Ryan was the only attorney who listened enough to actually help me define what I needed to do. Other attorneys I sought out didn’t listen and just dismissed my situation as too niche, and to go to the Bar Association for a referral (which they don’t do, by the way). Not only was he efficient and effective, he was soooooo incredibly kind and educational. Please go to him if you are the curious type and want to understand legal matters because he’s got a knack for clarity and extremely patient and sensitive, too. He made me feel supported and empowered. Thank you so much, Ryan!!!

Ms. Morado was absolutely invaluable in helping me navigate a bewildering publishing/art/licensing/permissions debacle in which I was utterly in-over-my-head. What seemed insurmountably complex to me was long-familiar legal territory for her. She lucidly explained to me the process along the way; she was a fastidiously professional steward of time-tracking and invoicing; she graciously interfaced on my behalf with a rather stressful third party; and, in the end, she navigated myself and the other party to a clean, fair, mutually agreeable conclusion. I couldn't be more pleased, and can recommend her services categorically.

Nick helped me and my friend through a years-long legal situation. Throughout the process, he was thorough, informative, and supportive. Nick was well informed on housing and tenant law. Beyond that, however, I felt as if Nick cared for us as individuals and really worked to protect our dignity throughout the situation. He also worked with us to reduce legal costs throughout the entire process. I am very grateful for Nick's support and would recommend him to anyone facing housing or tenant issues.

Referred by our usual corporate counsel, David was engaged to help us pursue a number of different companies who had copied and used photos that we create as part of our business. he was diligent and thorough. his apporach and relationship allowed us to pursue them financially. He was able to secure payments for damages from the firms and we hope to use his services to pursue others in the future. It appears that other companies will steal photos again in the future and its nice to know David will be available to help us stop them.

A person contacted me, without the use of an attorney, to accuse me of infringing on their patent. I was definitely not infringing, but I consulted with Ms. Oemig about the best course of action I could take to protect my business from that person. The person was threatening to contact a company I do business with to notify them of patent infringement. I hired Ms. Oemig to proactively contact that company so that my business relationship with the company would not be jeopardized. Everything worked out fine in the end thanks to Ms. Oemig's work. Ms. Oemig is knowledgeable, reliable, and timely. I hope I don't have anymore IP issues in the future, but if I ever do, I know whom I'll be contacting.

I brought Mike in as an IP litigator to represent a client of mine (IPCo) whose dispute with an infringer moved past the sparring stage into litigation. Mike quickly got up to speed on the matter, assembled a strong team, and developed the strategy to prosecute the infringement action. He and his team was diligent and committed - even drafting a brief over the July 4th holiday. The infringer claimed that it had the right to use IPCo's IP based on an expired license agreement. Mike's efforts led to a settlement that constituted a total victory - the infringer agreed to stop infringing, entered into a new favorable license agreement with IPCo, and made a settlement payment to IPCo that exceeded its total legal fees in the matter. He and his team were also consummate professionals and a pleasure to work with.

It was great working with Ms. Amy Jones. I explained about my accident and injury at first in my primitive English, she was very sympathetic and really feeling for me. I just left all to her, didn’t have to do anything. She explained very well at each step of how my case was taken care of and proceeded.I can see she is very trustful and detail oriented. This is the second time I hired a lawyer for a car accident. She worked very hard for my settlement and the result was outstanding and I could not believe what I heard. I am very lucky that I was introduced to her by my chiropractitioner. I felt finally released from anxiety for future and resentment that I got from the accident. Thank you so much, Amy and Herman Law Group! I definitely recommend them as the prestigious law firm in WA since 1950

Was involved with copyright infringement few years back. Having never been involved in such things and not knowing what to do, we panicked. Spoke to an attorney who wanted to meet up to do other things that would cost us more money. After speaking with John over the phone, he gave us options. John was professional, straight forward, and he gave us comfort. He kept us updated throughout the duration of the case. Everything was simple and convenient as it was all done via email or phone. His rate was fair and much cheaper than the alternative. The case is far behind us now, but John deserves this review. Will definitely use/recommend him in the future for patent, copyright and such cases. Thank you, John.

I have had an excellent experience with CCL and Ms. Choi in the matter of a complicated easement / title situation. The office staff was super responsive, appointments were scheduled quickly and in collaboration with my schedule/availability, and the meetings I had with Ms. Choi were focused, organized, and super productive. I felt that Ms. Choi was prepared for the meetings, understood what I was dealing with, and discussed with me multiple options and potential outcomes regarding this legal matter, which is going to end up in Court. I could not have asked for a better attorney for my situation (and I have consulted with others prior to CCL) and I very much look forward to my ongoing work with CCL and Ms. Choi. I did not have a good experience with the law firm. My main issues is that Boyoon Choi would repeatedly interrupt me and cut me off before I could finish speaking and there were some mannerisms like scoffing (in a subtle but noticeable way) that came off as pretty condescending and I received a general negative feeling from the tone of voice she used with me. She was also 6 minutes late to our Zoom meeting but cut our 30 minute meeting short nonetheless so we really only had 24 minutes together. I'm sure she would probably bill the time for 30 minutes to my MetLife benefits and not the 24 minutes that I actually got. The way I see it, if a client does not have the correct understanding then inform them in a respectful way. Trying to be subtle with mannerisms like quietly scoffing or responding with a negative tone, one that felt a bit indignant towards me feels less like you're working with someone that's trying to advocate for you and more like you're talking to someone that's trying to take out whatever stress she may be having towards you. It seems that no wonder her staff seems to sound a bit on edge over the phone as I can imagine what it can be like to be subjected to that over time. She also knew that my home is in Snohomish County but told me that she can't help with the eviction process in that area, but took my money through my MetLife benefit anyway. That's pretty messed up. Lastly, I also felt it was problematic to be told that she did not know the RCW that covered why a 90 day notice to vacate due to sale is not enforceable unless it is specifically mentioned in the lease agreement. When I requested clarification for her to specify how is this the case, she could only tell me it's part of the general landlord tenant rights that a lease agreement has to specify that an early termination can take place due to sale and that this language would not be specifically mentioned due to it being covered under the general umbrella of tenant rights. However, RCW 59.18.650 clearly states it's permissible for a landlord to end a lease agreement early with cause for the purpose of selling a home. Boyoon Choi should really be careful with giving advice that she clearly does not know the basis for. It is concerning when you ask for the RCW that she does not know it, and scoffs at you while mentioning it's part of the general rights for a tenant. Anyways, here is what I was told by another source about the permissibility of ending a lease early to sell the home: In Washington State, typically, if a landlord provides a 90-day notice to vacate for the purpose of selling the property, this is generally considered lawful. In Washington State, the enforceability of a 90-day notice to vacate due to the sale of a property typically does not require a specific clause in the lease agreement stating that sale of the home entails the tenant moving out. The standard process allows landlords to issue such a notice as part of the rights to dispose of their property, assuming other legal and procedural requirements are met (e.g., proper notice period and service). Lastly, she was also incorrect about my MetLife legal benefit. She said I don't have benefits for litigation as part of my benefit but in my MetLife portal it clearly states: "This service covers the Participant as a landlord for matters involving leases, security deposits and disputes with a residential tenant. The service includes attorney services for the eviction of a tenant up to and including trial."

Kyle was the patent attorney for AEON Law when our our small technology firm needed to file a patent. The process started in 2011. From the start we found Kyle to be very difficult to communicate with. He tends to talk more than listen and it is difficult for him to grasp complex technical concepts. He seemed to erroneously hang on to incorrect technical descriptions even after instructing him he missed the relevance. He was not diligent in forwarding correspondence from the patent office and in one case allowed the the application laps. I believe he had difficulty listening to the examiner's recommendations on how to modify the application to get allowances. Our firm spent a lot of money and Kyle could he not get the job done. In 2016 after much frustration we moved our application to another firm. After reworking Kyle's work we received the patent in 2017. He is a nice guy but did not do a good job for us.

I am the business development manager for a small Washington based company. Kyle Flindt was referred to us by our lawyer to secure a patent for our invention. We spent several years developing our product and had secured a provisional patent in 2008 through an online service. We marketed our product through our website, tradeshows, newsletters and mailings. It generated a lot of interest but very few sales. As our time limit on the provisional patent approached we were faced with a difficult decision, spend additional thousands of dollars pursuing a full patent on a product that may not be successful or abandoning the project. Shortly before the deadline date another company expressed interest in our product and sales started to pick up. We made the decision to proceed with the patent. This is where Kyle Flindt stepped in. I met with Kyle to discuss our situation including our budget. Kyle and I agreed to a fee for his services. He immediately went to work. His dedication, knowledge and professionalism were most impressive. He immediately grasped the concept of our product and made recommendations on how to word the documents to protect ourselves with future applications that we were not considering at this time. He completed the paperwork and literally drove it to the post office to insure a midnight postmark the day before our deadline. What is truly remarkable is that he completed all this in less than 5 days. I am absolutely convinced that there are very few patent attorneys who would show that level of dedication to a new client. I have told many of my colleagues about Kyle’s services and will continue to enthusiastically recommend him. We are currently in the planning stages of a new product that will require Kyle’s legal expertise in the future and I’m looking forward to working with him again but, next time I promise to give him more than a week to do his job.

When it came to selecting an attorney to provide Intellectual Property protection for my startup company, I had to draw on my experience at bigger corporations. Kyle Flindt had an advantage out of the gate: he had provided IP legal support to larger firms in the area so I was familiar with his processes. What truly impressed me was Kyle's ability to scale across a broad range of clients and a broad spectrum of IP protection work. He was truly flexible to work in "startup mode" with us: he came to our meetings, tolerated our scheduling challenges, and engaged with us on a deeply technical level to help us creatively protect our IP. Most importantly, he provided us great value for our dollars spent. As a frugal startup in tough economic times, we had to ask Kyle to work on a budget. He was up front about costs with us, stayed on budget, and provided more value that we had expected over the long haul. Because of this, I'll be turning to Kyle again with future businesses... large and sma

What a Copyright Lawyer Can Do for You

A copyright lawyer specializes in helping individuals and businesses protect their creative works by navigating the complexities of copyright law. They assist with registering copyrights, enforcing rights against infringement, drafting licensing agreements, and advising on the fair use of copyrighted material. Whether you're an author, artist, musician, software developer, or content creator, a copyright lawyer can help ensure your intellectual property is legally protected and monetized appropriately.

When Should I Hire a Copyright Lawyer?

You should consider hiring a copyright lawyer in the following situations:

  • Registering a copyright: While copyright protection exists upon the creation of an original work, registering your copyright with the U.S. Copyright Office provides legal advantages, such as the ability to file a lawsuit for infringement and eligibility for statutory damages and attorney's fees.
  • Enforcing your rights: If someone is using your work without permission, a lawyer can help you enforce your rights by sending cease and desist letters, negotiating settlements, or filing infringement lawsuits.
  • Defending against infringement claims: If you're accused of infringing someone else's copyright, a lawyer can defend you by assessing the validity of the claim and representing you in negotiations or court proceedings.
  • Drafting and reviewing contracts: When creating licensing agreements, work-for-hire agreements, or transferring ownership of a copyright, a lawyer can ensure the terms are legally sound and protect your interests.
  • Fair use assessment: If you plan to use copyrighted material under the fair use doctrine, a lawyer can evaluate the risks and advise on compliance to prevent potential legal issues.
  • International copyright concerns: If you need to protect your work internationally, a lawyer can guide you through the process of securing rights in other countries and navigating international treaties.

What Does a Copyright Lawyer Do?

A copyright lawyer provides a range of legal services related to the creation, protection, and enforcement of copyrighted works:

  • Copyright registration: Assist in preparing and filing applications with the U.S. Copyright Office, ensuring all legal requirements are met for successful registration.
  • Legal advice on protection strategies: Offer guidance on how to safeguard your work, including the best practices for documentation and disclosure.
  • Drafting and negotiating agreements: Prepare contracts such as licensing agreements, assignments, and work-for-hire agreements to monetize your work while protecting your rights.
  • Enforcement actions: Take legal steps against infringers, including sending cease and desist letters, negotiating settlements, and litigating infringement cases.
  • Defense against infringement claims: Represent you if accused of infringement, developing defense strategies and handling negotiations or court proceedings.
  • Fair use evaluation: Analyze whether your intended use of copyrighted material qualifies as fair use under the law, reducing the risk of infringement.
  • International protection: Advise on securing copyright protection abroad and complying with international intellectual property laws and treaties.

How Are Copyright Lawyers Paid?

Copyright lawyers typically charge for their services in the following ways:

  • Hourly rate: Many lawyers bill by the hour, with rates ranging from $200 to $600 or more, depending on experience and location.
  • Flat fee: For straightforward tasks like filing a copyright application or drafting a simple contract, some lawyers offer flat fees, which provide cost predictability.
  • Retainer: For ongoing services, a lawyer may require a retainer - a lump sum deposited in advance - against which hourly fees are charged.
  • Contingency fee: In some infringement cases, especially those involving significant damages, a lawyer may work on a contingency basis, receiving a percentage (typically 25% to 40%) of any settlement or judgment.

It's important to discuss payment arrangements upfront to understand the total cost and billing practices.

How Much Does a Copyright Lawyer Cost?

The cost of hiring a copyright lawyer varies based on the complexity of your needs:

  • Copyright registration: Legal fees for preparing and filing a copyright application typically range from $250 to $1,000, plus U.S. Copyright Office filing fees (which are $45 to $85 per application as of 2024).
  • Contract drafting or review: Fees for drafting or reviewing agreements can range from $500 to $2,500 or more, depending on complexity.
  • Infringement matters:
    • Cease and desist letters: Sending a letter may cost between $500 and $1,500.
    • Negotiations and settlements: Legal fees can range from $2,000 to $10,000 or more.
    • Litigation: Taking a case to court can be expensive, with costs ranging from $10,000 to over $100,000, depending on the case's complexity and duration.
  • Hourly rates: Expect to pay between $200 and $600 per hour for most services.

Always request a detailed cost estimate during your initial consultation to understand the potential expenses involved.

Top Questions to Ask a Copyright Lawyer

Before hiring a copyright lawyer, consider asking the following questions:

  1. What experience do you have with copyright law?
Ensure the lawyer has specific expertise in copyright matters similar to yours.
  2. How do you charge for your services?
Clarify the fee structure, including hourly rates, flat fees, or contingency fees, and any additional costs.
  3. What is the process for registering my copyright?
Ask about the steps involved, timelines, and what information you'll need to provide.
  4. How can I enforce my copyright if someone infringes it?
Discuss enforcement options, potential remedies, and the likelihood of success.
  5. What are the risks involved in my situation?
Whether you're protecting your work or using someone else's, understand the legal risks and how to mitigate them.
  6. Can you assist with international copyright protection?
If you need global protection, inquire about the lawyer's experience with international copyright laws and treaties.
  7. What strategies can you suggest for licensing my work?
Explore options for monetizing your copyright through licensing agreements and how to structure them effectively.

How to Check the Credibility of a Copyright Lawyer

To ensure you're hiring a reputable copyright lawyer:

  • Verify their license: Check with your state's bar association to confirm the lawyer is licensed and in good standing.
  • Review their experience: Look for lawyers who specialize in intellectual property law, particularly copyright issues.
  • Read client reviews and testimonials: Websites like Avvo, Martindale-Hubbell, or Google Reviews can provide insights into the lawyer's reputation and client satisfaction.
  • Ask for references: A credible lawyer should be willing to provide references from past clients.
  • Professional memberships: Membership in organizations like the American Intellectual Property Law Association (AIPLA) or the International Trademark Association (INTA) indicates a focus on intellectual property law.
  • Check for certifications: Some lawyers hold certifications or advanced degrees in intellectual property law, demonstrating specialized expertise.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a copyright lawyer, bring the following:

  • Descriptions of your work: Provide detailed descriptions or copies of the work you wish to protect, such as manuscripts, recordings, software code, or artwork.
  • Evidence of creation: Documentation that proves when and how you created the work, such as drafts, timestamps, or metadata.
  • Existing agreements: Any contracts, licensing agreements, or previous registrations related to your work.
  • Infringement evidence (if applicable): If someone is infringing your copyright, bring evidence like copies of the infringing material, URLs, screenshots, or witness statements.
