My experience with the vast majority of attorneys was just plain "Icky." Alice however, delivered amazing service from her small unassuming office. I entered her office fully expecting and willing to pay a hefty bill. Instead, she steered me towards an option that was literally thousands of dollars less. And for icing on the cake, she prepared a motion on the spot that I could file with the court. She's a caring woman and great attorney.

I hired Alice to help me with my financial issues and she was the best! Always returned my calls, answered all of my questions, etc! She is a very caring person. After my first consultation, I felt like a giant weight was lifted off my shoulders. I found her based on reviews from Yelp. I would hire her again and again if needed!

After struggling with a large amount of unsecured debt, my wife and I decided we needed to consult an attorney. We selected Mr. Huebner based on proximity and good reviews. During our initial free consultation, Mr. Huebner was personable and made us feel at ease. We decided the best route for us was to file Chapter 7 as a couple. We were provided material to follow a step by step process. Our case had some elements that complicated the process but we were provided answers to all our questions. Most questions were answered by the material we were given, but when needed, Mr. Huebner kept us up to date and answered all our questions via emails and telephone conference since the COVID-19 crisis closed all offices. We have since filed and participated in the creditor's meeting without any problems and are looking forward to having our case completed. We highly recommend Mr. Huebner.

I made an appointment with Mr. Huebner to talk about my options for bankruptcy. He provided me a lot of information and explained the difference, while not pressuring me in any way. He allowed me time to think about how to proceed and was available if I had further questions. I did choose to move forward and could not have asked for a better attorney. He filed everything and keep me informed of the process. He was always available via e-mail if I had any questions or concerns. I was fully prepared for my court date and the process was seamless, due to his actions. I would HIGHLY recommend his services!!

I was being sued by a debt collector. I hired Mr. Foley for representation. Best thing I could have ever done. He explained everything to me in a professional way and worked diligently on my case. He got the case against me dismissed. He charged a very fair price and I am extremely happy.

I met with Mr. McBride as well as spoke to him on the phone 6 months later as a follow up. At no time did he discuss pay, he was more concerned with making sure that I understood what my options were and then recommended other attorney's when my needs were different than what he practices. Who does that these days? Mr. McBride does because he cares about people in need.

Mr. McBride took a great deal of time to inform me of several things I wasn't aware of, which gave me a lot of encouragement. He was extremely professional, on point, and very pleasant. There's an aspect possibly outside his specialties that may require me to be referred elsewhere, but if I can work with him, I certainly plan to do so!

As a result of closing my business, I was left liable of significant business debt that I had personally guaranteed. Mr. Bride and his staff walked me and my wife through our options and navigated our Chapter 7 bankruptcy filing. He was very prompt answering questions and providing great advice. Even after the discharge, he has remained a valuable resource and shows his desire to help his clients.

I was involved in an auto accident where an inattentive driver pulled a U-turn across traffic striking and totaling my classic corvette and injuring my back. At first, I tried to work directly with their insurance but it was evident after two phone calls that they were not willing to compensate me for the value of my car nor my injuries. I contacted Rich at Trial Tribe and he walked me thru the process of obtaining a reimbursement for the actual value of my car. In addition, he provided recommendations for rehabilitation and examination services and obtained a fair compensation for my injuries. I am grateful to have the tribe on my side and fully endorse Rich and his staff for the outstanding service they provided

Terrible experience with Sarah particularly. My coparent withheld my ability to see my infant on multiple occasions, Sarah charged me for documentation that didn’t improve or remedy the situation; the coparent was not held accountable whatsoever. The response I received from filing the expensive paperwork Sarah’s firm advised was my coparent filing a false police report saying their vehicle was broken into implicating me for which I had proofs were 100% false (the vehicle was NOT broken into or tampered with and I was nowhere remotely close to area it was located at the time in question). I was required to meet at police stations following that accusation - know what the coparent showed up in?? The undamaged vehicle in question on the DAY FOLLOWING the accusation. (For the record, it’s supposed to be a crime in Texas to file a false police report). Again, none of it mattered when we *never made it to court* — saddled with $25k worth of representation debt (when the standard for family court settlements is ~$11k to my understanding), a hefty child support amount, and ONE day more than a standard possession as a non-custodial parent. I wrote her an angry, frustrated “who do you work for here?” email to which she felt the need to call me personally at 3 am having me tell her I thought she was the perfect person to help me with my situation or she would be resigning my case. Should’ve dropped her then and there. I’m an honorably discharged veteran, a former federal employee, an Eagle Scout, etc. I was up against someone with a an assault record. Continuously told her firm I wanted a 50/50 coparenting agreement and wasn’t trying to skirt child support because I didn’t think it would help my case. Not what was presented at the 2-3 court days we were supposed to have, I took off work for and made special arrangements for but didn’t actually “take.” We never made it to court - ended up in mediation with a RETIRED judge who didn’t read or pay any attention to the facts of the case whatsoever as his blanketed opening statement at mediation was - “I don’t care what the facts are here, I’m not taking any child away from his mother short of something drug related” - a determination based solely based on gender/sex. I did 90% of the talking during mediation; Sarah and her assistant sat there and barely spoke. I’m not an attorney. I didn’t get paid $25k to represent someone. Had no idea what I was doing. Sarah worked with the coparent’s attorney and came up with a 30+ page document that provides more coverage for my co-parent than me and I was billed for it; co-parent walked away from the case on a pro-bono basis. If I mess up, jail time and fines. If the co-parent messes up, there would be hefty court fees for me to enforce anything and then next to 0 repercussions for them. My coparent has been so empowered by how easy it was to walk over me that she has continued to violate the agreement (never missed a day with my son, coparent’s missed a plethora; coparent doesn’t send written updates when our circumstances change, I’ve had to; coparent moved outside the agreed upon living area, repercussions are supposed to be me becoming custodial, NOPE; coparent filed 2 more false police reports since implicating but not naming me to avoid harassment charges, nothing stopping them). If you’re a single father out there for any reason and are looking for help, know upfront no one (courts, attorneys, etc) cares about the dad’s rights or involvement in a child’s life. Since the resolution, I’ve struggled to make ends meet between the debts and my obligations. Think when I’m struggling to this degree that I can afford or would even bother going back to court to have my coparent “held accountable” for the violations?? Steer clear of Sarah’s firm; felt massively overcharged for the minimal support or intervention I received from them.

I would like to be more specific but there is not enough space for that. I will be brief and say that I feel I could have done as well without this attorney. Mr Thompson and his staff should learn to take the time to listen effectively and compassionately BEFORE the client is upset, and to not sound like they are rushing you off the phone when you call with a question. Mr. Thompson was mostly condescending with a sprinkle of sugar and I don't feel that he came close to earning the $6k that he received from my backpay. Just sayin'!!

We have not had a good experience with Higgins and Associates at all. BUYER BEWARE. Do yourself a favor and run AWAY! We have been involved in a grueling, time wasting, stressful, chapter 13 bankruptcy with this firm. Our case should have been over and closed out already, but due to the mishandling of our case it is still in limbo after 5 years. We have lost all the equity in our home due to the negligence of this firm. Yes, due to THEIR negligence. We know good & well you have to pay to keep your assets, but what their firm promises in the beginning & what they actually DO after they get your money are two entirely different things - then they make no effort to correct anything or negotiate in their client’s best interest – only their own. Their promises have not been kept and they have misrepresented things over and over again to us. They have not acted with any loyalty or in our best interest at all in regards to an issue we were promised in the beginning would be worked out appropriately. They are nothing but a cookie cutter firm that wants the easy way out. If you need a firm that will work hard to negotiate for you & be on your side, this firm is NOT it. I recently found out even the trustee's office gets tons of complaints about this firm so how anyone has had a good experience with these people is a surprise. The financial damages they have caused us far exceeds what they have charged in attorney's fees. Shame on you, Higgins and Associates for costing us over 5 years worth of stress, time wasted and thousands of dollars!

The fact that they say it was a mistake with that statement, that means internally one of your lawyers wrote that out and thought it was a good idea because you wouldn't have accidentally sent it if it wasn't written or printed. Honestly, get a law firm that treats people like humans. Also, we need to know the lawyer's name who wrote that paper out. Protecting this person is disgusting. You should be blasting this person even if it was a mistake, which again, if it wasn't written or printed, you couldn't have made that mistake, which means at one point you thought it was a good idea.

What a Bankruptcy Lawyer Can Do for You

A bankruptcy lawyer specializes in helping individuals and businesses manage overwhelming debt by filing for bankruptcy or exploring alternatives to bankruptcy. They guide clients through the complex legal process of discharging or restructuring debts, represent them in court, and work to protect assets such as homes and cars. Bankruptcy lawyers can also help stop creditor harassment, wage garnishment, and foreclosures through bankruptcy protections.

If you're facing financial hardship, a bankruptcy lawyer can help you decide whether filing for bankruptcy is the right option and assist you through the legal process.

When Should I Hire a Bankruptcy Lawyer?

You should consider hiring a bankruptcy lawyer in the following situations:

  • Unmanageable debt: If you're unable to pay your bills and debts are piling up, a lawyer can help you explore options such as Chapter 7 or Chapter 13 bankruptcy.
  • Foreclosure or repossession: If your home is at risk of foreclosure or your vehicle is in danger of being repossessed, a bankruptcy lawyer can help you use bankruptcy protections to prevent this and potentially reorganize your debts.
  • Wage garnishment: If your wages are being garnished, filing for bankruptcy can stop garnishments and allow you to regain control of your finances.
  • Creditor harassment: If creditors are constantly calling or sending collection notices, a bankruptcy lawyer can stop these actions by filing for bankruptcy, which enacts an automatic stay that halts collection activities.
  • Small business debt: If your business is struggling with debt and cannot meet financial obligations, a lawyer can help you file for Chapter 11 (reorganization) or Chapter 7 (liquidation) bankruptcy.
  • Medical debt or credit card debt: If you have large amounts of unsecured debt like medical bills or credit card balances, a bankruptcy lawyer can help you seek relief through Chapter 7 or Chapter 13 bankruptcy.

Hiring a bankruptcy lawyer early in the process can prevent further financial damage and help you choose the best legal option for debt relief.

What Does a Bankruptcy Lawyer Do?

A bankruptcy lawyer provides a range of services to help individuals and businesses handle their debts. Their responsibilities often include:

  • Evaluating your financial situation: Assessing your income, assets, debts, and expenses to determine if bankruptcy is the right option and which type of bankruptcy (Chapter 7, Chapter 13, or Chapter 11) best suits your situation.
  • Filing bankruptcy petitions: Preparing and filing the necessary documents to initiate your bankruptcy case, ensuring that all legal requirements are met.
  • Stopping creditor harassment: Once the bankruptcy case is filed, an automatic stay is enacted, which stops creditors from pursuing collection efforts. A lawyer ensures this protection is applied immediately.
  • Representing you in court: Representing you in court proceedings, including meetings with creditors and any hearings related to your case.
  • Negotiating with creditors: In Chapter 13 or Chapter 11 bankruptcies, negotiating a repayment plan that restructures your debts and allows you to manage payments more effectively.
  • Advising on asset protection: Guiding you on how to protect certain assets, such as your home or retirement savings, through available bankruptcy exemptions.
  • Explaining the impact on your credit: Informing you about how bankruptcy will affect your credit and advising on steps to rebuild your credit post-bankruptcy.

How Are Bankruptcy Lawyers Paid?

Bankruptcy lawyers typically charge for their services in different ways depending on the complexity of the case and the type of bankruptcy being filed. Common payment structures include:

  • Flat fee: Many bankruptcy lawyers charge a flat fee for handling Chapter 7 or Chapter 13 bankruptcy cases. This fee usually covers the entire process, from preparing and filing paperwork to representing you in court.
  • Hourly rate: For more complex cases, such as Chapter 11 bankruptcy (often used by businesses), some lawyers charge an hourly rate. Hourly rates typically range from $150 to $500 or more.
  • Retainer: In cases where ongoing legal services are required, such as in Chapter 11 bankruptcies or complex Chapter 13 cases, a lawyer may request a retainer, which is an upfront payment billed against as the lawyer works on the case.

It’s important to discuss fees with your lawyer upfront, as bankruptcy law requires lawyers to disclose all fees and ensure they are reasonable and fair.

How Much Does a Bankruptcy Lawyer Cost?

The cost of hiring a bankruptcy lawyer varies depending on the type of bankruptcy and the complexity of the case. General cost estimates include:

  • Chapter 7 bankruptcy: For individuals, legal fees usually range from $1,000 to $3,500. This flat fee generally covers the entire process.
  • Chapter 13 bankruptcy: For individuals filing Chapter 13, legal fees typically range from $2,500 to $6,000. This cost is higher because of the additional work required to create and manage the repayment plan.
  • Chapter 11 bankruptcy (for businesses): Chapter 11 bankruptcy is more complex and usually more expensive, with legal fees ranging from $10,000 to $50,000 or more, depending on the size of the business and the complexity of the debt restructuring.
  • Filing fees: In addition to legal fees, there are also court filing fees, which are $338 for Chapter 7 and $313 for Chapter 13 as of 2024.

Always ask for a detailed cost estimate during your consultation to understand what services are included and whether payment plans are available.

Top Questions to Ask a Bankruptcy Lawyer

Before hiring a bankruptcy lawyer, it’s important to ask key questions to ensure they have the experience and knowledge to handle your case effectively. Key questions to ask include:

  1. What experience do you have with bankruptcy cases?
Ensure the lawyer has experience handling cases similar to yours, whether it's Chapter 7, Chapter 13, or Chapter 11 bankruptcy.
  2. How do you charge for your services?
Clarify whether the lawyer charges a flat fee or hourly rate, and ask for a detailed breakdown of costs, including filing fees and additional expenses.
  3. Which type of bankruptcy is best for me?
Ask the lawyer to explain whether Chapter 7, Chapter 13, or Chapter 11 is the best option based on your financial situation and long-term goals.
  4. What debts can be discharged?
Ask which of your debts will be forgiven through bankruptcy and which debts (such as certain taxes or student loans) may not be dischargeable.
  5. How long will the process take?
Bankruptcy cases can take time to resolve, so ask the lawyer how long they expect the process to last, from filing to discharge.
  6. Will I be able to keep my assets?
Ask if you will be able to keep important assets, such as your home or car, and what exemptions might apply.
  7. What happens after bankruptcy?
Ask about the impact of bankruptcy on your credit score and what steps you can take to rebuild your credit after the bankruptcy is finalized.

How to Check the Credibility of a Bankruptcy Lawyer

To ensure you are hiring a reputable bankruptcy lawyer, follow these steps to verify their credentials and track record:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed to practice law and has no history of disciplinary actions.
  • Look for bankruptcy experience: Review the lawyer’s website or professional profile to ensure they specialize in bankruptcy law and have successfully handled cases like yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and ability to handle bankruptcy cases.
  • Ask for references: A reputable lawyer should be able to provide references from past clients who have worked with them on bankruptcy matters.
  • Check for certifications or memberships: Look for lawyers who are members of organizations such as the National Association of Consumer Bankruptcy Attorneys (NACBA) or who have specialized bankruptcy law certifications.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with a bankruptcy lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • List of debts: Prepare a detailed list of all your debts, including credit cards, personal loans, medical bills, and any secured debts such as mortgages or car loans.
  • Income and expense records: Bring documents that show your current income, such as pay stubs or tax returns, and a list of your monthly expenses, including rent, utilities, and other essential costs.
  • Asset information: Provide information on any assets you own, such as your home, car, investments, or other valuable property.
  • Credit reports: If possible, bring copies of your credit reports to give the lawyer a clear view of your financial situation.
  • Questions for the lawyer: Prepare a list of questions you have about the bankruptcy process, the lawyer’s fees, and what to expect after filing for bankruptcy.

By preparing thoroughly for your consultation, you can help the lawyer assess your situation more effectively and provide the best possible legal advice tailored to your needs.
