do any business with him or his company. I now have to get legal involve and file complaints against him.

A year and a half into a contentious custody dispute and acrimonious divorce, I met Neil Fredman and Ken Novenstern, attorneys at Fredman, Baken and Novenstern. During the most painful time of my life, I was finally in capable, compassionate hands. Neil and Ken are not your typical lawyers. From the get go, they focused on doing the right thing. They have heart, and most definitely appreciated my situation. Despite the emotional turbulence of those months, working with them was a pleasure. As I got to know them, I saw quickly how well they both know and understand the system. They have relationships with many of the judges, clerks, referees and staff in the White Plains Supreme and Family Court, so they just know how to handle every scenario and every surprise from the opposing side. Because of their understanding of the Westchester court system, things went smoothly from the beginning. Brilliant writers, they always impressed me with their comprehensive letters to the court and the opposing attorney. Nothing was left out of the letters and every time, they nailed it. Neil and Ken had a special ability to support me through an immensely stressful period. Speaking to them felt like I was talking to friends, father figures in a way, who gave me trusted and wise counsel. Down to earth, easy-going and gracious, they are both just good people. You just get this positive feeling about people and with them, I felt it right away. As experienced divorce attorneys, they know what to focus on. When the other side created distractions or said things to rile me up, they would reassure me that it wasn’t a big deal and not to worry. Facile in putting things into layman’s terms, they have a very direct, clear and real world communication style. They know what’s important and ultimately what matters most. During emotional custody and divorce battles, you need them on your side. Honest, authentic, and intelligent, Neil and Ken kept my expectations in check. If I wanted to go after something, they would let me know if it was worth it, and if not, they would help me refocus my energy on what was truly essential. Above all, Neil and Ken brought me results. Working with them got me a solid and fair financial agreement and custody agreement for my two children, who mean more to me than anything in the world. After a year and a half of withstanding mean-spirited and demoralizing attacks by the opposing counsel in court, I am thankful that I finally found attorneys who ensured I was properly protected and fought for. I am happy to have my divorce and custody battle behind me and am incredibly grateful for the stellar legal results I received. Neil and Ken understood my side of the story and fought for me, and won for all of us, including my two sons. I recommend them at the highest level.

Neil Fredman represented me in my divorce/custody case in 1995. In the years since then I spoke of him often in the sharing of that story and I will again here, later. But first let me say that 25 years later, Neil once again saved the day. In the face of coronavirus, I decided to take a lump sum payment of my pension plan. If I died, this pension plan did not allow for a non-spouse beneficiary – meaning my children could not inherit it. But I could take the lump sum and roll it into an IRA account, naming my children as beneficiary. We are talking about a couple hundred thousand dollars that if left within the pension and I died, would simply be absorbed by the pension plan. I desperately wanted to make sure that my kids would be able to inherit these funds. The pension administrator required a copy of my divorce decree which neither I nor my Ex was able to locate. To get a copy from the Court, I’d have to go in-person to New York – from Florida, during coronavirus crisis. I took a chance and emailed Neil Fredman. Neil emailed me a certified copy of my 25 year old divorce decree in just one day!!! Because of Neil, I am now the happy recipient of my lump sum pension plan distribution. Of course, I thanked him profusely and took the opportunity to tell him how grateful I have always been for his sage advice way back in 1995. I reflected on my divorce scenario and Neil’s role and I’d like to take this opportunity to comment on that as well. 25 years ago, my Ex and I intended to resolve custody and divorce matters amicably. We had agreed on joint custody. I agreed to no alimony or child support because I earned more than him. We didn’t have much savings and didn’t own a home, so there wasn’t much to fight over. Never-the-less, a blood-sucking divorce attorney sunk his teeth into my ex-husband and promised him sole custody and alimony, prompting the animosity and legal fees to pile up. My first attorney was of a similar ilk. But a few days before a temporary custody hearing, he died of a brain aneurysm. I figured I was a great Mom so I went into court representing myself. I was not able to handle the procedural requirements of civil court, and I lost temporary custody of our kids. My heart was broken. That was when I hired Neil Fredman. His reputation proceeded him. I had one chance to change the course of events in the trial for full custody. In truth, it never got that far. Neil reviewed the findings from Social Services- who found both of us quite suitable parents- and supported joint custody with the children living with me and generous visitation with their Dad. Neil Fredman went to my Ex’s blood-sucking attorney and “encouraged” him to support the original proposal of joint custody, no alimony or child support. I later found out from my Ex that his attorney told him that while he could easily win against me, he would never be able to win against Neil Fredman. With Neil at the helm, the case was quickly resolved through a Stipulation and Settlement Agreement. At the time, I thought Neil’s hourly rates were high – but in the end, well worth it. He NEVER tried to drag it out. He worked towards settling rather than going to trial. I’m proud to say that ultimately, my Ex and I amicably co-parented. Our kids often said, “Why can’t you and Dad be like other divorced parents and not speak to each other?” – because we stood united in our parenting decisions and they couldn’t pit us against each other. It was Neil Fredman who paved the path to this end, and I have been eternally grateful to him ever since. Now 25 years later, Neil once again resolved my problem quickly and effectively. Neil Fredman has integrity and consideration for what happens AFTER the divorce process is finalized with the goal of meeting the best interests of the children and the adults in the years that follow. He is a rare find in divorce law and I highly recommend him.

I cannot recommend David highly enough. He represented me for more than 5 years during a very complex and emotionally draining family law case. From the very beginning, he demonstrated exceptional professionalism, empathy, and expertise that made navigating a challenging family law situation much easier. David’s deep understanding of family law, combined with his strategic "no nonsense" approach gave me confidence and peace of mind throughout the entire process. He always listened intently to my concerns, was timely in his responses, and thoroughly explained every step. He was always available to answer questions, no matter how small. David's commitment to my case was evident in the way he advocated fiercely on my behalf, balancing assertiveness with sensitivity to ensure the best possible outcome for me and my daughter. He took an incredible risk by representing me and I could not be more grateful for him. Thanks to his dedication, I felt supported and informed at every turn, which was invaluable during such an emotional time. The resolution he achieved exceeded my expectations. Because he represented me for so long, he was tirelessly invested in seeing it through to the end. I have tremendous respect for his dedication and resilience. If you are looking for a compassionate, firm, knowledgeable, and results-driven family law attorney, David is the one you want by your side.

I would highly recommend the Douglas Family Law Group. I have come to realize that you either have a horrible lawyer or a great one. I feel the best measure is when they are transparent and show that they actually care. I was first represented by a pro-bono lawyer who wouldn't tell the court my ex-partner boyfriend threatened me, that she caused him 38 lates to school and she didn't have him half the time and she moved out of state without telling me or the court. He just kept telling me " you never know what the judge will say so take the settlement". he refused to even put my requests in the settlement if he felt they wouldn't agree. When I retained the Douglas Family Law group it was a different experience. There was constant communication, empathy and acknowledgment for some of the unfairness that I had experienced. Elizabeth spoke up for me in the courtroom and stated many things that needed to be on the record. Elizabeth put in my reasonable and justifiable requests when engaging in the settlement process. Elizabeth many times had to explain to me what the court pays attention to and what path we can take to present that. I have a great disdain for the family court system and it's practices but if you have representation from this law firm they can professionally and honestly represent and defend your interests in this institution. I, thank them for finally giving me a voice in this arena so that my son can truly have what he needs that serves in his best interest.

Was on the other side of a transaction and couldn’t have been more disappointed. Matt thought it was OK/moral to send contracts out to multiple offers while knowing the real estate agent accepted one offer and not letting the counter parties know that was happening. A very poor communicator and would not respond to inquiry’s after our lawyer was made aware that multiple contracts were sent out. Inappropriate and not someone I would trust doing business with.

He was very responsive and promptly let us know about anything unusual or risks that we as seller or buyer should be aware of. He took care to explain the key points of real estate transactions. He handled the communications on both ends very well. He has a very deep knowledge and network of realtors and real estate industry contacts in Westchester. He was able to coordinate both closings and the closings went smoothly. For real estate transactions, I highly recommend Brett and his team.

I contacted Dolores after doing extensive research on divorce attorneys. Dolores had one of the highest recommendations and now I understand why. She is not only adept at handling various divorce matters with professional ease and unreproachable competence, but she allays her clients worries & problems with diligent attention and a genuine, personal concern that comes through at all times. Dolores takes the myriad of legal jargon and litgational processes and translates the cold, hard facts into clear explanations that even the biggest simpleton can understand. When you're ready and want only the best representation for your divorce, especially after you get done dealing with biased mediators and incompetent attorneys, give her a call. Better yet, call Dolores first. You won't regret it.

I cannot express enough gratitude for Jessica and Meredith and their incredible team for their outstanding support and expertise throughout my court case. From the very beginning, they were not only professional and knowledgeable but also deeply compassionate and understanding of my situation. Jessica and Meredith fought tirelessly on my behalf and ensured that every detail was handled with care and precision. Their dedication to my case was evident in every interaction, and they always made me feel supported and heard. The entire team was equally remarkable, always responsive, organized, and willing to go above and beyond to help. Thanks to their efforts, we achieved a settlement that exceeded my expectations. The outcome will make a significant difference in my life and my children’s lives, and I owe it all to Jessica’s hard work and determination. If you are looking for a lawyer who is not only highly skilled but also genuinely cares about her clients, I wholeheartedly recommend Jessica and Meredith. They are truly exceptional, and I feel so fortunate to have had them in my corner during this challenging time.

My experience with Jessica Ressler and her firm has been amazing! It is very difficult to find the delicate balance of not only an attorney that listens and hears you, but represents your best interest. I am been involved in an extremely complex and litigious battle. Without her caring yet determined approach, I am not quite sure if I would have been able to make it through.... Every step of the way, Jessica has been communicative, forthright, and available. I have always been made to feel heard, which is invaluable when going thru the complexities of such emotional and financial stress. Jessica is beyond brilliant, the hardest worker I know, and is so determined to fight for her clients best interests, my best interests. I am thrilled to have found her and her firm! Every single person in that office deserves more than 5 stars!!

I had a very frustrating, and potentially negatively life altering, experience with Ms. Ressler earlier this year. The error on her part cost my family time, frustration, and stress to myself and my children. I was advised to file a temporary order of protection which involved making claims against family members. Unbeknownst to me, Jessica Ressler has a general modus operandi of being an extremely aggressive attorney, regardless of the situation. Her tactics involve getting her clients temporary orders of protection, involving the police, and using false statements. For those who are not aware, these tactics often negatively impact children. She treats every case the same, and her reputation in the industry is well known as being overly aggressive to the point of being detrimental to her clients and their cases. Further, her strategy unnecessarily involves child protective services who are legally obligated to investigate each case, and each parent, regardless of the accusations made. Without going into significant personal detail, the filings I made under Ms. Ressler's guidance landed me in the cross hairs of CPS for no apparent reason. The result could have led to a permanent record, termination from my job, and an inability to be involved in some children's activities. When I pointed this out to Ms. Ressler, I was met with vague explanations and no real accountability, nor help to assist me from a legal standpoint. While initially she was attentive to my questions, once this occurred, her communication stopped instead of following up on ways to assist me, as though she signed off from my case. Ultimately, the CPS case was resolved without issue based on evidence provided by my family. It should be noted that Ms. Ressler was recently formally admonished in court for her tactics and procedures. As previously stated, her reputation amongst attorneys in the NYC metro area is well known, and not well regarded. I would not trust this lawyer with anything important and would highly caution others to do their due diligence before hiring her. I strongly suggest looking elsewhere for legal counsel.

Martin Rosen is an outstanding attorney who champions his clients. His ability to listen deeply and understand the nuances of my situation set him apart from the start. He is exceptionally well-versed in family and divorce law. What really impressed me is his compassionate approach—he genuinely cares about his clients while maintaining a laser-like focus on the details that matter most. His strategic advice is thoughtful and effective during a time when you most need strong counsel and experience in your corner.

I fired my high end /hotshot NYC attorneys and hired Martin Rosen 18 months into my divorce negotiations — and it was the best decision I ever made! I had been through the wringer - feeling like I wasn’t being heard by my legal team and with a nagging feeling of “This just can’t be right”. From our first meeting, Martin showed compassion and vowed to fight on my behalf and get me what was legally and morally right after a 16+ year marriage. He is a highly respected Westchester lawyer and this was obvious from the minute we stepped into the courthouse together. He knows the law inside and out, and his courtroom etiquette is superb. The settlement I got was far above and beyond what my original attorneys urged me to agree to — and if that wasn’t pleasing enough, I have also made a friend for life. Martin will have your back, he will treat you with kindness and respect, and he will fight for you both inside and outside the courtroom. He is a diamond in the rough.

Martin Rosen is an excellent attorney, one whom has been there for me throughout not only the worst times in my life, but for the times after. He is attentive, knowledgable, and usage of his services purveys one with a peace of mind that is not readily attainable with less qualified lawyers. He is direct and honest, but compassionate. If you tell Mr. Rosen the actual scenario, he will obtain the best result possible; if you are in a bad place, he will put you in a better one. He is not intimidated by snark nor malice. I have used his services for my own custody issues on multiple occasions and will continue to do so as long as his name rests over his awning. I have severe concerns regarding the recent one star review (Chris, 2024) and strongly take issue with his brazen mischaracterization of an individual whom has been there for me at my lowest as much as any professional could be asked to. I hope he gets the help he needs, but his review reads as untrue and glib. Though his flat attempts at slander, one can see a truly gauche (nay, entitled?) interior, and I simply cannot understand why someone who clearly never even used Mr. Rosen's services feels entitled to mischaracterize one's business (and thus livlihood) as they did in such a shameful and public manner. I would strongly urge any potential clients to ignore this individual's sentiments entirely.

After years of questionable experiences and swapping lawyers due to unsatisfactory service and poor responsiveness, I have been amazingly pleased with Mr. DeTommasi as a lawyer and a business professional. I was an innocent man incarcerated in the New York State Department of Corrections, and had a Federal Petition for Habeas Corpus pending in the Southern District of New York. After much wrangling with the Attorney Generals Office, I was appointed Mr. Theodore Green to assist me with my filing. I can unequivocally say that he was the only attorney that I had in this long ordeal that was attentive to all my concerns, questions, and calls. I never waited for a reply from him. Ultimately, he was able to secure my release on actual innocence, not an easy feat in the federal court system. I can say, without any hesitation, that Mr. Green is a true professional, and future clients should feel assured that they have hired a man at the top of his field. I cant thank this man enough for all of his assistance, and has restored to me what is most desired of any person. FREEDOM. Thank you Mr.Green.

My husband and I just finalized the purchase of our first home, with Lou's help. From our first conversation, we could tell that Lou cared about helping us and making sure we understood the process. He knows White Plains backward and forward and we appreciated his commitment to the local community that we are now a part of. Lou is personable, knowledgeable, and pays close attention to detail; on top of that, his pricing was very reasonable. We would use him again and would recommend him to anyone looking to buy property in the area.

My wife and I were in need of an attorney when purchasing our first home. I spoke to a few attorneys, but Lou came via way of a good friend. Lou came across as fair but firm, knowledgeable, and experienced. My wife and I knew he would get the job done and he was the type of person we needed to help us close on our first home. Lou was extremely professional, responsive at all hours of the day and even on weekends, more than patient with our many questions, and meticulous and thorough as he guided us through the closing process. Everything went smoothly -- much smoother than we ever could have expected for our first home purchase -- and we couldn't be happier. Thank you, Lou!

I had the good fortune of retaining Lydia Milone for my divorce proceedings in 2019, and I say this with the utmost respect and gratitude- Lydia is a lioness; ferocious in her client’s defense and protective of their needs and emotions in what are for them, very turbulent times. Lydia shepherded me through one of the most difficult experiences of my life- listening to my concerns, protecting my interests and offering sage advice through the entire process. John Jones was so great! We'd been working with another law firm to try to close on some land in upstate NY. The closing date was supposed to be in September 2020. We switched to working with John in January 2021 and he was able to do in 4 weeks what had taken the other firm over 4 months. If only we'd switched sooner, perhaps we could have avoided the extra time spent, interest paid, and all the price hikes on building materials. However we are SO SO SO pleased with how diligently John worked on our closing. He was responsive, informative, and thorough. Thanks John!

If you are headed for a difficult divorce and seeking compassionate, intelligent and competent representation, I highly recommend The Pappalardo Law Group. John Pappalardo and his associate, Judith Murphy worked diligently for me for over 5 years through an extremely contentious divorce. Despite the fact that my ex controlled all the marital assets and was willing to spend everything to destroy me, John and Judith stuck by me. My case was also very difficult as we had 4 different judges presiding due to the length of time it took to resolve. Two of the four judges were completely inexperienced and were blatantly incompetent. These circumstances made for a very challenging battle. During all of this, I felt that I had the best possible attorneys representing me. In an extremely emotional and soul crushing time, both John and Judith always made me feel like I was a person worth fighting for. Yet, John would tell me exactly what he thought, even if it wasn’t always what I wanted to hear. He is completely honest and told me what I needed to hear, giving the best possible advice. I thank them both for their hard work!

I am incredibly dissatisfied with the legal services provided by John Pappalardo and his team during my child custody case. They consistently ran up the bill with ineffective strategies and failed to properly guide me on the best course of action, resulting in significant financial strain and distress. Moreover, communication was severely lacking throughout the process, with my emails and calls often going unanswered for days. I felt like I was constantly kept in the dark about important developments in my case, and when I did receive updates, they were vague and unhelpful. Additionally, the level of professionalism exhibited by John Pappalardo and his team left much to be desired. I often felt dismissed and belittled whenever I raised concerns or asked for clarification on legal matters. Overall, I would not recommend John Pappalardo's legal services to anyone in need of competent and reliable representation. My experience with his firm was nothing short of a nightmare, and I am left feeling extremely disappointed and let down. In conclusion, I strongly advise against utilizing John Pappalardo's services for child custody cases. Their poor communication, inadequate preparation, and lack of effectiveness in the courtroom only served to heighten stress and financial burden. They do not prioritize or protect the well-being of the children and struggle to handle cases involving domestic abuse or high-conflict custody disputes.

The Poppalardo Law group You never think one day you’ll need to go through the process of fighting for custody of your children. Unfortunately that day came me. I found myself in a love-less relationship with an unfaithful partner who I shared 2 beautiful children with. I felt helpless because you always think the law favors the mother in most cases. Being an extremely involved father who coached and was very active in my children’s life, I knew I didn’t want to be the typical every-other-weekend warrior father, I had to fight for my children. I was referred to The Pappalardo Law group from a friend of a friend who was also an attorney in Connecticut. She was very confident that this was the best Law Firm for my situation. I reluctantly made the call and set up the appointment. Turned out to be one of the best most important decisions I’ve ever made. John Pappalardo assigned his associate Sam to my my case and from day one they both worked tirelessly to understand our circumstances and put together an amazing case to present to the court. It was a long stressful road but being able to be in my children’s life on a day to day basis made the tough journey worth it. Sam was an amazing partner through all of this even going on maternity leave, having a baby and still returning to my case to close it out. She was extremely attentive and the communication always made me feel like I was a priority. Nobody ever wants to go through this process in life but if you find yourself in a situation where you’re fighting to keep your children in your life, I would Highly recommend reaching out and putting your trust in The Poppalardo Law Group.

What an Appeals Lawyer Can Do for You

An appeals lawyer specializes in representing clients in appellate courts, challenging or defending lower court decisions. If you believe that a legal error was made during your trial or that the court’s decision was unjust, an appeals lawyer can help you appeal the ruling to a higher court. They work to identify mistakes made during the trial, such as improper application of law, exclusion of key evidence, or jury misconduct. On the other hand, if you're defending a favorable judgment, an appeals lawyer can help protect the decision from being overturned.

Appeals lawyers don’t retry the case but instead focus on legal arguments and procedural issues to convince the appellate court to either overturn, modify, or uphold the lower court’s decision.

When Should I Hire an Appeals Lawyer?

Hiring an appeals lawyer is necessary when you are involved in a legal appeal, either as the appellant (the party appealing the case) or the appellee (the party defending the lower court’s ruling). Common situations in which you should hire an appeals lawyer include:

  • Appealing a conviction or ruling: If you’ve been convicted in a criminal case or lost a civil case and believe the decision was based on legal errors or improper procedures, an appeals lawyer can review the case and file an appeal on your behalf.
  • Challenging a sentence: In criminal cases, if you feel that the sentence is excessively harsh or not in line with legal standards, an appeals lawyer can work to reduce or modify the sentence.
  • Defending a lower court ruling: If the opposing party has filed an appeal to overturn a favorable ruling, an appeals lawyer can help defend the judgment and argue that the lower court’s decision should be upheld.
  • Complex legal issues: If your case involves complicated legal issues or interpretations of the law, an appeals lawyer can provide the necessary expertise to argue those points effectively before an appellate court.
  • Reviewing trial errors: Appeals lawyers can examine whether mistakes such as jury misconduct, improper exclusion or admission of evidence, or incorrect jury instructions occurred during the trial.

You should hire an appeals lawyer as soon as you decide to appeal or are informed that the other party is appealing the case, as appellate procedures are time-sensitive.

What Does an Appeals Lawyer Do?

An appeals lawyer provides specialized legal services to challenge or defend a lower court decision. Their role focuses on legal arguments, reviewing the trial record, and persuading the appellate court to either reverse or uphold the ruling. They can:

  • Review the trial record: Appeals lawyers meticulously review transcripts, evidence, and rulings from the original trial to identify any legal errors or procedural mistakes that could be grounds for appeal.
  • Prepare and file briefs: Appeals lawyers write legal briefs that present persuasive arguments to the appellate court. These briefs focus on the legal errors made during the trial and how they affected the outcome.
  • Present oral arguments: In many appeals, lawyers present oral arguments before a panel of judges, explaining why the lower court’s decision should be reversed or upheld based on legal principles.
  • Monitor case law developments: Appeals lawyers stay updated on changes in the law and precedents set by higher courts, which can be crucial in shaping the arguments they present during the appeal.
  • Provide legal advice on the likelihood of success: Appeals lawyers can offer a realistic assessment of your chances of winning the appeal based on the legal errors and evidence from the trial.

How Are Appeals Lawyers Paid?

Appeals lawyers typically charge for their services based on the complexity of the appeal and the amount of work required to prepare briefs and present arguments. Common payment structures include:

  • Hourly rate: Many appeals lawyers charge by the hour due to the significant amount of research, writing, and preparation involved in appeals. Hourly rates can range from $200 to $600 or more, depending on the lawyer’s experience and the case’s complexity.
  • Flat fee: For some straightforward appeals, a lawyer may charge a flat fee that covers all the work necessary to complete the appeal.
  • Retainer fee: In complex or high-stakes appeals, a lawyer may require a retainer, an upfront payment that covers the initial stages of the appeal. The lawyer then bills against this retainer for ongoing work.

It's important to discuss fees and costs upfront with your lawyer during the initial consultation to ensure you understand the financial commitment involved.

How Much Does an Appeals Lawyer Cost?

The cost of hiring an appeals lawyer varies depending on factors such as the complexity of the case, the lawyer’s experience, and the amount of work involved. General cost estimates include:

  • Straightforward appeals: For simpler appeals, such as those involving minor legal errors, fees can range from $5,000 to $15,000, depending on the scope of work.
  • Complex appeals: Appeals that involve complicated legal issues, multiple grounds for appeal, or high-stakes outcomes can cost anywhere from $20,000 to $100,000 or more, especially if the case requires extensive legal research, brief writing, and oral arguments.
  • Hourly rates: Many appeals lawyers charge hourly rates ranging from $200 to $600 per hour, with higher rates often associated with more experienced attorneys or particularly challenging cases.

Before proceeding with your appeal, it’s crucial to ask for a clear estimate of the costs involved so you can budget appropriately.

Top Questions to Ask an Appeals Lawyer

Before hiring an appeals lawyer, it’s essential to ask questions to ensure they are well-suited for your case and that you understand the appeals process. Important questions include:

  1. What experience do you have with appeals?
Ensure the lawyer has substantial experience handling appellate cases, particularly in the area of law relevant to your case (e.g., criminal, civil, family, etc.).
  2. How do you charge for appeals?
Ask whether the lawyer charges an hourly rate, a flat fee, or a retainer, and request an estimate of the total costs for handling your appeal.
  3. What is the likelihood of success for my appeal?
A good appeals lawyer should provide an honest assessment of your case’s strengths and weaknesses and the chances of winning the appeal.
  4. How long will the appeal process take?
Ask for an estimate of how long the appeal process might take, from filing the initial briefs to a final decision by the appellate court.
  5. Will you personally handle my appeal?
In larger law firms, junior attorneys or legal assistants may handle some of the research or drafting. Clarify who will be responsible for preparing and arguing your case.
  6. What is your approach to handling appeals?
Some lawyers may be more inclined to focus on procedural issues, while others emphasize broader legal arguments. Make sure the lawyer’s approach aligns with your goals.

How to Check the Credibility of an Appeals Lawyer

To ensure that you’re hiring a reputable appeals lawyer, take the following steps to verify their credentials and experience:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no history of disciplinary actions.
  • Look for appellate experience: Review the lawyer’s website or profile to ensure they specialize in appellate law and have successfully handled appeals similar to yours.
  • Check client reviews and testimonials: Look for client feedback on platforms like Avvo, Martindale-Hubbell, or Google to get insight into the lawyer’s track record and client satisfaction.
  • Ask for references: A credible lawyer should be willing to provide references from past clients who can speak to their expertise and success in handling appeals.
  • Look for recognition in appellate law: Membership in organizations like the American Academy of Appellate Lawyers (AAAL) or awards and recognition in appellate law can indicate a lawyer’s expertise in this specialized area.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with an appeals lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Trial transcripts and court records: The lawyer will need a complete record of the original trial, including transcripts, motions, exhibits, and the final judgment or order.
  • Legal briefs from the trial: If any briefs or motions were filed during the trial, bring copies so the appeals lawyer can review the legal arguments that were presented.
  • Written decision or verdict: Bring the court’s written ruling, verdict, or decision so the lawyer can identify any potential errors or issues to raise on appeal.
  • Questions about the appeal process: Write down any questions you have about the appeal’s timeline, costs, and potential outcomes.
  • List of potential legal errors: If you believe specific mistakes were made during the trial (e.g., improper evidence, legal misinterpretations), provide a list of those issues.

Being well-prepared for your consultation allows the lawyer to assess your case more effectively and provide the best guidance on how to proceed with your appeal.
