Lindsey Straus recently assisted our retail business with trademark issues. She was referred to us by our local chamber of commerce and we are so glad to have had her expertise and experience guiding us. She is extremely thorough, very responsive and advised on all the legal issues involving a trademark. We had met with others re: our trademark and chose The Law Office of Lindsey Straus to represent us, and we definitely made the right decision. Highly recommend!

Lindsey prepared trusts, last will and testaments, powers of attorney, trustees certificates and health care proxies for my wife and me. She was extremely expedient but thorough and prepared all these documents for a third of the price of a Hyannis lawyer who had quoted the job. Her handling of our personal preferences for last rites was particularly compassionate.

A few short years ago my company ran into an egregious trademark and copyright infringement. In reviewing local attorneys, I discovered Ms Straus had extensive experience in the field and hired her. Despite the complexity of the case, we achieved a resounding success and very quickly. We again ran into yet another similar infringement in the past couple months so I called upon Attorney Straus yet again. And again, in a matter of only a couple weeks she was able to shut down the violation and bring it to a quick resolve. Not only that, it ended up not costing me a penny. Should we find ourselves confronted with yet another ne'er-do-well attempting to steal our IP down the road, be assured we know who to call. I recommend anyone else do the same.

I worked with John for a brief time where he negotiated licensing and IP deals that could be very complex. My past experience in entertainment IP saw many deals fall apart for lack of mutual understanding in this very new territory. Not the case with John, he was diligent, thoughtful and speaks in terms all can understand. I continue to consult with John on personal business and trust him to always be straight and guide me to the best solution.

I can't speak highly enough about Valerie. First off, she's an amicable person. I know that doesn't count for much in a world governed by law, but just her tone of voice is so comforting. And it's nice to have a lawyer you feel like you can trust. She is a professor @ Berklee College of Music in Boston, MA. So if that doesn't scream credibility, then I don't know what does! Let's get down to business: Valerie knows everything regarding music law. Period. End. You will never need to retain another lawyer. And she's honest! I feel like most lawyers just want quick money. But her rates are surprisingly quite reasonable. I highly doubt you'll find another lawyer with rates as competitive as hers, who will put the same amount of time and energy into your case(s) as she will. Valerie helped my band with trademarks, copyrights, professional name searches, and so much more. Seriously, without Valerie we probably would have made a several major mistakes upon entering the music industry. She helped us dodge & squash all of that, along with a few red flag issues we were having with our former recording studio. I've learned so much in the process as well. As a result, I'm more aware, and I feel like a better musician now. Valerie doesn't offer free consultations. BUT the pre-consultation form is pretty much a free consultation in itself. I like it because it asks you questions that you may not have even thought of yet because you've been focused on making music/booking gigs. For example: your goals, your concept, if you have a manager/agent, your creative process, copyrights filings, etc. It gets you really thinking about the overall bigger picture. And it helps Valerie get to know you or your band better. From there, she can help guide you in the right direction. I remember my consultation with was 2 hours long. We literally covered at least 10+ different things extensively over the phone. I couldn't remember some of what we discussed the next day, but I was SO happy when 2 days later she emailed me a professionally drafted follow up consultation document that contained everything we talked about in detail. It had a glossary, and everything. Just like a book. She even included a to do list, ha! That consultation was worth every single penny! And I still reference the follow up document every now and then when I need to.

Valerie is an outstanding music attorney. She's smart, fair, organized, proactive, and a pleasure to work with. She's great at the big picture and fine details and she's excellent at what she does. Indeed, she usually finds errors in my third-party contracts that they are thrilled to learn of and fix. Valerie does what she says she'll do, for the price she quotes and in the time she says it will take. She's a woman of her word. There are never any surprises. People looking for a music attorney should jump at the chance to work with Valerie Lovely.

I cannot speak highly enough of Valerie. She has reviewed several contracts for me and ensured I was protected in a copyright dispute! She is incredibly responsive, even replying on weekends, If you are lucky enough to retain her services you will not be disappointed. She takes great care of small artists, going out of her way to help my co-writer and I avoid some common contractual errors. I always look forward to working with her, she is fantastic!

Martsyl Joseph is a very conscientious lawyer who doesn't just look at all the legal aspects of a case, but also realizes that there are individuals involved. She is very responsive to any e-mails, phone calls, texts or requests to meet in person. In my particular case she actually came to the site that was being contested and that is the personal touch that she provides. Therefore when she represents you in court, you know that she knows the situation first hand and can speak about it effectively and understands the gravity of the matter because she took the time to know your particular situation personally. Martsyl Joseph also let's you know when she isn't always sure about a legal aspect of the case, however she gets back to you as soon as she does the research for the best course of action. There wasn't any aspect of her representation that was unsatisfactory. I certainly would recommend Martsyl Joseph to anyone else that I know either just needs legal advice or representation.

I cannot imagine better attorneys. I was in an accident with a long recovery period and they were by my side the whole way. Their knowledge helped me through things I never could have navigated on my own. Leslie and Karen were patient, kind, and supportive of me for over a year until my case was settled. It could have been one of the worst experiences of my life, instead, they handled all of my bills and paperwork, listened compassionately, and fought to get me the settlement I deserved. I am forever grateful and can't recommend them strongly enough.

My sister and I had Karen as our lawyer for a motor vehicle accident that occurred last summer. Karen met us at a local cafe, and talked us through the process and told us what we should expect. She was in contact with us, provided updates (without us having to ask her for them), and pushed to get us the best settlement. She is an advocate for women and does her job well. I would recommend her and the firm!

I was referred to Burns & Jain and specifically Neil Burns through a lawyer who practiced a different type of law. From the first phone call with Neil, I felt comfortable in my choice. He made what had been a difficult time in our lives easier. He is hard working professional who makes himself and his team fully available to clients throughout the process at any time. The Burns & Jain team are a dedicated group of individuals who offer thorough explanation at each step of the legal process and through their kindness help you to feel comfortable and able to see the process through. My daughter and I were in a horrible head-on car accident, Neil and his team were able to help both of us navigate the legal channels and get insurance coverage maximized for us both. I would highly recommend the Burns & Jain team when you are seeking legal counsel.

I scheduled a 30 minute free consultation. Marvin was 15 minutes late and rushed to end the phone call. The call lasted 8 minutes. Some of my questions were answered. At the end of the 8 minutes I had additional questions to ask. While I was mid-asking my questions, he ended the call. I completely understand time is money, but my purpose for this consultation was to ultimately determine if Marvin is the lawyer I plan to hire. If the intent were to have a 15 minute max discussion then why are 30 minute blocks available? Or, provide an email informing me of the shorten duration of allocated time. If 8 minutes were only available, then I would have rearranged my questioning accordingly. I dislike giving poor reviews in a customer centric environment because I have been there myself, but I felt like my call inconvenienced Marvin and I felt extremely undervalued.

Every year Boston magazine publishes the results for top attorneys in Boston from different legal specialties, from business and criminal law to family and employment law. If there are top 100 attorneys; Edward Wayland would be voted as the top 10 WORST attorneys in Boston. I'm very grateful I had made the right decision to terminate him for ineffectiveness of his counsel. About few years ago, To today's day, I never regretted (terminating) firing Edward Wayland. He almost ruined my life and my freedom. lack of communication, Failure to exercise diligence, ineffectiveness of his counsel, and Incompetence, Incompetence, and Incompetence. I'm in the process of filing a complaint against him to the Massachusetts Board of Bar Overseer; Attorney and Consumer Assistance Program (ACAP), I think he should get his license suspended or revoked. (everything I stated here is true except for the top 10 worst attorneys).

I would like to share with everyone the extremely positive experience we had with Attorney Edward Wayland. We were "in the weeds" and getting "bullied" by opposing counsel. Edward just calmly and rationally cut through "the sideshow" intended to distract and turned the situation around 180 degrees. Most importantly Edward held to his integrity and achieved a "just" outcome. I am happy to speak with anyone directly as this is a real experience. You can contact Edward for my details.

What a Copyright Lawyer Can Do for You

A copyright lawyer specializes in helping individuals and businesses protect their creative works by navigating the complexities of copyright law. They assist with registering copyrights, enforcing rights against infringement, drafting licensing agreements, and advising on the fair use of copyrighted material. Whether you're an author, artist, musician, software developer, or content creator, a copyright lawyer can help ensure your intellectual property is legally protected and monetized appropriately.

When Should I Hire a Copyright Lawyer?

You should consider hiring a copyright lawyer in the following situations:

  • Registering a copyright: While copyright protection exists upon the creation of an original work, registering your copyright with the U.S. Copyright Office provides legal advantages, such as the ability to file a lawsuit for infringement and eligibility for statutory damages and attorney's fees.
  • Enforcing your rights: If someone is using your work without permission, a lawyer can help you enforce your rights by sending cease and desist letters, negotiating settlements, or filing infringement lawsuits.
  • Defending against infringement claims: If you're accused of infringing someone else's copyright, a lawyer can defend you by assessing the validity of the claim and representing you in negotiations or court proceedings.
  • Drafting and reviewing contracts: When creating licensing agreements, work-for-hire agreements, or transferring ownership of a copyright, a lawyer can ensure the terms are legally sound and protect your interests.
  • Fair use assessment: If you plan to use copyrighted material under the fair use doctrine, a lawyer can evaluate the risks and advise on compliance to prevent potential legal issues.
  • International copyright concerns: If you need to protect your work internationally, a lawyer can guide you through the process of securing rights in other countries and navigating international treaties.

What Does a Copyright Lawyer Do?

A copyright lawyer provides a range of legal services related to the creation, protection, and enforcement of copyrighted works:

  • Copyright registration: Assist in preparing and filing applications with the U.S. Copyright Office, ensuring all legal requirements are met for successful registration.
  • Legal advice on protection strategies: Offer guidance on how to safeguard your work, including the best practices for documentation and disclosure.
  • Drafting and negotiating agreements: Prepare contracts such as licensing agreements, assignments, and work-for-hire agreements to monetize your work while protecting your rights.
  • Enforcement actions: Take legal steps against infringers, including sending cease and desist letters, negotiating settlements, and litigating infringement cases.
  • Defense against infringement claims: Represent you if accused of infringement, developing defense strategies and handling negotiations or court proceedings.
  • Fair use evaluation: Analyze whether your intended use of copyrighted material qualifies as fair use under the law, reducing the risk of infringement.
  • International protection: Advise on securing copyright protection abroad and complying with international intellectual property laws and treaties.

How Are Copyright Lawyers Paid?

Copyright lawyers typically charge for their services in the following ways:

  • Hourly rate: Many lawyers bill by the hour, with rates ranging from $200 to $600 or more, depending on experience and location.
  • Flat fee: For straightforward tasks like filing a copyright application or drafting a simple contract, some lawyers offer flat fees, which provide cost predictability.
  • Retainer: For ongoing services, a lawyer may require a retainer - a lump sum deposited in advance - against which hourly fees are charged.
  • Contingency fee: In some infringement cases, especially those involving significant damages, a lawyer may work on a contingency basis, receiving a percentage (typically 25% to 40%) of any settlement or judgment.

It's important to discuss payment arrangements upfront to understand the total cost and billing practices.

How Much Does a Copyright Lawyer Cost?

The cost of hiring a copyright lawyer varies based on the complexity of your needs:

  • Copyright registration: Legal fees for preparing and filing a copyright application typically range from $250 to $1,000, plus U.S. Copyright Office filing fees (which are $45 to $85 per application as of 2024).
  • Contract drafting or review: Fees for drafting or reviewing agreements can range from $500 to $2,500 or more, depending on complexity.
  • Infringement matters:
    • Cease and desist letters: Sending a letter may cost between $500 and $1,500.
    • Negotiations and settlements: Legal fees can range from $2,000 to $10,000 or more.
    • Litigation: Taking a case to court can be expensive, with costs ranging from $10,000 to over $100,000, depending on the case's complexity and duration.
  • Hourly rates: Expect to pay between $200 and $600 per hour for most services.

Always request a detailed cost estimate during your initial consultation to understand the potential expenses involved.

Top Questions to Ask a Copyright Lawyer

Before hiring a copyright lawyer, consider asking the following questions:

  1. What experience do you have with copyright law?
Ensure the lawyer has specific expertise in copyright matters similar to yours.
  2. How do you charge for your services?
Clarify the fee structure, including hourly rates, flat fees, or contingency fees, and any additional costs.
  3. What is the process for registering my copyright?
Ask about the steps involved, timelines, and what information you'll need to provide.
  4. How can I enforce my copyright if someone infringes it?
Discuss enforcement options, potential remedies, and the likelihood of success.
  5. What are the risks involved in my situation?
Whether you're protecting your work or using someone else's, understand the legal risks and how to mitigate them.
  6. Can you assist with international copyright protection?
If you need global protection, inquire about the lawyer's experience with international copyright laws and treaties.
  7. What strategies can you suggest for licensing my work?
Explore options for monetizing your copyright through licensing agreements and how to structure them effectively.

How to Check the Credibility of a Copyright Lawyer

To ensure you're hiring a reputable copyright lawyer:

  • Verify their license: Check with your state's bar association to confirm the lawyer is licensed and in good standing.
  • Review their experience: Look for lawyers who specialize in intellectual property law, particularly copyright issues.
  • Read client reviews and testimonials: Websites like Avvo, Martindale-Hubbell, or Google Reviews can provide insights into the lawyer's reputation and client satisfaction.
  • Ask for references: A credible lawyer should be willing to provide references from past clients.
  • Professional memberships: Membership in organizations like the American Intellectual Property Law Association (AIPLA) or the International Trademark Association (INTA) indicates a focus on intellectual property law.
  • Check for certifications: Some lawyers hold certifications or advanced degrees in intellectual property law, demonstrating specialized expertise.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a copyright lawyer, bring the following:

  • Descriptions of your work: Provide detailed descriptions or copies of the work you wish to protect, such as manuscripts, recordings, software code, or artwork.
  • Evidence of creation: Documentation that proves when and how you created the work, such as drafts, timestamps, or metadata.
  • Existing agreements: Any contracts, licensing agreements, or previous registrations related to your work.
  • Infringement evidence (if applicable): If someone is infringing your copyright, bring evidence like copies of the infringing material, URLs, screenshots, or witness statements.
  • Questions and concerns: Prepare a list of questions about your rights, the registration process, enforcement options, and any potential legal risks.
  • Goals and objectives: Be clear about what you hope to achieve, whether it's registering your work, licensing it, or taking action against an infringer.

By coming prepared, you enable the lawyer to provide accurate advice and develop an effective legal strategy tailored to your needs.
