John is caring, and very skilled and his staff is wonderful to work with. They helped ensure that things moved along accordingly, and we were in piles of IRS debt that was incredibly intimidating and scary to work with but they all made it easy and helped us figure out a game plan that was affordable and something we could accomplish. I appreciate all that you do Sterbick and Associates!! Thanks again so much!!

Did what he would say he was going to do, when he said he was going to do it. Sometimes it's hard to get a call back, but with John, most of the time he answered the phone himself and he always took my calls. I felt like he truly cared about me and I wasn't just a number.

Brett Wittner is the only attorney I have sent people to for the last 20+ years when it comes to bankruptcy. His fees are the lowest I’ve seen with no less professionalism. Brett takes interest and understands how easy it is to get into situations so you don’t leave feeling like a loser. I will forever refer him to people and will always continue using him myself if need be. I consider Brett a friend/family and that’s how he treats my family. Thank you Brett for being so awesome over the years. We appreciate you and are forever grateful. Always, The Kalii Family

Working with Brett was a very easy, smooth process. Even when we threw obstacles at him he was quick to offer us our options, his advice, full understanding of our concerns and a quick solution. I especially appreciate that we did not feel pressured or uncomfortable during any part of our experience. I have referred/recommended him already and will continue to do so.

Let me start by saying that Mr. Wilson was a true life saver! I was at the end of my rope before I met him. He is very helpful, knowledgeable, reasonably priced, and flexible. Bankruptcy was something I had never considered and I was afraid because I've heard horrible stories... When I walked out of his office I felt at peace for the first time in years!!! I'm extremely grateful and I even got to keep my assets. Thanks Tim!

I called to request a consultation late on a Friday, the attorney was not available at that time. He called me back first thing on the following Saturday. I was really surprised as I had not expected to hear back until Monday. Tim provided me with suggestions as to what I should do and also provided me with the needed steps to take to move through the dispute on my own. He said that hiring an attorney would be more than the amount I was dealing with in regards to the dispute. His explanation was great and made me realize that this wasn't something that I had to freak out about and that it could be dealt with regardless of the outcome. He also didn't make me feel bad about the situation, which I appreciated. If for some reason I need to file bankruptcy in the future (I hope not) or if I know someone who is in need of a bankruptcy attorney, Tim will be who I go to or suggest to others.

James helped us through bankruptcy. Obviously that was not a great time for us, just about everything that could go wrong did with the development and construction of our home. He helped us through our financial nightmare. The wife of a co-worker, a local Olympia attorney, had highly recommended him and to this day I'm so glad I checked with her. He gracefully guided us through what could have been a very uncomfortable and daunting process. From the very beginning we knew we were in good hands. He listened attentively and clearly explained every step of the process, but most importantly, each time we communicated I knew He would follow through. I could go on and on, ...I was truly amazed. Hecexemplifies the best of your profession ...and I don't pass out compliments lightly.

I personally spoke with 10-12 attorneys when I began my search for an attorney that could represent me in a family estate dispute. When I spoke with Mr. Rosenblum, I knew immediately that he was the one to handle my problem. Even before I hired him, he spent much time on the phone with me and also met with my husband and I in person at his office to get a better grasp of the problem at hand. Not once, did we feel rushed... We hired him, and the all through the process of the dispute, right up until the very last minute of the estate closing, he was right by our side... His attention to detail is top notch and truly cares about his clients; not only now, but in their future. All the documents that he prepared for us were clear and concise and I feel fully protects us and our future, and leaves no room for question or error. While I was not sure about hiring a large law firm and getting "lost in the shuffle", nothing could be farther from the truth. Mr. Rosenblum and his staff made me feel like I was his only client. On top of all of this, he is extremely quick to respond to his clients; whether it be an e-mail at 1:00 am or answering a phone call from me, at his office, on the holidays. I always knew that I could get him on the phone if necessary, as problems arose. This was a great comfort at this incredibly stressful time. The very confusing laws of probate do not phase him. He knows the law inside and out. Thank you Mr. Rosenblum!!!!! :)

Jada did an amazing job helping me through some of the hardest times in my life. I was going through a divorce and had 2 previous attorneys take payment without following through. She took my divorce case 9 months in and helped me gain a significant amount of custody of my son. Before working with her, I was full of gloom and felt that I was fighting an uphill battle. Christy Carpenter is an absolutely amazing person, if it wasn't for her I'd still be married. From the first day I talked to her I never questioned whether she was right for me, I knew she would fight to help me with my case and she has every step of the way. Christy always kept me informed of what was going on and she always returned my phone calls or texts as soon as possible. There are those in Christy's profession that are in it for the money and will draw out your case as long as possible and charge you as much as they can. Christy Carpenter is not one of them, she will fight tooth and nail to help you while working with you on your finances. I highly recommend Christy Carpenter to help you with your divorce.

Spent over 15k for hillary dawn to draft and file initial separation papers and her paralegal filled it out incorrectly and i was charged for that. After that i was charged monthly for her and the paralegal chat briefly in one to one i guess, but no action or communication. 2 continuations literally no action over a year, despite my ex not contesting. Complete waste of money I really needed as a single mom. All i asked for child support so i could aid to leave an abusive situation. She drafted 2 two temp orders and charged me but never filed anything. Heard nothing unless i reached out.

When I think of my time with Cindy Wysocki, Esq., tears of deep gratitude literally come to my eyes as I recall her strength and gentleness, her humor and sharp critical thinking, her willingness to get into the ultimate fighting cage we call the judicial system and her reluctance to throw a punch, and her commitment to fairness and open-hearted compassion. To the lawyer or firm across the virtual table, Cindy must seem formidable and relentless. To me as her client-friend, she was comforting, encouraging, and grounding. I never had to yield my voice or stuff down my questions. AND, Cindy held my concerns and fears, my heightened emotions and (sometimes) clear intuitive insights respectfully while guiding them in positive, productive ways. And best of all, Cindy knew me well enough at the end of a grueling process to be able to then assist and guide me in my needs to safeguard my estate and financial assets to be sure to leave them secure for the ones I love the most. Above all, I am forever grateful to Cindy for accompanying me as a caring fellow human being during one of the most devastating times of my personal life journey. She stayed by my side through unprecedented conditions, with unconditional care and concern, as one of the few who did in my life. Cindy is a legal Bodhisattva!!

this attorney was part of a bankruptcy firm I went to after I was divorced in 2012. One of my main concerns was what I was court ordered to pay my ex. I asked this attorney if I declared chapter 7 if it would discharge all debt and she assured me it would. However I found out now that it never discharged debts owed during dissolution, so ironically it discharged a debt I had been paying on but not the ex and so now I am facing even more financial and dissolution hurdles.

I RETAINED HELEN TO REPRESENT ME ON A CHAPTER 13 BANKRUPTCY. SHE MADE PROMISES OF DEBTS THAT WOULD BE INCLUDED THAT WERE NOT AND ULTIMATELY COST ME MORE TIME AND MONEY TO ATTORNEYS TO ASSURE MY FINANCIAL FUTURE WAS ACCOMPLISHED WITH THE SET PURPOSE OF FILING BANKRUPTCY. I SENT DOCUMENTS MULTIPLE TIMES THAT WERE LOST, HAD TO RESEND THOUGH I HAD CONFIRMATION. WE WERE IN COURT AND SHE WAS TOLD OF SEVERAL MISTAKES IN HER PETITION THAT NEEDED TO BE CORRECTED BEFORE MY CASE COULD MOVE FORWARD. MOST DISTURBING IS SHE DID NOT ADVOCATE FOR WHAT SHE PROMISED. AND THEN UP AND LEFT THE LAW FIRM SHE WAS WORKING AT WITHOUT NOTICE.

What a Bankruptcy Lawyer Can Do for You

A bankruptcy lawyer specializes in helping individuals and businesses manage overwhelming debt by filing for bankruptcy or exploring alternatives to bankruptcy. They guide clients through the complex legal process of discharging or restructuring debts, represent them in court, and work to protect assets such as homes and cars. Bankruptcy lawyers can also help stop creditor harassment, wage garnishment, and foreclosures through bankruptcy protections.

If you're facing financial hardship, a bankruptcy lawyer can help you decide whether filing for bankruptcy is the right option and assist you through the legal process.

When Should I Hire a Bankruptcy Lawyer?

You should consider hiring a bankruptcy lawyer in the following situations:

  • Unmanageable debt: If you're unable to pay your bills and debts are piling up, a lawyer can help you explore options such as Chapter 7 or Chapter 13 bankruptcy.
  • Foreclosure or repossession: If your home is at risk of foreclosure or your vehicle is in danger of being repossessed, a bankruptcy lawyer can help you use bankruptcy protections to prevent this and potentially reorganize your debts.
  • Wage garnishment: If your wages are being garnished, filing for bankruptcy can stop garnishments and allow you to regain control of your finances.
  • Creditor harassment: If creditors are constantly calling or sending collection notices, a bankruptcy lawyer can stop these actions by filing for bankruptcy, which enacts an automatic stay that halts collection activities.
  • Small business debt: If your business is struggling with debt and cannot meet financial obligations, a lawyer can help you file for Chapter 11 (reorganization) or Chapter 7 (liquidation) bankruptcy.
  • Medical debt or credit card debt: If you have large amounts of unsecured debt like medical bills or credit card balances, a bankruptcy lawyer can help you seek relief through Chapter 7 or Chapter 13 bankruptcy.

Hiring a bankruptcy lawyer early in the process can prevent further financial damage and help you choose the best legal option for debt relief.

What Does a Bankruptcy Lawyer Do?

A bankruptcy lawyer provides a range of services to help individuals and businesses handle their debts. Their responsibilities often include:

  • Evaluating your financial situation: Assessing your income, assets, debts, and expenses to determine if bankruptcy is the right option and which type of bankruptcy (Chapter 7, Chapter 13, or Chapter 11) best suits your situation.
  • Filing bankruptcy petitions: Preparing and filing the necessary documents to initiate your bankruptcy case, ensuring that all legal requirements are met.
  • Stopping creditor harassment: Once the bankruptcy case is filed, an automatic stay is enacted, which stops creditors from pursuing collection efforts. A lawyer ensures this protection is applied immediately.
  • Representing you in court: Representing you in court proceedings, including meetings with creditors and any hearings related to your case.
  • Negotiating with creditors: In Chapter 13 or Chapter 11 bankruptcies, negotiating a repayment plan that restructures your debts and allows you to manage payments more effectively.
  • Advising on asset protection: Guiding you on how to protect certain assets, such as your home or retirement savings, through available bankruptcy exemptions.
  • Explaining the impact on your credit: Informing you about how bankruptcy will affect your credit and advising on steps to rebuild your credit post-bankruptcy.

How Are Bankruptcy Lawyers Paid?

Bankruptcy lawyers typically charge for their services in different ways depending on the complexity of the case and the type of bankruptcy being filed. Common payment structures include:

  • Flat fee: Many bankruptcy lawyers charge a flat fee for handling Chapter 7 or Chapter 13 bankruptcy cases. This fee usually covers the entire process, from preparing and filing paperwork to representing you in court.
  • Hourly rate: For more complex cases, such as Chapter 11 bankruptcy (often used by businesses), some lawyers charge an hourly rate. Hourly rates typically range from $150 to $500 or more.
  • Retainer: In cases where ongoing legal services are required, such as in Chapter 11 bankruptcies or complex Chapter 13 cases, a lawyer may request a retainer, which is an upfront payment billed against as the lawyer works on the case.

It’s important to discuss fees with your lawyer upfront, as bankruptcy law requires lawyers to disclose all fees and ensure they are reasonable and fair.

How Much Does a Bankruptcy Lawyer Cost?

The cost of hiring a bankruptcy lawyer varies depending on the type of bankruptcy and the complexity of the case. General cost estimates include:

  • Chapter 7 bankruptcy: For individuals, legal fees usually range from $1,000 to $3,500. This flat fee generally covers the entire process.
  • Chapter 13 bankruptcy: For individuals filing Chapter 13, legal fees typically range from $2,500 to $6,000. This cost is higher because of the additional work required to create and manage the repayment plan.
  • Chapter 11 bankruptcy (for businesses): Chapter 11 bankruptcy is more complex and usually more expensive, with legal fees ranging from $10,000 to $50,000 or more, depending on the size of the business and the complexity of the debt restructuring.
  • Filing fees: In addition to legal fees, there are also court filing fees, which are $338 for Chapter 7 and $313 for Chapter 13 as of 2024.

Always ask for a detailed cost estimate during your consultation to understand what services are included and whether payment plans are available.

Top Questions to Ask a Bankruptcy Lawyer

Before hiring a bankruptcy lawyer, it’s important to ask key questions to ensure they have the experience and knowledge to handle your case effectively. Key questions to ask include:

  1. What experience do you have with bankruptcy cases?
Ensure the lawyer has experience handling cases similar to yours, whether it's Chapter 7, Chapter 13, or Chapter 11 bankruptcy.
  2. How do you charge for your services?
Clarify whether the lawyer charges a flat fee or hourly rate, and ask for a detailed breakdown of costs, including filing fees and additional expenses.
  3. Which type of bankruptcy is best for me?
Ask the lawyer to explain whether Chapter 7, Chapter 13, or Chapter 11 is the best option based on your financial situation and long-term goals.
  4. What debts can be discharged?
Ask which of your debts will be forgiven through bankruptcy and which debts (such as certain taxes or student loans) may not be dischargeable.
  5. How long will the process take?
Bankruptcy cases can take time to resolve, so ask the lawyer how long they expect the process to last, from filing to discharge.
  6. Will I be able to keep my assets?
Ask if you will be able to keep important assets, such as your home or car, and what exemptions might apply.
  7. What happens after bankruptcy?
Ask about the impact of bankruptcy on your credit score and what steps you can take to rebuild your credit after the bankruptcy is finalized.

How to Check the Credibility of a Bankruptcy Lawyer

To ensure you are hiring a reputable bankruptcy lawyer, follow these steps to verify their credentials and track record:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed to practice law and has no history of disciplinary actions.
  • Look for bankruptcy experience: Review the lawyer’s website or professional profile to ensure they specialize in bankruptcy law and have successfully handled cases like yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and ability to handle bankruptcy cases.
  • Ask for references: A reputable lawyer should be able to provide references from past clients who have worked with them on bankruptcy matters.
  • Check for certifications or memberships: Look for lawyers who are members of organizations such as the National Association of Consumer Bankruptcy Attorneys (NACBA) or who have specialized bankruptcy law certifications.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with a bankruptcy lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • List of debts: Prepare a detailed list of all your debts, including credit cards, personal loans, medical bills, and any secured debts such as mortgages or car loans.
  • Income and expense records: Bring documents that show your current income, such as pay stubs or tax returns, and a list of your monthly expenses, including rent, utilities, and other essential costs.
  • Asset information: Provide information on any assets you own, such as your home, car, investments, or other valuable property.
  • Credit reports: If possible, bring copies of your credit reports to give the lawyer a clear view of your financial situation.
  • Questions for the lawyer: Prepare a list of questions you have about the bankruptcy process, the lawyer’s fees, and what to expect after filing for bankruptcy.

By preparing thoroughly for your consultation, you can help the lawyer assess your situation more effectively and provide the best possible legal advice tailored to your needs.
