Helen was my attorney during my divorce. She listened to my concerns and fought for everything I needed in order to keep my house and raise my two children. She was exceptional and went above and beyond what I thought an attorney would need to do. She was always available to answer questions and guided me through the process of regaining my independence. I would definitely recommend Helen Wallace to anyone in need of a lawyer.

I have known Helen professionally for several years, and have always found her to be highly competent in her work, and extremely thorough. I have worked with Julie and her excellent staff (on and off) for the past 3 years to resolve my child custody case. I could not ask for a more professional and genuinely caring group of people who were always there for me when I needed them and made me feel like my case was a priority. I feel fortunate to have such a great lawyer looking out for me and my family, and I plan on having Julie represent us in the future.

Justin and I sat down originally once I decided to attempt shared parenting. He was very helpful with discussing the process that needed to be done and the proper steps in doing so. Him and I always kept an open communication during this process which made it easier to respond to certain steps during this. He was overall a Great Person to work with and Fought for what he felt was right for the children in the process. Him and I put together a great case and in the end I (father) was awarded resident parent for my 2 children. Would recommend him to anyone that is going through the same thing I went through. Thanks Again Justin.

Justin represented us in a custody battle over our non-biological granddaughter. We received full custody. Justin was knowledgeable, professional, but, most importantly he truly cared. Justin listened to our input but was willing to stand his ground when he thought a different approach was in our best, overall interest. We followed his lead, we trusted his judgement and knowledge and the result speaks for itself. We would HIGHLY recommend Justin, not just for Custody matters, but any legal matter that he is qualified to pursue.

Attorney James Kirkland exceeded in all areas throughout the duration of my custody case. I'm an Ohio native, but relocated to Western Massachusetts, my sons lived in Ohio, but yearn to be with me. Although me residing out of State made the case complicated alone, Attorney Kirkland listened to my story and accepted the challenge. He was very organized, focus and reviewed every single detail and aspect that went into the case. He was not afraid to take the steps necessary to get results If there is one thing that I am sure of, is that he KNOWS THE LAW, and he knows it well. What made Kirkland unique was his approach. He is respectful, honest, thorough but very Family Orientated. I highly recommend him to anyone in need of legal representation, surrounding family law.

I usually never write a review or give excellent ratings unless it well worth it. I am not the type of guy that logs on and reviews product or services. This, however, is my exception. I was in the Marine Corps when Mr. Kirkland took my divorce case in 2012. I needed a lawyer to represent me in court because I could not attend any hearings, due to my military obligations. Mr. Kirkland not only took my case (and even though we didn't have a chance to meet face to face) he was able to fully complete my divorce decree in court. Fast forward two years later. I had another crazy summons by the ex-wife (figures). Once again I need a lawyer and decided to go back to Mr. Kirkland for legal advice. Not only did he remember me after two years, but he once again took my case and fought for me. Mr. Kirkland is an excellent lawyer at a reasonable price, and I think the most important part is that, he is military friendly. He always gets back to you and keeps you informed throughout the whole proceedings. To all my military friends out there, I highly recommend him. Juan Semper Fi

I have been very pleased w/the Kirkland atty firm. The entire staff is very helpful, courteous and understanding while maintaining a professional atmosphere. Mr Kirkland himself is very open and straight forward. He answers questions in a timely manner, explains when necessary, prepares in advance and is very thorough. I have been working w/Mr. Kirkland and his office since 2011 as we walk thru a rather contentious divorce case. Both in his office and in the courtroom, Mr. Kirkland is attentive and efficient.

I was referred to Josh Carter by a friend who hired Mr. Carter plan his estate. I went with Mr. Carter based not only on my firend's satisfaction and referral, but also based on the fact I knew how much it would cost before meeting with him. Mr. Carter's fees are published on his web site, and he stuck to his fee and never billed me again....even though my case was complex and resulted in a contested trial. Additionally, Mr. Carter always returned my calls which was different from my previous lawyer. I would definitely recommend Mr. Carter for domestic relations cases.

If you're looking for an incredible attorney who will advocate for you, look no further. Not only does Mr. Malocu have decades of experience litigating cases for thousands of clients, he also has experience as a sit in magistrate. While he understands how magistrates and prosecutors think, he is also very well respected in court rooms all over the Miami Valley. I've dealt with numerous attorneys over the years for minor traffic violations, divorce and custody matters and not one holds a handle to Frank. Shockingly, he's very reasonably priced as well. Ask yourself, what kind of attorney will call you at 7am or 9pm, or on weekends when he's out of town visiting family? An attorney who deeply cares for you. This. Is. The. Guy. Folks.

Mr. Kruse was always straight with me on my options. I first met with him when considering divorce and I didn’t follow his advice and failed to file sooner. So I hired him when I needed to fix things. He understood my case and my concerns and continued answering questions after our case was closed. He took ownership when his paralegal made a mistake (her replacement was great!) and he dealt with abuse and drama from my ex’s attorney with complete professionalism. I hope I don’t need to, but I’ll hire him again if I need further action on our latest decision.

I met Brian last year, and the circumstances of my case were very hard and difficult to deal with. Let me say this, Brian was easy to work with, felt like he had my back from the day I retained his services. Let me give you a piece of advice when dealing with Brian, always tell the truth no matter what. If you give this man and his firm the truth and information he will fight for you and do the best job he can! I never lied to Brian i told him the truth about everything. He assured me over and over to trust him and while sometimes it was hard, Brian and his firm knew what they were doing. He assured me it was a marathon and not a sprint but to stay the course. It was the longest 12 months of my life but being a religious man and having Faith in God and in Brian I knew that I would be okay. As opposing counsel and my ex tried to use false restraining orders to gain the upperhand over and over, Brian tore them up and showed the truth! The thing that I admired about Brian that you don't see hardly anymore is that he would never take a shortcut or lie to gain the upperhand. He did it the old fashion way, hardwork and using the truth! He never once tried to take a fast shortcut to gain the upperhand, he just assured me that we needed to trust the system, and show the truth and put the work in and everything would be okay! Again easy to work with him and to set a plan. As time went out and Brian and I were able to show the truth to the court and the parties involved appointed by the court it was deemed that I should be awarded full custody and that I had the best interest for the children. That's my story in a nutshell, and to tell you where I came from and where I ended up Brian and his firm worked their tails off and got me custody of my kids! Their was times I spoke to Brian at 11 pm at night to have my mind put at ease or to go over my case, sometimes on the weekends, he always returned calls and emails. As a matter of fact my mother just passed away and after the custody and divorce was over he still reached out to me to let me know that he was sorry for my loss. I haven't had a lot of dealings with lawyers but I assure you of this he cares about his clients and he fights for them! I went from only being able to see my children based off lies from my ex to getting full custody as he fought hard for me. While I may sound like a broken record here, I am trying to show you the reader who may be looking for a lawyer that will fight for you, Brian is the man that you need to use! Thank you so much for your help, your partnership in walking with me as it was the hardest time of my life, but thank you! I am very thankful and when I looked you in the eyes and shook your hand I meant what I said! You took care of me like family, I won't forget that! I hope you nothing but the best, and hopefully I won't need you again but if I do, I know that I got the truth on my side and a lawyer and firm who will fight to win for my children and myself!

What a Child Custody Lawyer Can Do for You

A child custody lawyer specializes in helping parents navigate legal matters related to the custody and care of their children, particularly in the context of divorce, separation, or other family disputes. These lawyers assist with determining custody arrangements, drafting parenting plans, and advocating for your rights in court. They also help resolve disputes over physical custody (where the child lives), legal custody (who makes decisions for the child), visitation rights, and modifications to existing custody orders.

Whether you're going through a divorce or need to change an existing custody arrangement, a child custody lawyer can help you understand your rights and protect your child's best interests throughout the legal process.

When Should I Hire a Child Custody Lawyer?

You should consider hiring a child custody lawyer in several situations, especially when disputes arise or complex legal issues affect your parental rights. Some common reasons to hire a child custody lawyer include:

  • Divorce or separation: If you're going through a divorce or separation and need to establish custody and visitation arrangements, a lawyer can help ensure the custody order reflects your child's best interests.
  • Disputed custody cases: If you and the other parent cannot agree on custody or visitation terms, a lawyer can advocate for your rights in court and help you develop a strong case.
  • Modification of custody orders: If you need to change an existing custody arrangement due to changes in circumstances (e.g., relocation, changes in the child’s needs), a lawyer can help file a modification request.
  • Parental alienation: If the other parent is interfering with your relationship with your child, a lawyer can help address these issues through legal action.
  • Domestic violence or abuse: If there is a history of domestic violence or abuse, a lawyer can help protect you and your child by requesting restraining orders and advocating for appropriate custody arrangements.
  • Grandparent or third-party custody: If you are a grandparent or another relative seeking custody or visitation rights, a lawyer can guide you through the legal process.
  • Paternity disputes: In cases where paternity is in question, a lawyer can assist with establishing or challenging paternity, which may affect custody and visitation rights.

Hiring a lawyer early in the process can help protect your parental rights and ensure that the custody arrangement is in your child's best interests.

What Does a Child Custody Lawyer Do?

A child custody lawyer provides a variety of legal services to help parents resolve custody disputes and secure favorable custody arrangements for their children. Their responsibilities often include:

  • Filing custody petitions: Helping you file the necessary paperwork to request custody or visitation rights and ensuring all legal procedures are followed.
  • Negotiating custody agreements: Assisting in negotiating custody and visitation arrangements, often working toward a mutually beneficial parenting plan without going to court.
  • Representing you in court: If you and the other parent cannot agree on custody terms, representing you in court by presenting evidence and making legal arguments to support your case.
  • Drafting parenting plans: Helping you draft a comprehensive parenting plan that outlines the schedule for physical custody, decision-making responsibilities, and visitation.
  • Handling child support issues: Assisting with related issues such as child support, ensuring that financial obligations are properly calculated and enforced.
  • Modifying custody orders: Helping you request a modification from the court if you need to change an existing custody arrangement due to significant life changes.
  • Mediating custody disputes: Acting as a mediator to help both parents reach an agreement on custody and visitation without the need for litigation.

How Are Child Custody Lawyers Paid?

Child custody lawyers typically charge for their services based on the complexity of the case, the time involved, and the nature of the legal work. Common payment methods include:

  • Hourly rate: Most child custody lawyers charge by the hour, with rates ranging from $150 to $500 or more, depending on the lawyer's experience and location. The total cost depends on the time spent preparing documents, negotiating, and representing you in court.
  • Flat fee: For simple custody matters or uncontested custody agreements, some lawyers may offer a flat fee for specific services, such as drafting a parenting plan or filing a custody petition.
  • Retainer: Many lawyers require an upfront retainer fee, which is billed against as the lawyer works on your case. The amount varies based on the expected complexity and duration of the case.
  • Sliding scale or pro bono services: Some lawyers may offer reduced fees or pro bono (free) services for clients with limited financial means, particularly in cases involving domestic violence or other serious issues.

It’s important to discuss fees and payment arrangements with your lawyer during the initial consultation to understand how much you will be charged and what services are included.

How Much Does a Child Custody Lawyer Cost?

The cost of hiring a child custody lawyer depends on various factors, including the complexity of the case, whether it’s contested or uncontested, and the lawyer’s experience. General cost estimates include:

  • Uncontested custody cases: Legal fees may range from $1,500 to $5,000 or more, depending on the complexity of the paperwork and any negotiations.
  • Contested custody cases: Legal fees can range from $5,000 to $40,000 or more, depending on the complexity of the issues, the need for expert testimony, and the time spent in litigation.
  • Hourly rates: Lawyers typically charge between $150 and $500 per hour, with higher rates for more experienced attorneys or complex custody disputes.
  • Mediation services: If both parents agree to work through mediation, costs typically range from $1,000 to $5,000 or more for the mediation process.

Always ask for a clear cost estimate during your consultation to ensure that you understand the total legal fees and payment structure.

Top Questions to Ask a Child Custody Lawyer

Before hiring a child custody lawyer, it’s essential to ask the right questions to ensure they are the best fit for your case. Some key questions to ask include:

  1. What experience do you have with child custody cases?
Ensure the lawyer has experience handling cases similar to yours, especially if your case involves complex issues like domestic violence, relocation, or paternity disputes.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, offers flat fees for certain services, or requires a retainer, and ask for an estimate of the total cost.
  3. What is the likelihood of success in my case?
Ask for an honest assessment of your case, including potential challenges and expected outcomes.
  4. How long will the process take?
Inquire about the expected timeline from filing the petition to reaching an agreement or going to trial.
  5. Will you personally handle my case?
Ensure you know who will be managing your case and representing you in court.
  6. Can we pursue mediation or alternative dispute resolution?
Ask whether the lawyer recommends mediation or other forms of dispute resolution to avoid a lengthy court battle.

How to Check the Credibility of a Child Custody Lawyer

To ensure you are hiring a reputable child custody lawyer, follow these steps to verify their credentials and experience:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed to practice and has no history of disciplinary actions.
  • Look for family law experience: Review the lawyer’s website or professional profile to ensure they specialize in family law and child custody cases.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to gauge the lawyer’s professionalism and success in child custody matters.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on custody cases.
  • Check for certifications: Look for lawyers who are board-certified in family law or have memberships in organizations like the American Academy of Matrimonial Lawyers (AAML) or local family law sections.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with a child custody lawyer, come prepared with relevant documents and information:

  • Court orders or existing custody agreements: Bring copies of any existing custody or visitation orders for the lawyer to review.
  • Communication with the other parent: Provide copies of emails, texts, or letters regarding custody, visitation, or disputes.
  • List of your child’s needs: Prepare a list of your child’s specific needs, such as medical care, education, and extracurricular activities.
  • Timeline of the case: Outline key events related to your custody case, including changes in living situations or parental involvement.
  • Questions for the lawyer: Write down any questions about the custody process, legal fees, and the lawyer’s strategy for your case.

By being well-prepared, you can help the lawyer assess your situation effectively and receive the best possible advice for protecting your rights and your child’s well-being.
