Scott Needleman went above and beyond to help us. We were an incredibly unique case. We did not pass the means test for a Chapter 7, but Scott went to work and made it happen. Another twist to our story, my mother died the day after we filed. Associated with her death were some payable upon death beneficiary accounts. I called Scott he told me they would be the property of the bankruptcy trustee. The typical attorney would just give up at this point. Scott researched and found court cases in which these types of funds were treated like lottery winnings, they get to keep it. Scott presented his research to the trustee who agreed we could keep this large sum of money. Scott’s work for us made us feel like we won the lottery. Every attorney we interviewed immediately stated we had to file chapter 13 and I have no doubt we would have also lost the money my mother intended for us. Scott will work hard for you. He is worth the Money!!!!!!

I have used Mr. Herders services previously to file a bankruptcy and my case was handled professionally. Recently I had to contact them for some information on my old case and he was very helpful and provided the information I needed quickly. The issue involved a mortgage that was thankfully removed 10 years ago. He looked up the records and his office did the job perfect. He remembered me and actually answered the phone too. He has the same high energy in the past. Does he ever sleep? He also explained that I could not accomplish the result now. I timed the bankruptcy just right. Thank you Mr. Herder for all of your help. I recommend the law office to anyone looking to file a bankruptcy!

I want to give Attorney Mark Herder & his team hats off for saving my Chapter 13. Due to illness I was in & out of the hospital & eventually spent time in a nursing home which caused me to fall behind on my Chapter 13 payments. Mr. Herder & his staff went to bat for me & saved my case. I want to express my gratitude to him & Kelsey for standing by my side. Thank you so much for all your help!!!

Mark Herder filed my bankruptcy case and made a bad situation turn into a positive one. He and his staff took care of all the money troubles that I had from bad decisions from a bad divorce. I really felt like he was in my corner, and he even called me back tonight, after work, on a weekend. I am sure that he had plenty of other things to do during this pandemic as well. I am glad I followed his advice and instructions from the first time I contacted him several years ago. The car is saved and I have taken real good care of it too. My bankruptcy case will finish in 15 months and I have made all of the payments, just like he sugested. I will freely own my car at the end of the case, with no debts. Have a nice weekend Attorney Herder!

My husband and I hired Jim to help with a complicated personal bankruptcy precipitated by losing a business we both owned. He was responsive, clear-minded, super helpful, and helped us get the best outcomes possible. He also represented us through litigation with a former client, also successfully. In running our business for a decade we’ve worked with a dozen lawyers and can honestly say Jim is one of the best we’ve known. Can’t recommend him enough.

I went through several lawyers in my custody battle before I found Bob Caplan, and the difference in representation was immediately noticeable. Bob spent countless hours fighting for both of my children, and the outcome exceeded my expectations. He was very invested in my case, didn’t make any promises that he couldn’t keep, and he genuinely cared about my family’s future. In the courtroom, he was able to accurately depict what was going on with my childrens’ mother and was able to win several cases that my ex had put against me. I have been through 3 Ohio lawyers and none of them can hold a candle to Bob’s professionalism and work ethic. He has over 20 years of experience fighting for Ohio families and it shows. I would definitely recommend Bob to anyone looking for a lawyer. He will see you through the most challenging time of your life and will be standing next to you when your problems are resolved.

Her staff was ever helpful and polite. If I needed an answer from Athena herself, then in fairly short order I would receive a call from her. I hired Ron about 7 years ago and he was prompt, professional and informative about the law. He made me feel secure about the decision I had to make. There was no pressure or sales pitch. Throughout the years, if I needed advice or legal help, he has always been available to talk. Recently I needed legal documents that were filed when I first hired him and he immediately responded. He sent me the documents that I needed and the fact that he knows me by name (very personable) means so much. I’ve moved to a different state but if I could bring him here, I would in a heart beat! I highly recommend Ron! Best attorney I’ve ever hired! Thanks Ron for being so genuine and not only representing your clients but caring about them as well!

I am so grateful I was referred to this Atrorney. He is sincere, compassionate, hard-working, and truly cares about helping people. I suffered trauma after an auto accident (hit hard from behind), which caused severe trauma to neck and to my thinking. I had difficulty performing my job in the banking, and also in the insurance industries (shortly after that has ladted more than two years), and felt the need to resign (after being bullied by management, trainers, and fellow staff), because of being the "slow kid on the block," and the "weekest link" in the office. I was losing my memory and the fast funtion I had always had. Due to my medical problems, after resigning, I struggled with unemployment on and off for a few years. My finances became a chaos. I kept thinking, "This next job will work for me," but it never did. I struggled for nearly two years, with different office jobs and even MORE bullying. Anyway, back to Ron...Ron was referred to me by CCCS of Columbus, as I was told by them that he has helped a lot of people in need of declaring bankruptcy. I never wanted to consider it, but he made it very simple for me to understand. I feel compared to other Attorneys, he is very fair in his pricing with tons of experience. I can honestly say that I have never met a kinder attorney (only had two in my life). Ron is very down to earth, easy to talk with, and I feel that he took a sincere interest in my concerns, and my desire to get back up in my life. It may sound "mushy" to some, but I pray a lot, and I truly believe that "Attorney Ron," as I call him, was sent to me by God. I was inundated with debt, and kept trying as hard as I could to get another office job, yet I struggled with my thinking and my neck each time, which made me look like an utter "Boob" every time (very frustrating, as I am actually a very brite person, intellectually). Anyway, I finally found a lower stress job as a retail clerk for less than half of what I was earning in each office position, and sso had no choice really but to declair bankruptcy. Ron has never made me feel belittled, or judged in this, and that impresses me as I hear most Attorneys are "power hungry" jerks. Ron is NOT! If you are looking for a good Attorney, in my opinion, Attorney Ron should be your guy. Don't worry, Folks, I get NO "referral fee." God as my Witness on that! He's amazing. When my case is complete, I am sending praise about Ron to the BBB as well as the Colymbus Bar Association. Thank you, Ron and may God bless you, richly.

During my time before my meeting with the creditors my son became seriously ill and I had to go out of the state for a few weeks. Jason always responded to my queries. Kelly Morgan is a very rare Attorney. He is kind, patient, a great listener, easy to communicate with, responsive and solution oriented. I reached out to Attorney Morgan after a business deal had gone awry, in search of a legal expert that could help my company. In my mind, help meant, “let’s go to court.” Attorney Morgan, however, with his calm and level-headed demeanor, talked me off the ledge with a suggestion to meet with the opposing party because of the relationship he and I have. The result of which positioned my friend and I to finish our deal and remain friends. All thanks to Attorney Morgan. Thank you, Kelly!

I was a client of Sean Cydrus. I paid him his fee in full and was told I could file anytime I would like.so I waited about 10 months and called his firm back to ask for a refund because I'm not really sure that I should file.or not. His employee Dan said that I shouldn't refund my retainer until I was absolutely sure. After listening to his 10 minute speech I said ok fine. We'll after another 10 months I decided I didn't need to file and I was near his office so I stopped in. His receptionist said that I need to write the request for refund. That was fine. So I emailed Sean. His response was that he needs a written letter not an email. Ok again. I wrote a letter and took it to the office. Sean then sent me an email in response saying he had no recollection of me or the transaction. I had moved and lost the receipt so I didn't have proof. And I am assuming he doesnt keep accurate records and doesn't remember very well. because he said he had never met me or talked to me before. Even though I sat in his office talking about Buick cars and his wife and how she is a veteran like myself. So I was told I never paid him he never met me. But I guess since he is a lawyer I should go away and not say anything about the money that was not returned. It was a horrible desicion to ever involve myself with a person like that.

Despite providing substantial documentation to support our claims, our concerns have been consistently disregarded by State Farm Fire and Casualty, leading us to contemplate submitting complaints against the attorney representing State Farm Fire and Casualty to The Ohio Board of Professional Conduct and The Office of Disciplinary Counsel. State Farm's actions have demonstrated a pattern of bad faith practices, including a failure to conduct a thorough investigation into our corporation and the unauthorized disclosure of confidential policy information to a third party without proper authorization. These actions have not only hindered the progress of our insurance claim but also infringed upon our rights as a small African American-owned business. Specifically, we would like to highlight the following grievances: 1. **Failure to Conduct a Proper Investigation**: We contend that State Farm neglected to conduct a comprehensive investigation into our insurance claim, focusing erroneously on individual personnel rather than engaging with all relevant stakeholders as required by Ohio regulations. 2. **Lack of Personal Contact**: Despite my pivotal role within the corporation and clear documentation listing my responsibilities, State Farm failed to make any direct contact with me during their investigation, breaching standard investigative protocols. 3. **Allegations of Discrimination**: Our status as an African American-owned business raises concerns of potential discrimination in State Farm's handling of our claim, with actions suggesting bias in their decision-making processes. Additionally State Farm Fire and Casualty company disclosed policy information to an unauthorized party without any consent from any officer, partner or shareholder of our corporation. (Attached evidence) Please view the attached sworn under oath statements attached specifically answer number 7 "7. Please admit or deny that you, Deborah McSurley, were given notice that on or about August 16, 2022, Claim Number 35-29N7-27R had been denied. ANSWER: Admit. I contacted State Farm’s corporate office and they advised me I was not a named insured and that the claim had been denied." 4. **Engagement with Black Lives Matter**: In response to perceived injustices, we have reached out to the Black Lives Matter organization to seek support and potentially raise awareness of our case within the community and beyond. 5. **Attempts to Resolve the Issue**: Multiple efforts to engage with State Farm's attorney, Lori Thomson, have been met with silence, prompting us to explore alternative avenues of addressing these issues. 6. **Potential Legal Actions**: Considering the gravity of the situation, we are prepared to pursue further legal actions against State Farm for their alleged misconduct, including filing formal complaints with relevant regulatory bodies. Sincerely, Mr. Marquis L. Kimble Director of Operations/Co-Founder The HCV Distribution Corporation Inc.

To the distinguished members of The Ohio Disciplinary Counsel, I wish to express my gratitude for the valuable services provided by your esteemed organization, which enables consumers to address professional misconduct. I am writing to share my experience regarding State Farm Fire and Casualty's attorney, Ms. Lori Thomson. I have personally experienced violations of my rights, including racial discrimination and defamation of character, at the hands of State Farm Fire and Casualty. Additionally, the rights of our protected class organization, The HCV Distribution Corporation, have been consistently disregarded by Ms. Thomson. The attached document provides evidence of State Farm Fire and casualty's breach of our company's private policy information by sharing it with an unauthorized third party. Despite clear violations of my rights and those of our company, Ms. Thomson has failed to respond adequately to our requests for resolution. She has also instructed us not to contact State Farm Fire and Casualty regarding these violations, yet she continues to disregard our attempts to seek a resolution. In February 2024, we sent a certified letter to State Farm Fire and Casualty seeking a settlement for these violations. Although it was received and signed for, it was ultimately disregarded. The response from Ms. Thomson included personal threats of criminal charges for our attempts to address these violations. I am reporting Ms. Thomson to the professional board of conduct due to suspected racial discriminatory actions, which parallel the treatment we have received from State Farm Fire and Casualty. Despite providing sworn evidence of the violations and rights infringements, Ms. Thomson has ignored our requests and resorted to threatening me personally with criminal charges, despite her client's violation of my personal rights and those of our corporation, The HCV Distribution Corporation Inc. We are urgently seeking your involvement to address these violations. I would like to emphasize that I am a registered minister in the state of Ohio and a sworn public servant notary in Lucas County with a clear background and record. It is both unprofessional and a violation of my rights for Ms. Thomson to threaten filing a police report against me for seeking answers and a resolution. We have filed complaints with various authorities, including The Ohio Department of Insurance, The Ohio Civil Rights Commission, The Ohio Attorney General's Office, The Ohio Supreme Court, The Ohio Office of Disciplinary Counsel, the Better Business Bureau, The Office of the Honorable Governor Mike DeWine, The Consumer Protection Bureau, The Federal Trade Commission, and the Office of Ohio Senator Sherrod Brown. I kindly ask for your immediate involvement and appropriate actions to address these actions committed against me personally and against our corporation, The HCV Distribution Corporation. I have attached relevant documents for your review and appreciate your assistance in addressing this serious and ongoing matter. Sincerely, Minister Marquis L. Kimble Public Servant, Co-Founder, Director of Operations The HCV Distribution Corporation INC.

David Abromowitz was the lawyer I hired to help set up my IV Hydration and Vitamin Infusion business. He charged me quadruple what was discussed (quoted me 3.5-5K - charged me over 20K and I paid a final amount of OVER 12k - astronomical amount) and took 3 times as long to complete the job. Three other nurses in my coaching group (NursePreneurs) had similar experiences with him and another nurse, coincidentally, came forward today from a different IV Hydration/Vitamin Infusion business reporting the same story. RNs - be warned! He is dishonest and will overcharge you! I notified the BBB but his response was "I'm sorry she didn't understand". You and I both know the truth, Mr. Abromowitz. You were intentionally dishonest. It's people like you that give lawyers a bad name. All these RNs trusted you, I trusted you. Mr. Spiroff was my attorney for my Chapter 13 bankruptcy, which I just recently finished. When I was at court at the beginning of my case, I saw another attorney come in who had to call out his clients' names, because he did not know who they were/what they looked like. Mr. Spiroff and his employees always remember me and remember details of my case. He was able to answer any questions that I had, and helped me through this difficult process. I would definitely recommend him to others.

I was without work and needed to file for relief under the Bankruptcy Laws. I was advised by the Staff at this firm to get a job and that they would work with me. During the time I was looking for a job, my truck was repossessed as well as my house went up for Sherriff's Auction. I was just barely able to save my house by filing a Chapter 13 at the very last minute. I should have been counseled to go Chapter 7, but it turns out that Mr. Spiroff Only does Chapter 13. I feel, and it is my opinion, that I was misled and given very poor advice. My original attorney was replaced suddenly on a Sunday Morning and I ended up working with Mr. Spiroff directly. I subsequently refiled a Chapter 13 with a much better attorney (in my opinion) and have been very happy with the results. I was very disappointed in the professionalism (or in my opinion, a lack of) with this firm.

What a Bankruptcy Lawyer Can Do for You

A bankruptcy lawyer specializes in helping individuals and businesses manage overwhelming debt by filing for bankruptcy or exploring alternatives to bankruptcy. They guide clients through the complex legal process of discharging or restructuring debts, represent them in court, and work to protect assets such as homes and cars. Bankruptcy lawyers can also help stop creditor harassment, wage garnishment, and foreclosures through bankruptcy protections.

If you're facing financial hardship, a bankruptcy lawyer can help you decide whether filing for bankruptcy is the right option and assist you through the legal process.

When Should I Hire a Bankruptcy Lawyer?

You should consider hiring a bankruptcy lawyer in the following situations:

  • Unmanageable debt: If you're unable to pay your bills and debts are piling up, a lawyer can help you explore options such as Chapter 7 or Chapter 13 bankruptcy.
  • Foreclosure or repossession: If your home is at risk of foreclosure or your vehicle is in danger of being repossessed, a bankruptcy lawyer can help you use bankruptcy protections to prevent this and potentially reorganize your debts.
  • Wage garnishment: If your wages are being garnished, filing for bankruptcy can stop garnishments and allow you to regain control of your finances.
  • Creditor harassment: If creditors are constantly calling or sending collection notices, a bankruptcy lawyer can stop these actions by filing for bankruptcy, which enacts an automatic stay that halts collection activities.
  • Small business debt: If your business is struggling with debt and cannot meet financial obligations, a lawyer can help you file for Chapter 11 (reorganization) or Chapter 7 (liquidation) bankruptcy.
  • Medical debt or credit card debt: If you have large amounts of unsecured debt like medical bills or credit card balances, a bankruptcy lawyer can help you seek relief through Chapter 7 or Chapter 13 bankruptcy.

Hiring a bankruptcy lawyer early in the process can prevent further financial damage and help you choose the best legal option for debt relief.

What Does a Bankruptcy Lawyer Do?

A bankruptcy lawyer provides a range of services to help individuals and businesses handle their debts. Their responsibilities often include:

  • Evaluating your financial situation: Assessing your income, assets, debts, and expenses to determine if bankruptcy is the right option and which type of bankruptcy (Chapter 7, Chapter 13, or Chapter 11) best suits your situation.
  • Filing bankruptcy petitions: Preparing and filing the necessary documents to initiate your bankruptcy case, ensuring that all legal requirements are met.
  • Stopping creditor harassment: Once the bankruptcy case is filed, an automatic stay is enacted, which stops creditors from pursuing collection efforts. A lawyer ensures this protection is applied immediately.
  • Representing you in court: Representing you in court proceedings, including meetings with creditors and any hearings related to your case.
  • Negotiating with creditors: In Chapter 13 or Chapter 11 bankruptcies, negotiating a repayment plan that restructures your debts and allows you to manage payments more effectively.
  • Advising on asset protection: Guiding you on how to protect certain assets, such as your home or retirement savings, through available bankruptcy exemptions.
  • Explaining the impact on your credit: Informing you about how bankruptcy will affect your credit and advising on steps to rebuild your credit post-bankruptcy.

How Are Bankruptcy Lawyers Paid?

Bankruptcy lawyers typically charge for their services in different ways depending on the complexity of the case and the type of bankruptcy being filed. Common payment structures include:

  • Flat fee: Many bankruptcy lawyers charge a flat fee for handling Chapter 7 or Chapter 13 bankruptcy cases. This fee usually covers the entire process, from preparing and filing paperwork to representing you in court.
  • Hourly rate: For more complex cases, such as Chapter 11 bankruptcy (often used by businesses), some lawyers charge an hourly rate. Hourly rates typically range from $150 to $500 or more.
  • Retainer: In cases where ongoing legal services are required, such as in Chapter 11 bankruptcies or complex Chapter 13 cases, a lawyer may request a retainer, which is an upfront payment billed against as the lawyer works on the case.

It’s important to discuss fees with your lawyer upfront, as bankruptcy law requires lawyers to disclose all fees and ensure they are reasonable and fair.

How Much Does a Bankruptcy Lawyer Cost?

The cost of hiring a bankruptcy lawyer varies depending on the type of bankruptcy and the complexity of the case. General cost estimates include:

  • Chapter 7 bankruptcy: For individuals, legal fees usually range from $1,000 to $3,500. This flat fee generally covers the entire process.
  • Chapter 13 bankruptcy: For individuals filing Chapter 13, legal fees typically range from $2,500 to $6,000. This cost is higher because of the additional work required to create and manage the repayment plan.
  • Chapter 11 bankruptcy (for businesses): Chapter 11 bankruptcy is more complex and usually more expensive, with legal fees ranging from $10,000 to $50,000 or more, depending on the size of the business and the complexity of the debt restructuring.
  • Filing fees: In addition to legal fees, there are also court filing fees, which are $338 for Chapter 7 and $313 for Chapter 13 as of 2024.

Always ask for a detailed cost estimate during your consultation to understand what services are included and whether payment plans are available.

Top Questions to Ask a Bankruptcy Lawyer

Before hiring a bankruptcy lawyer, it’s important to ask key questions to ensure they have the experience and knowledge to handle your case effectively. Key questions to ask include:

  1. What experience do you have with bankruptcy cases?
Ensure the lawyer has experience handling cases similar to yours, whether it's Chapter 7, Chapter 13, or Chapter 11 bankruptcy.
  2. How do you charge for your services?
Clarify whether the lawyer charges a flat fee or hourly rate, and ask for a detailed breakdown of costs, including filing fees and additional expenses.
  3. Which type of bankruptcy is best for me?
Ask the lawyer to explain whether Chapter 7, Chapter 13, or Chapter 11 is the best option based on your financial situation and long-term goals.
  4. What debts can be discharged?
Ask which of your debts will be forgiven through bankruptcy and which debts (such as certain taxes or student loans) may not be dischargeable.
  5. How long will the process take?
Bankruptcy cases can take time to resolve, so ask the lawyer how long they expect the process to last, from filing to discharge.
  6. Will I be able to keep my assets?
Ask if you will be able to keep important assets, such as your home or car, and what exemptions might apply.
  7. What happens after bankruptcy?
Ask about the impact of bankruptcy on your credit score and what steps you can take to rebuild your credit after the bankruptcy is finalized.

How to Check the Credibility of a Bankruptcy Lawyer

To ensure you are hiring a reputable bankruptcy lawyer, follow these steps to verify their credentials and track record:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed to practice law and has no history of disciplinary actions.
  • Look for bankruptcy experience: Review the lawyer’s website or professional profile to ensure they specialize in bankruptcy law and have successfully handled cases like yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and ability to handle bankruptcy cases.
  • Ask for references: A reputable lawyer should be able to provide references from past clients who have worked with them on bankruptcy matters.
  • Check for certifications or memberships: Look for lawyers who are members of organizations such as the National Association of Consumer Bankruptcy Attorneys (NACBA) or who have specialized bankruptcy law certifications.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with a bankruptcy lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • List of debts: Prepare a detailed list of all your debts, including credit cards, personal loans, medical bills, and any secured debts such as mortgages or car loans.
  • Income and expense records: Bring documents that show your current income, such as pay stubs or tax returns, and a list of your monthly expenses, including rent, utilities, and other essential costs.
  • Asset information: Provide information on any assets you own, such as your home, car, investments, or other valuable property.
  • Credit reports: If possible, bring copies of your credit reports to give the lawyer a clear view of your financial situation.
  • Questions for the lawyer: Prepare a list of questions you have about the bankruptcy process, the lawyer’s fees, and what to expect after filing for bankruptcy.

By preparing thoroughly for your consultation, you can help the lawyer assess your situation more effectively and provide the best possible legal advice tailored to your needs.
